1. Introduction1.1 This is the Statement of Reasons of the Council in support of the LondonBorough of Hammersmith & Fulham (Shepherds Bush Market) CompulsoryPurchase Order 2012 (the “Order”).1.2 The primary purpose of the Order is to facilitate the redevelopment andregeneration of Shepherds Bush Market (the “Market”), and adjoining area tocontribute towards significant social, economic and environmentalimprovements. This will be achieved through the assembly and developmentof the Market area and the immediately adjoining commercial interests inGoldhawk Road (the “Order Lands”) which will support the enlargement andimprovement of the Market and improve its setting by bringing vacantbrownfield land into beneficial use.1.3 The Market itself is a mix of retail trading units beneath and running alongsidethe Hammersmith and City tube line viaduct between Shepherds Bush Marketstation and Goldhawk Road station. It is owned by London UndergroundLimited and managed by Transport for London. It is widely accepted that theMarket has been in decline for more than a decade.1.4 The Council is the freehold owner of the former Spring Grove CommercialLaundry site, which lies between Pennard Road and the eastern edge of theMarket. The Council has entered into a contractual option agreement withOrion Shepherds Bush Limited (the Developer) to sell this site to secure theredevelopment of this area as one element within a programme of landassembly to be undertaken by the Developer.1.5 The Developer has already secured outline planning consent for a scheme ofdevelopment on the Order Lands (Planning Applications Committee decision8 th February 2012 – planning permission issued 30 th March 2012) and hasentered into contractual arrangements in relation to two other sites within theOrder Lands boundary. Although this consent is currently subject to anapplication for judicial review, the Council does not consider there is anyobvious reason why planning permission for the project should be withheld ifit were necessary to determine the issue.1.6 The Council is now seeking to secure ownership of all the Order Lands toensure that the consented scheme may be implemented.1.7 Although the Developer has contractual control over the freehold interests inthe majority of the Order Lands, the implementation of the redevelopmentproposals requires the acquisition of all property interests currently owned bythird parties, including a number of freehold and leasehold interests as wellas other rights, and easements.1.8 The Council, in association with the Developer, has and will continue to takesteps to consult and negotiate with third party owners to acquire their’2Page 62
