Schedule 4The Developer’s ObligationsEach Party shall comply with their respective obligations in this Schedule1 Referencing Agent1.1 Unless already appointed prior to the date of this Agreement, as soon as practicableafter this Agreement is entered into, the Parties shall, using their reasonableendeavours, seek to identify prospective appointees as the Referencing Agent and itsTerms of Appointment, including the timetable within which to carry out theReferencing Exercise.1.2 Upon agreement between the Parties as to the identity of the Referencing Agent, theDeveloper shall as soon as practicable appoint the Referencing Agent at theDevelopers cost.2 Referencing Exercise2.1 The Referencing Agent shall be required to complete the Referencing Exercise assoon as is practicable and to furnish the information gathered as a result of that insuch form as may be reasonably required by the Council and the Developer, but sothat such information gathered and supplied complies with all statutory requirementsto prepare, apply for and make a CPO, including its confirmation2.2 Without prejudice to any other provision in this Agreement:2.2.1 each of the Parties shall provide the Referencing Agent such assistance as itmay reasonably request or require from time to time and do all acts and thingsnecessary; and2.2.2 the Council shall, if reasonably necessary to carry out the ReferencingExercise, use such powers, statutory or otherwise, to obtain or require (withoutlimitation) third parties to supply information as to ownership or occupation of land orinterests in land3 Compensation Assessment3.1 As soon as reasonably practicable after its appointment the Referencing Agent shallproduce to the Developer and the Council based upon the best evidence then availablea schedule listing:3.1.1 all known or anticipated CPO Interests;3.1.2 the heads of claim that the owner of those interests could be entitled to make;3.1.3 an estimated an amount (or range of amounts) for compensation for thatinterest;L1.040-CPO-CPOIA.v2.222Page 105
