espect of all or any part of the CPO Lands as the result of the severance of land incommon ownership and the cost of accommodation works the Council is required tocarry out as a direct result of the CPO in respect of land not included in the CPO andnot otherwise acquired by the Council for the Development;11 any advance payment the Council is required to make in respect of all or any part ofthe CPO Lands under the provisions of section 52 and 52A of the 1973 Act;12 any compensation payable pursuant to the provisions of sections 236, 237 or 250 ofthe 1990 Act;13 any payments require to be made by the Council under Parts I and/or II of the 1973Act arising directly from and in connection with the Development;14 stamp duty land tax and any Land Registry fees arising out of the acquisition of anyThird Party Interest or New Right;15 any monies awarded to an owner or owners of any Third Party Interest or New Rightin respect of any reference to the Lands Tribunal and costs awarded to such person bythe Lands Tribunal in respect thereof;16 to the extent the same is not covered elsewhere in this Schedule, any other payment towhich a claimant is entitled under the Compensation Code;17 a sum equal to any VAT which is paid by the Council in respect of any of the CPOCosts save to the extent that the Council obtains repayment or credit in respect of suchsums; and18 any additional costs the Council incurs as a result of the Developer refusing toapprove any payment or delaying approval of that payment or failing to provide theCouncil with the necessary funds to make a payment on the day it is due,provided always that:(a) CPO Costs shall not include costs incurred by the Council in breach of thisAgreement or as a result of any negligent act or omission on the part of the Council and theCouncil shall not be entitled to double recovery of any item of cost; and(b) CPO Costs shall include costs incurred in connection with the promotion of the CPOeven if they directly or indirectly Lime Grove Hostel but shall not (for the avoidance of doubtinclude) any and all costs incurred by or on behalf of the Council or any third party relating toor arising out of the disposal and acquisition of Lime Grove HostelL1.040-CPO-CPOIA.v2.220Page 103
