Where it is established during criminal proceedings that the accused person has died,the criminal proceedings shall be discontinued by a ruling of the investigating judge,individual judge or the president of the chamber.Article 218(1) For the duration of the proceedings, the court may order the following to pay fines ofup to 100,000 RSD: the defence counsel, proxy, legal representative, aggrieved parties,subsidiary prosecutors or private prosecutors – if the obvious aim of their actions was todelay the criminal proceedings.(2) The bar association shall be notified on the imposition of a fine on a lawyer or traineelawyer.(3) Where the public prosecutor does not submit motions to the court in a timely manneror conducts other procedural actions with substantial delays, causing the proceedings tobe prolonged, a higher public prosecutor shall be notified thereof.Article 219(1) Rules of international law shall be applied in respect of the exclusion from criminalproceedings of foreign nationals who enjoy immunity rights in Serbia.(2) Where there is doubt about the fact that such persons are concerned, the court shallapproach the ministry responsible for foreign affairs for clarification.Article 220All public authorities are required to render all necessary assistance to courts and thepublic authorities participating in criminal proceedings, especially in respect of thedetection of criminal offences and their perpetrators.Article 221The terms used in this Code shall mean the following:1) A suspect is a person against whom before institution of criminal proceedings acompetent public authority had undertaken certain action in connection with theexistence of reasonable suspicion that that person had committed a criminal offence.2) An accused person is a person against whom has been rendered or filed a ruling onthe conduct of an investigation, an indictment, a motion to indict, or private prosecution.3) A defendant is a person against him the indictment has acquired legal force.4) A convicted person is a person determined by a final judgement or a final ruling on apenalty to have committed a certain criminal offence.
