ordered in criminal proceedings pursuant to provisions which apply to enforcementproceedings.(2) The ruling referred to in paragraph 1 of this Article shall during the investigation stagebe issued by the investigating judge. After the issuance of the indictment, the ruling shallbe rendered by the president of the chamber outside the trial, and at the trial by thechamber.(3) Rulings against chambers’ decision on temporary security measures are notappealable. In other cases decisions on appeals shall be rendered by the chamberreferred to in Article 24 paragraph 6. Appeals do not stay execution of rulings.Article 211(1) Where objects are concerned that are indubitably the property of the aggrieved, andhave not been entered as evidence in criminal proceedings, they shall be delivered tothe aggrieved even before the completion of the proceedings.(2) Where several aggrieved parties are in dispute in connection with the ownership ofone or more objects, they shall be referred to civil litigation, and in the criminalproceedings the court shall only order the objects to be safeguarded as a temporarysecurity measure.(3) Objects serving as evidence shall be seized and returned to their owners at theconclusion of the proceedings. If such an object is urgently needed by the owner, it maybe returned even before the completion of the proceedings, and the owner shall declarean obligation to bring in the object when necessary.Article 212(1) Where an aggrieved party has a claim against a third party because that personholds objects acquired by the commission of the criminal offence, or has acquiredmaterial gains by the commission of the criminal offence, the court may in criminalproceedings, acting on a motion by authorised persons (Article 202) and pursuant toprovisions applicable to enforcement proceedings, order temporary security measuresagainst such third person. The provisions of Article 210 paragraphs 2 and 3 of this Codeshall also apply in this case.(2) In judgements convicting accused persons, the court shall revoke the measuresreferred to in paragraph 1 of this Article, if they had not repealed earlier, or shall referaggrieved parties to civil litigation, with the proviso that the measures will be repealed ifcivil litigation is not initiated within a time limit determined by the court.Chapter XVIPREJUDICIAL ISSUESArticle 213
