Expert witnesses’ finding and opinions shall be entered in the record promptly. Expertwitnesses may be allowed to submit written findings and opinions at a later date, within atime limit determined by the authority in charge of the proceedings.Article 120(1) Where a professional institution or public authority are commissioned to performexpert analyses, the authority in charge of the proceedings shall issue a caution that thepersons referred to in Article 116 of this Code, or persons for whom grounds exist forexclusion from conducting expert analyses specified in this Code, may not take part inproviding findings and opinions, and about the consequences of perjury in theirtestimony.(2) The professional institution or public authority shall be provided with the materialsrequired for conducting expert analyses, and, if required, the provisions of Article 117paragraph 6 of this Code shall be applied.(3) The professional institution or public authority shall submit written findings andopinions signed by the persons who had conducted the expert analysis.(4) Parties to the proceedings may ask the managing official of the professionalinstitution or public authority to supply the names of the experts who had performed theexpert analysis.(5) The provisions of Article 117 paragraphs 1 to 5 of this Code shall not be appliedwhere professional institutions or public authorities have been commissioned to performexpert analyses. The authority in charge of the proceedings may ask the professionalinstitution or public authority to provide explanations in connection with the findings andgiven.Article 121(1) The record of the expert analysis, or the written findings and opinions, shall containthe names of the experts who had performed the expert analysis, as well as theoccupations, professional qualifications and specialities of the expert witnesses.(2) Following completion of the expert analysis, which the parties did not attend, theyshall be notified that the expert analysis had been performed and that they may examinethe record of the expert analysis, or the written findings and opinions.Article 122Where there are substantial contradictions in expert witnesses’ data in their findings or ifthe findings are unclear, incomplete, contradict themselves or are in opposition with thecircumstances, and the shortcomings cannot be rectified by questioning the expertwitnesses again, a new expert analysis shall be done, with new expert witnesses.Article 123
