(2) In the case of a failure of aggrieved partied as subsidiary prosecutors to attend thetrial although properly summoned, the provisions of Article 59 paragraphs 2 to 5 of thisCode shall be applied.Article 64(1) Aggrieved parties as prosecutors are entitled to all the rights exercised by publicprosecutors, except for those to which public prosecutors is entitled in their capacity ofpublic authorities.(2) In proceedings conducted on a request of aggrieved parties as subsidiaryprosecutors, the public prosecutor is entitled, until the conclusion of the trial, to take overcriminal prosecution and representation of the prosecution.Article 65(1) Where aggrieved parties are minors or persons totally devoid of the capacity to act,their legal representatives are authorised to issue all statements and perform all actionsto which the aggrieved party is entitled under this Code.(2) Aggrieved parties over the age of 16 are authorised to make their own statementsand performs actions in the proceedings.Article 66(1) Private prosecutors, aggrieved parties and aggrieved parties acting as subsidiaryprosecutors, as well as their legal representatives, may exercise all their proceduralrights via a proxy.(2) Where proceedings are being conducted upon the request of an aggrieved party as asubsidiary prosecutor, for a criminal offence punishable by law by more than five years’imprisonment, a proxy may be appointed for the subsidiary prosecutor on his ownrequest if it is in the interest of achieving the aim of the criminal prosecution, and if thesubsidiary prosecutor is owing to his financial status unable to cover the costs ofrepresentation. Rulings on the request shall be issued by the investigating judge, or thepresident of the chamber, and the proxy shall be appointed by the president of the courtfrom the ranks of lawyers.Article 67Private prosecutors, subsidiary prosecutors and aggrieved parties, as well as their legalrepresentatives and proxies, are required to notify the court of every change of abode orpermanent residence.Chapter VIDEFENCE COUNSELArticle 68
