The territorial jurisdiction of the public prosecutor is determined according to theprovisions which apply to the jurisdiction of the court in whose territory the publicprosecutor was appointed.Article 49Where there is a danger of deferrals, procedural actions may also be undertaken by apublic prosecutor who is not competent, who has a duty to immediately notify thecompetent public prosecutor thereof.Article 50Public prosecutors undertake procedural actions directly or through persons authorisedto by law to represent them.Article 51Conflicts of jurisdiction between public prosecutors shall be settled jointly by theimmediately higher public prosecutor.Article 52Public prosecutors may drop requests for criminal prosecution until the conclusion of thetrial before the court of first instance, and before higher courts - in cases provided for bythis Code.Chapter VTHE AGGRIEVED AND THE PRIVATE PROSECUTORArticle 53(1) For criminal offences prosecuted on the basis of a request of an aggrieved party, or aprivate prosecution, the request or the motion shall be submitted within three months ofthe date the authorised person learned about the criminal offence and the perpetrator.(2) Where a motion for private prosecution has been filed in connection with the criminaloffence of insult, the accused person may until the conclusion of the trial file an actionagainst the prosecutor who insulted him on the same occasion (counter-suit). In thiscase the court shall render a single judgement.Article 54(1) Requests for criminal prosecution are submitted to the competent public prosecutor,and requests for private prosecution are submitted to the competent court.(2) Where aggrieved parties submit criminal complaints or claims for indemnificationin criminal proceedings, it shall be deemed that they thereby also submitted requestsfor prosecution.
