y the president of the chamber in connection with the maintenance of order, thepresident of the chamber shall notify thereof the competent bar association, which isrequired to notify the president of the chamber and the president of the court within twomonths of receiving the notice of the measures it has implemented.Article 300(1) Rulings on penalties are appealable, but the chamber may repeal its ruling.(2) Other decisions relating to the maintenance of order and conduct of the trial are notappealable.Article 301(1) Where a defendant commits a criminal offence at the trial, the provisions of Article342 of this Code shall be applied.(2) If another person commits a criminal offence during a trial hearing, the chamber mayadjourn the trial and on the basis of verbal charges presented by the prosecutoradjudicate the criminal offence immediately, and may prosecute the criminal offenceafter the conclusion of the trial which has commenced.(3) Where there are grounds to suspect that a witness or expert witness committedperjury during the trial, that criminal offence is not prosecutable immediately. In suchcase the president of the chamber may order a special record made of the testimony ofthe witness or expert witness and delivered to the public prosecutor. The record shall besigned by the witness or expert witness who had testified.(4) Where it is not possible to try the perpetrator of a criminal offence which isprosecutable ex officio immediately, or where a higher court has the necessaryjurisdiction, the competent public prosecutor shall be notified thereof for further action.3. Preconditions for holding trialsArticle 302The president of the chamber shall open the trial hearing and announces the case beingprocessed and the composition of the chamber. The president shall then establishwhether all the persons summoned are present, and if some are not, whether they wereduly served summons and whether they have justified their absences.Article 303(1) Where a public prosecutor or person deputising for the public prosecutor fails toappear at a trial scheduled on the basis of the public prosecutor’s indictment, the courtshall order a continuance. The president of the chamber shall notify the competentpublic prosecutor thereof.
