(4) In the agreement on the admission of guilt the accused may promise to fulfil theobligations referred to in Article 236 paragraph 1 of this Code, provided their naturemakes their fulfilment possible for the accused person until the submission of theagreement on the admission of guilt to the court, or to begin fulfilment of the obligationsby the date of submitting the agreement on the admission of guilt to the court.(5) In the agreement on the admission of guilt the accused may accept an obligation toreturn within a specified period of time the proceeds from the commission of the criminaloffence, or to return the object of the criminal offence.Article 282v(1) The court shall decide on the agreement on the admission of guilt, and may issue aruling dismissing, upholding or rejecting the agreement.(2) Where an agreement on the admission of guilt is submitted before the indictment isfiled, it shall be ruled on by the president of the chamber referred to in Article 24paragraph 6 of this Code.(3) Where the agreement on the admission of guilt is submitted after the indictment isfiled, or if the accused or his defence counsel cite such an agreement in their objectionagainst the indictment, it shall be ruled on by the president of the chamber.(4) The president of the chamber may dismiss the agreement on the admission of guilt ifit is submitted after the conclusion of the first trial hearing. Rulings dismissingagreements on the admission of guilt are not appealable.(5) The court shall rule on an agreements on the admission of guilt at a hearing whichshall be attended by the public prosecutor, the accused and defence counsel, and theaggrieved and his proxy shall be notified about the hearing. Where an accused persondoes not retain a defence counsel, one shall be assigned by the court ex officio, no lessthan eight days before the scheduled date of the hearing, and a defence counselappointed in this manner shall perform his duty until the ruling referred to in paragraph 9of this Article becomes effective, or until the rendering of the judgements referred to inArticle 282d of this Code.(6) The hearing referred to in paragraph 5 of this Article is public (Article 291), and thepublic may by a ruling of the court be excluded from the entire hearing or a part of thehearing only if there exist any of the reasons referred to in Article 292 of this Code,applying accordingly the provisions of Article 293 and Article 294 paragraph 4 of thisCode.(7) The court shall reject an agreement on the admission of guilt by a ruling if the dulysummoned accused fails to attend the hearing. Rulings rejecting agreements on theadmission of guilt are not appealable. The hearing referred to in paragraph 5 of thisArticle may also be held in the absence of a duly summoned public prosecutor, of whichthe court shall notify the public prosecutor’s immediate superior public prosecutor.
