8.0 RELEVANT BACKGROUND INFORMATIONThe principles are that:• Environmental protection principles be observed in relation to the managementand administration <strong>of</strong> Crown land.• The natural resources <strong>of</strong> Crown land (including water, soil, flora, fauna andscenic quality) be conserved wherever possible.• Public use and enjoyment <strong>of</strong> appropriate Crown land be encouraged.• Where appropriate, multiple use <strong>of</strong> Crown land be encouraged.• Were appropriate, Crown land should be used and managed in such a way thatboth the land and its resources are sustained in perpetuity.• Crown land be occupied, used, sold, leased, licensed or otherwise dealt with inthe best interests <strong>of</strong> the State consistent with the above principles.Additional requirements under the Crown <strong>Land</strong>s Act 1989 relating to plans <strong>of</strong>management are:• that the Minister administering the Crown <strong>Land</strong>s Act 1989 or Minister assistingthe Minister for Natural Resources (<strong>Land</strong>s), gives consent for the preparation <strong>of</strong>a plan <strong>of</strong> management and consent for a draft plan going on public exhibition;• that the plan <strong>of</strong> management observe appropriate reserve policy applicable tothe site along with relevant land management case law; and• that the draft plan <strong>of</strong> management shall be placed on public display for not lessthan 28 days to allow for submissions to be made on the plan <strong>of</strong> management.Local Government Act 1993Although <strong>Enmore</strong> <strong>Park</strong> is Crown <strong>Land</strong> and subject to the Crown <strong>Land</strong>s Act 1989,various aspects <strong>of</strong> community land management policy as arise for the LocalGovernment Act can be <strong>of</strong> assistance in management <strong>of</strong> <strong>Enmore</strong> <strong>Park</strong>.The Local Government Act provides the legislative framework for a council’s day to dayoperation. The Act emphasises a council’s responsibility to actively manage land and toinvolve the community in developing a strategy for management.Environmental and <strong>Plan</strong>ning Assessment Act 1979The objectives <strong>of</strong> this Act are:(a) to encourage:(i) the proper management, development and conservation <strong>of</strong> natural and artificialresources, including agricultural land, natural areas, forests, minerals, water,cities, towns and villages for the purpose <strong>of</strong> promoting the social andeconomic welfare <strong>of</strong> the community and a better environment,(ii) the promotion and co-ordination <strong>of</strong> the orderly and economic use anddevelopment <strong>of</strong> land,(iii) the protection, provision and co-ordination <strong>of</strong> communication and utility services,(iv) the provision <strong>of</strong> land for public purposes,(v) the provision and co-ordination <strong>of</strong> community services and facilities, and(vi) the protection <strong>of</strong> the environment, including the protection and conservation<strong>of</strong> native animals and plants, including threatened species, populations andecological communities, and their habitats, and(vii) ecologically sustainable development, and(viii) the provision and maintenance <strong>of</strong> affordable housing, and(b)(c)to promote the sharing <strong>of</strong> the responsibility for environmental planning betweenthe different levels <strong>of</strong> government in the State, andto provide increased opportunity for public involvement and participation inenvironmental planning and assessment.85 Marrickville CouncilOctober 2012
