All Products sold and distributed by Kuriyama of America, Inc.are in the nature of commodities and they are sold by publishedspecifications and not for particular purposes, uses orapplications. Purchaser shall first determine their suitability forthe intended purposes, uses or applications and shall eitherconduct its own engineering studies or tests, or retain qualifiedengineers, consultants or testing laboratories and consult withthem before determining the proper use, suitability or proprietyof the merchandise or Products for the intended purposes, usesor applications.Kuriyama of America, Inc. (“Seller”) does not recommend theProducts for any particular purpose, use or application, and thePurchaser or user thereof shall assume full responsibility forthe suitability, propriety, use and application of the Products.Purchaser shall follow all instructions contained in Seller’scatalogs, brochures, technical bulletins and other documentsregarding the Products. The Products, including but not limitedto, hose, tubing or couplings, may fail due to the use or conveyanceof substances at elevated or lowered temperatures orat excessive pressure, the conveyance of abrasive, injurious,flammable, explosive or damaging substances.Cautionary StatementHose or tubing used in bent configurations will be subjected toincreased abrasion. Hose clamps or couplings may loosen afterinitial installation and all sections of hose and tubing includingconnections, couplings, clamps, conductivity and bondingshould be inspected frequently, regularly and consistently, andshould be replaced, adjusted or re-tightened for the avoidanceof leakage, for the prevention of injuries or damages, and forgeneral safety purposes. Except as indicated in its LimitedWarranty, Seller shall not be liable or responsible for director indirect injuries or damages caused by or attributed to thefailure or malfunction of any Products sold or distributed by it.Purchasers or users of the Products should frequently and consistentlyundertake inspections and protective measures withrespect to the use and application of Products, which shouldinclude the examination of tube and cover, conditions of thehose or tubing, and the identification, repair or replacement ofsections showing cracking, blistering, separations, internal andexternal abrasions, leaking or slipped couplings or connectionsand make proper proof tests.The Products sold or distributed by Seller are warranted to itscustomers to be free from defects in material and workmanshipat the time of shipment by us, subject to the followingprovisions.ALL WARRANTY CLAIMS SHALL BE MADE WITHIN SIX (6)MONTHS AFTER SELLER SHIPPED THE PRODUCTS. SELLER’SLIABILITY HEREUNDER IS LIMITED AT SELLER’S EXCLUSIVEDISCRETION, TO 1) THE PURCHASE PRICE OF ANY PRODUCTSPROVING DEFECTIVE; 2) REPAIR OF ANY DEFECTIVE PRODUCTOR PART THEREOF; OR 3) REPLACEMENT OF ANY DEFECTIVEPRODUCT OR PART UPON ITS AUTHORIZED RETURN TO SELLER.THIS WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHERWARRANTIES, EXPRESSED, IMPLIED, STATUTORY, OR OTHER-WISE CREATED UNDER APPLICABLE LAW INCLUDING, BUT NOTLIMITED TO, THE WARRANTY OF MERCHANTABILITY AND THEWARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. IN NOLimited WarrantyEVENT SHALL SELLER OR THE MANUFACTURER OF THE PROD-UCT BE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIALDAMAGES, INCLUDING LOSS OF PROFITS, WHETHER OR NOTCAUSED BY OR RESULTING FROM THE NEGLIGENCE OF SELLERAND/OR THE MANUFACTURER OF THE PRODUCT, UNLESSSPECIFICALLY PROVIDED HEREIN. IN ADDITION, THIS WAR-RANTY SHALL NOT APPLY TO ANY PRODUCTS OR PORTIONSTHEREOF WHICH HAVE BEEN SUBJECTED TO ABUSE, MISUSE,IMPROPER INSTALLATION, MAINTENANCE, OR OPERATION,ELECTRICAL FAILURE OR ABNORMAL CONDITIONS, AND TOPRODUCTS WHICH HAVE BEEN TAMPERED WITH, ALTERED,MODIFIED, REPAIRED, REWORKED BY ANYONE NOT APPROVEDBY SELLER, OR USED IN ANY MANNER INCONSISTENT WITH THEPROVISIONS OF THE “CAUTIONARY STATEMENT” ABOVE OR ANYINSTRUCTIONS OR SPECIFICATIONS PROVIDED WITH OR FORTHE PRODUCT.09/2005BECAUSE WE CONTINUALLY EXAMINE WAYS TO IMPROVE OUR PRODUCTS, WE RESERVE THE RIGHT TO ALTER SPECIFICATIONS WITHOUT PRIOR NOTICE.KCCA111049
