technical surveys. He therefore first clarified the def<strong>in</strong>ition <strong>of</strong> the term "l<strong>and</strong> release" as describ<strong>in</strong>g a<br />

process dur<strong>in</strong>g the course <strong>of</strong> which every reasonable effort is made to remove any suspicion <strong>of</strong><br />

contam<strong>in</strong>ation by m<strong>in</strong>es/ERW through non-technical <strong>and</strong> technical surveys <strong>and</strong>/or clearance work. He<br />

then described all aspects l<strong>in</strong>ked to the new term<strong>in</strong>ology <strong>in</strong> force, as well as the pr<strong>in</strong>ciples regulat<strong>in</strong>g<br />

l<strong>and</strong> release, that is, mak<strong>in</strong>g every reasonable effort <strong>and</strong> evidence-based assessment. Philippe Houliat<br />

then outl<strong>in</strong>ed the pr<strong>in</strong>ciples <strong>of</strong> non-technical <strong>and</strong> technical surveys.<br />

Alioune ould Mohamed El Hacen described the l<strong>and</strong> release policy <strong>in</strong> Mauritania which had made it<br />

possible to release 10 million m 2 . This policy is carried out us<strong>in</strong>g non-technical processes. After a<br />

PNDHD Sort<strong>in</strong>g Committee meet<strong>in</strong>g, analysis is carried out <strong>of</strong> potential areas for l<strong>and</strong> release <strong>and</strong> <strong>of</strong><br />

the causes <strong>of</strong> contam<strong>in</strong>ation, followed by cross-check<strong>in</strong>g <strong>and</strong> confirmation <strong>in</strong> the field <strong>of</strong> the<br />

<strong>in</strong>formation gathered dur<strong>in</strong>g the impact survey with the affected communities on the basis <strong>of</strong> specific<br />

def<strong>in</strong>ed criteria. Subsequently, a meet<strong>in</strong>g is held concern<strong>in</strong>g l<strong>and</strong> release to the communities affected<br />

(or to the adm<strong>in</strong>istration) based on def<strong>in</strong>ed criteria, followed by a l<strong>and</strong> release ceremony <strong>and</strong><br />

conclud<strong>in</strong>g with the sign<strong>in</strong>g <strong>and</strong> issu<strong>in</strong>g <strong>of</strong> documents. In case <strong>of</strong> accident, there is community<br />

responsibility <strong>and</strong> the l<strong>and</strong> is reclassified for technical survey<strong>in</strong>g. If there is an accident subsequent to<br />

the quality control, the penal responsibility lies with the head <strong>of</strong> quality control; f<strong>in</strong>ancial<br />

responsibility for the victim is ensured by the PNDHD's victim assistance programme <strong>and</strong> the l<strong>and</strong> is<br />

reclassified as await<strong>in</strong>g a technical survey.<br />

The presentation by Sudi Alimasi Kimputu covered l<strong>and</strong> release with<strong>in</strong> the DRC. After rem<strong>in</strong>d<strong>in</strong>g<br />

participants <strong>of</strong> the orig<strong>in</strong>s <strong>of</strong> the contam<strong>in</strong>ation, he stated that 792 <strong>of</strong> the 900 <strong>in</strong>itially suspected<br />

hazardous areas still rema<strong>in</strong>ed classified as such. He also specified that l<strong>and</strong> release <strong>in</strong> the DRC is<br />

based on the concept <strong>of</strong> the GMAS, the m<strong>in</strong>e action survey<strong>in</strong>g methodology adapted to the context <strong>of</strong><br />

the DRC.<br />

Lastly, Assane Ngueadoum ended this series <strong>of</strong> presentations by describ<strong>in</strong>g the situation <strong>in</strong> Chad. His<br />

paper dealt particularly with the impact survey carried out from 1999 to 2001, which showed that over<br />

280,000 people live <strong>in</strong> 417 suspected hazardous areas. L<strong>and</strong> release <strong>in</strong> Chad is based on three ma<strong>in</strong><br />

methods: l<strong>and</strong> release by non-technical means; l<strong>and</strong> release by technical survey; l<strong>and</strong> release by<br />

dem<strong>in</strong><strong>in</strong>g. The l<strong>and</strong> release process itself is founded on five pr<strong>in</strong>ciples:<br />

• a well-documented <strong>and</strong> recorded formal process, which def<strong>in</strong>es the survey methods <strong>in</strong><br />

accordance with the Chadian national st<strong>and</strong>ards <strong>and</strong> the accredited POP ;<br />

• objective <strong>and</strong> well-def<strong>in</strong>ed criteria for l<strong>and</strong> declassification which are used to supplement the<br />

plann<strong>in</strong>g <strong>and</strong> priority action process ;<br />

• a high level <strong>of</strong> community <strong>in</strong>volvement <strong>and</strong> decision acceptance ;<br />

• a formal process for responsibility transfer when l<strong>and</strong> release takes place ;<br />

• a supervisory mechanism which cont<strong>in</strong>ues after responsibility transfer.<br />

The l<strong>and</strong> is released once the community has signed the "Certificate <strong>of</strong> L<strong>and</strong> Release".<br />

Several exchanges took place follow<strong>in</strong>g these presentations. Papa Omar N'Diaye stressed the fact that,<br />

<strong>in</strong> pr<strong>in</strong>ciple, l<strong>and</strong> release signifies a technical process which leads to a conclusion : the area is m<strong>in</strong>efree.<br />

This differs from the political act <strong>of</strong> l<strong>and</strong> restitution which consists <strong>in</strong> return<strong>in</strong>g l<strong>and</strong> to the<br />

people. Papa Omar N'Diaye then wished to know if it was appropriate to halt a technical survey on<br />

discovery <strong>of</strong> a m<strong>in</strong>e.<br />

Mamadou Mane, IMSMA Adm<strong>in</strong>istrator, wished to add to the comment by Papa Omar N'Diaye. In<br />

his view, l<strong>and</strong> release is an act between an operator <strong>and</strong> the national authority, while restitution is an<br />

act between the national authority <strong>and</strong> the population.<br />

Norbert Badet wished to express doubt concern<strong>in</strong>g the actual process <strong>of</strong> l<strong>and</strong> release. It seemed to him<br />

that if the responsibility lies with the local community <strong>in</strong> case <strong>of</strong> accident, this shows that those who<br />

established this concept are not totally conv<strong>in</strong>ced <strong>of</strong> its effectiveness.<br />
