4 CONSTITUTION AND BYLAWSARTICLE IVORGANIZATION STRUCTURESection 1 Under the direction of the President, a Director maybe appointed for each Division, District and/or City. <strong>The</strong>President may establish Regional Councils, Advisory Boards,and/or Committees, as well as rules and regulations therefore.<strong>The</strong> members of such Councils, Advisory Boards and/orCommittees shall be selected by election or appointment bythe President subject to the President’s direction. <strong>The</strong> purposeof such Councils, Boards, and/or Committees created by theDivisions hereunder shall be to formulate policyrecommendations to the <strong>Local</strong> Executive Board and tootherwise serve in an advisory capacity. Such bodies shall, atall times, be subject to the supervision of the President of theUnion, or President’s designee.Section 2. In cities designated by the President, AdvisoryCouncils appointed by the President may be established tohelp advise and forward the program of the union regarding:Supporting local contract administration and campaigns<strong>The</strong> local political program<strong>The</strong> union social programs for the membersAny other issues or activities as designated by the PresidentARTICLE VORGANIZATION MEMBERSHIPSection 1. Any person employed in any employment withinthe jurisdiction of this <strong>Local</strong> Union shall be eligible formembership, except as otherwise provided herein.Section 2. <strong>The</strong>re shall be no discrimination against anymember or any applicant for membership by reason of race,creed, color, religion, gender, sexual orientation, genderexpression, national origin, citizenship status, marital status,ancestry, age, handicap or disability, or in respect to any stateor federal law, and no member shall discriminate or advocatesuch discrimination.Section 3. Self-employed individuals who perform work withinthe jurisdiction of the <strong>Local</strong> Union and who otherwise meetthe eligibility requirements for membership under this ArticleIV shall be eligible for membership except that such membersshall not be (a) eligible to hold any position as an officer,member of the <strong>Local</strong> Executive Board, or trustee; (b)permitted to vote upon the acceptance or rejection ofproposed collective bargaining agreements to coveremployees other than self-employed workers or (c) permittedto vote in respect to any proposed strike or other such<strong>SEIU</strong> <strong>Local</strong> 1 5collective action in respect to other employees. In no case,however, shall such membership be allowed in order to avoidor undermine the standards established by the Union incollective bargaining agreements or where for any reasonsuch membership is not in the interest of the <strong>Local</strong> Union.Section 4. Every member by virtue of membership in the<strong>Local</strong> Union is obligated to adhere to and follow the terms ofthe International Constitution and Bylaws, this <strong>Local</strong>Constitution and Bylaws, and the rules and regulationspromulgated in accordance with these Constitutions inrespect to each member’s rights, duties, privileges andimmunities conferred by them and by statue. Each membershall faithfully carry out such duties and obligations and shallnot interfere with the rights of fellow members.Section 5. Every member by virtue of membership in the<strong>Local</strong> Union authorizes the <strong>Local</strong> Union to act as his or herexclusive bargaining representative with full and exclusivepower to execute agreements with his or her employergoverning terms and conditions of employment and to act forand have final authority in presenting, processing, andadjusting any grievance, complaint, or dispute arising underany collective bargaining agreement or out of the member’semployment with the employer in such manner as the <strong>Local</strong>Union, its officers or agents deem to be in the best interests ofthe members and the <strong>Local</strong> Union. <strong>The</strong> <strong>Local</strong> Union and itsofficers, union representatives, and authorized agents maydecline to process any such grievance, complaint, or dispute,if in their discretion and judgment such grievance, complaintor dispute is without merit.Section 6. No member shall interfere with the elected orappointed officers, union representatives or other agents oremployees of this organization in the performance of theirduties, and every member, when requested, shall render suchassistance and support in the performance of such duties asmay be required, provided that it does not interfere with hisor her individual rights as a member. Each member shalladhere to the terms and conditions of applicable collectivebargaining agreements and shall refrain from any conductthat would interfere with the performance by the <strong>Local</strong> Unionof its legal or contractual obligations.Section 7. No member shall espouse or engage in dualunionism or disaffiliation, or be party to any activity to securethe disestablishment of this <strong>Local</strong> Union as the collectivebargaining agent for any employee nor shall any membereither slander or libel the <strong>Local</strong> Union, its members,employees, officers or agents. No member shall be permittedat any assembly or meeting of other members to engage inany of the conduct hereinbefore described.
6 CONSTITUTION AND BYLAWSSection 8. No member or group of members of the <strong>Local</strong>Union, including advisory boards, councils, committees,conferences, leagues, clubs or any association composed ofmembers of the <strong>Local</strong> Union shall, in any manner, directly orindirectly, use, exploit or trade upon the name of the <strong>Local</strong>Union, or any similar name or designation, nor levy or collectany taxes dues or other monies, nor conduct any affair or anyother activity including programs or soliciting advertisementsin any publication, or any like conduct either directly orindirectly, without first obtaining express written permissionform the President of the <strong>Local</strong> Union.Section 9. No member shall, at any time, solicit the job of afellow member, unless such a member is leaving voluntarily.No member shall injure the interest of another member byundermining wages or other terms and conditions ofemployment, nor shall any member commit any act whichwould jeopardize another member’s office or standing in theUnion. No member shall take any action or seek to undermineor injure a fellow worker with an employer.Section 10. Any person desiring to become a member of this<strong>Local</strong> Union shall execute an application form. <strong>The</strong> applicationfor membership must be accompanied by such partialpayment of the initiation fee fixed by the <strong>Local</strong> ExecutiveBoard. Not later than sixty (60) days after such partialpayment has been made, the full amount of the initiation feemust be paid to the <strong>Local</strong> Union unless the President, theSecretary-Treasurer or the Executive Board shall otherwiseprovide for partial payments and the terms thereof. Unlessotherwise expressly exempted as provided herein, fullpayment of the initiation fee shall be made prior to taking theoath of membership. <strong>The</strong> <strong>Local</strong> Executive Board may requirean applicant for membership to present himself before theExecutive Board or an examining Board established by theExecutive Board for the purpose of submitting to anexamination as to the applicant’s qualifications formembership.Section 11. Any internal or external program personnelemployed by <strong>SEIU</strong> <strong>Local</strong> 1 or affiliated state councils shall beeligible for membership in <strong>Local</strong> 1. Union staff personnel donot authorize the <strong>Local</strong> union to serve as their bargainingrepresentative unlike members otherwise working in <strong>Local</strong> 1’sjurisdiction as described in Article III.Section 12. Every member shall notify the Secretary-Treasurerof the Union of any change of address.<strong>SEIU</strong> <strong>Local</strong> 1 7ARTICLE VIOFFICERSSection 1. <strong>The</strong> officers of the <strong>Local</strong> Union shall be as follows:1. President2. Secretary-Treasurer3. Twelve (12) Vice Presidents4. Recording Secretary5. Thirty-Seven (37) members of the <strong>Local</strong> Executive Boarddesignated as follows:A. Twenty (20) seats assigned to membership in the citiesas follows:Chicago – 10 seatsAkron – 1 seatCincinnati – 1 seatCleveland – 1 seatColumbus – 1 seatDetroit – 1 seatIndianapolis – 1 seatKansas City – 1 seatMilwaukee – 1 seatSt. Louis – 1 seatToledo – 1 seatB. Seventeen (17) at-large seats elected by themembership as a wholeSection 4. <strong>The</strong> Fifty-two (52) members shall constitute the<strong>Local</strong> 1 Executive Board.Section 5. <strong>The</strong> officers of the Union, including the members ofthe <strong>Local</strong> Executive Board, shall be nominated and elected onan at-large basis for the election to be held in September2014 and every three (3) years thereafter in accordance withArticle VIII, Section 1.Section 6. In addition to the voting members of the ExecutiveBoard as laid out above, there shall be one (1) non-votingmember of the Executive Board appointed by the Presidentfrom the retired members of the local in good standing whoare active in the <strong>Local</strong> 1 retirees chapters.
