18 CONSTITUTION AND BYLAWSobligations due to the International Union and shall have noright to pay any bills before it pays its full obligations to theInternational Union each month. A fee as shall be required bythe International Union shall be paid by the <strong>Local</strong> Union to theInternational Union for each new member or reinstatedmembers enrolled by the <strong>Local</strong> Union.ARTICLE XVIDUES-GOOD STANDING-FAIRSHARE FEES-AGENCY FEESSection 1. For members who have not authorized monthlydues deductions, quarterly dues shall be paid for periodsbeginning January, April, July and October of each year. <strong>The</strong>President or President’s designee shall establish proceduresfor the payment of dues by such members. <strong>The</strong> dues for eachquarter are due and payable on or before the last day of thefirst month of the quarter. A member who is in arrears in thepayment of dues, fees, fines or assessments shallautomatically be considered not in good standing without anyaction on the part of the <strong>Local</strong> Union.Section 2. Members who authorize dues deductions either ona monthly, quarterly, or other basis shall be deemed to be ingood standing, provided that dues, initiation fees, fines andassessments have been paid.Section 3. A member not in good standing who pays his orher back dues, initiation fees, fines and assessments shall beconsidered to be a new member from the date of suchpayment in order to render the member eligible for anybenefits for which he or she might otherwise be considered.In case of death of such member, the member’s beneficiariesshall be considered eligible for benefits, if any, as of the dateof payment of back dues, initiation fees, fines andassessments.Section 4. Where required by law, the Union shall provide forthe payment and deduction of fair share or agency fees andestablish such procedures and rules governing the employeesin the various units who are not members of the Union inrespect to such fees, their rights and the Union’s obligation tothem in accordance with applicable law.Section 5. Retired members who are not working and pay lessthan the full dues required for working members of the <strong>Local</strong>Union shall not be eligible for nomination or appointment asan officer, voting member of the Executive Board, delegate orany other office in the <strong>Local</strong> Union or International Union.<strong>SEIU</strong> <strong>Local</strong> 1 19ARTICLE XVIIREADMISSION-FINES-ASSESSMENTSSection 1. A member who is expelled from this <strong>Local</strong> Unionmay be readmitted by making application to the <strong>Local</strong>Executive Board. Upon receiving a favorable recommendationof the Executive Board, the member may be readmitted tomembership if a majority vote at a regular membershipmeeting approves such recommendations.Section 2. All fines imposed or assessments levied against amember shall be charged by the Secretary-Treasurer to suchmember as dues and must be paid by the member prior topayment of any regular dues in order to entitle such memberto any rights, privileges or benefits of this <strong>Local</strong> Union.Reasonable fees or assessments shall be payable within thirty(30) days after they are imposed or levied unless otherwiseprovided by the Secretary-Treasurer. However, if such fine orassessment is appealed, the member may deposit such fine(not to exceed the sum of $100.00) with the <strong>Local</strong> Union orthe International Union pending the outcome of the appealand, if successful, the member shall be restored to all rights ofmembership and the fine or assessment shall be refunded.ARTICLE XVIIITRIALS, HEARINGS, AND APPEALSSection 1. In order to maintain discipline and to provide forthe observance of the provisions of this Constitution andBylaws and rules and regulations of the <strong>Local</strong> Union, the <strong>Local</strong>Executive Board is empowered to act as a trial or hearingbody, or appoint a hearing body to act in its stead, which shallhave the power to levy such penalties as it may determineupon any member found guilty of charges made after a fulland fair hearing held in accordance with the requirements ofthe <strong>Local</strong> and International Constitutions and Bylaws, andapplicable rules and regulations and law. In order to ensureprotection from filing of frivolous charges, the trials, hearingand appeals shall be held only for charges filed for reasonsstated in Article XVII of the International Constitution andshall be held under procedures established therein. <strong>The</strong>charges must specify the events or acts which the chargingparty believes constitutes a basis of charges and must statewhich subsection(s) of Section 1 of Article XVII of theInternational Constitution the charging party believes hasbeen violated.If the charges are not specific, the trial body may dismiss thecharges either before or at the hearing, but the charging partyshall have the right to re-file more detailed charges whichcomply with this Section. No charges may be filed more thansix months after the charging party learned, or could have
