16TERMS & CONDITIONSTERMS - The terms of the sale are cash or cheque payable at par at sale location unless satisfactory credit arrangements have been made previous to the sale. Theright of property shall not pass until after settlement is made. The sellers reserve the right to require a certified cheque as settlement before releasing any salecattle. Should any purchaser fail to settle for his purchase, the seller reserves full power to resell the animal to the best advantage either publicly or privately,without further notice. Any loss arising from such resale together with keep and all other expenses shall be payable by the defaulter. All settlements must bemade with the clerks of the sale before any cattle will be released.BID - Every animal consigned to the sale must be sold by auction. No private sales will be allowed except as otherwise provided for in the terms and conditions. Noby-bidding will be permitted. Each animal will be sold to the highest bidder.DISPUTES - In cases of dispute, bidding will be reopened between the parties involved. If no further bid is made the buyer will be the person from whom the auctioneeraccepted the last bid. The auctioneer’s decision in such matters will be final.PURCHASER’S RISK - Each animal becomes the risk of the purchaser as soon as sold. Animals will be cared for at the purchaser’s risk for a reasonable length oftime.ANNOUNCEMENTS from the auction block will take precedence over the printed matter in the catalogue. Buyers are therefore cautioned to pay attention to any suchannouncements.CERTIFICATE OF REGISTRY - The proper Registration or Recordation paper, as the case may be, will be duly transferred and furnished to the buyer for each animalafter settlement has been made.BREEDERS GUARANTEE, BULLS - Should any bull fourteen (14) months of age or over, fail to prove a breeder after being used on cows known to be breeders,the matter shall be reported in writing to the seller within six (6) months after the bull has reached fourteen (14) months of age. The seller will then have the rightand privilege of six (6) months to prove the bull a breeder. No guarantee is given that semen collected from the bull will be suitable for artificial insemination.BREEDERS GUARANTEE GUIDELINESPARTIES OF GUARANTEE -All guarantees are between the buyer and the seller.ROLE OF THE ASSOCIATION - The Canadian Simmental Association shall not be responsible for any guarantees given by a seller of Simmental cattle.BULL BREEDING GUIDELINES - All bulls offered for sale as breeding bulls, except calves at side, must be guaranteed breeders.At the time of sale all bulls must attain or exceed the minimum scrotal circumference measurements for their respective age as outlined here: 12 months - 32cm, 14 months - 34 cm, 15-20 months - 35 cm, 21-30 months - 36 cm. All bulls sold after weaning and prior to 12 months of age must meet the minimum scrotalmeasurement of 32 cm when they reach 12 months of age.Should any bull fifteen months of age or over fail to prove a natural breeder after being used on cows known to be breeders and free of any venereal disease,the buyer shall report in writing to the seller and provide a report of a complete examination by a qualified veterinarian. This notification shall be provided to theseller no later than four (4) months following the date of purchase or six (6) months after the bull has reached fifteen (15) months of age, whichever is later. Thebuyer shall return the bull to the seller at the buyer’s expense. The seller shall have the opportunity to have the bull examined by a veterinarian of his choice.In the instance of a fertility re-test by the seller, the bull must weigh the same or more than his posted adjusted 365-day weight. If the bull falls short of this weightthen he must be reconditioned to meet the weight and then be re-tested. The seller will then have 45 days to prove this bull a breeder. If this bull proves to bea satisfactory breeder the bull shall be returned to the buyer.In the event the seller fails to prove the bull a satisfactory breeder, the buyer has the option to either accept a replacement F.O.B. the seller’s ranch or a creditof the actual purchase price. No incidental expenses such as feed, veterinary charges, interest, etc. will be charged by either party. In no event shall the sellerbe responsible for reimbursing more than the purchase price.EXCEPTION TO GUARANTEE - In cases where the animal is subjected to any hormonal or surgical reproduction techniques after the sale, this guarantee shall benull and void.SETTLEMENT - Transportation charges on animals returned to the seller are for account of the purchaser. No incidental expenses such as fee, A.I., signing fees,interest, veterinary charges, etc. will be charged by either party when making settlements. If the seller is successful in proving the animal in question to be abreeder, then said animal will be reclaimed by the purchaser at his expense. Should the seller fail to so prove the animal a breeder, then the buyer is guaranteeda satisfactory replacement, F.O.B. ranch or location of origin or a refund of the actual purchase price paid FOB selling point. In no event shall the seller beresponsible for more than the purchase price. Should a dispute arise over the quality of a replacement animal, the sellers will appoint a mediator.ACCIDENTS - Although every precaution will be taken to protect the safety and comfort of buyers, neither the sellers, auctioneer, or Association assumes anyresponsibility in this matter and disclaims any liability legal or otherwise in the event of accident of loss of property.RIGHTS AND OBLIGATIONS - The above terms and conditions of the sale shall constitute a contract between the buyer and the seller and be equally binding toboth. Resale of animals following purchase shall constitute a separate transaction and the rights and obligations of these two parties connected thereto are notcovered by the terms and conditions of the sale.ARBITRATION - In the event of a dispute, the purchaser and seller may ask the Canadian Simmental Association to arbitrate the matter. The Arbitration Board shallbe conducted under the rules of arbitration wherein the purchaser and seller will each appoint one person to the Board and the Canadian Simmental Associationwill appoint a Chairman. Each party will have one vote, and the decision of the majority of the Board being binding on both the seller and the purchaser. Expensesof the arbitration will be at the sole discretion of the Chairman. Under no circumstances will the seller be liable for more than the purchase price of the animal.THE AUCTIONEER shall have the right to refuse bids from anyone who has a previous record of default in payment or who has not made proper credit clearanceprior to the sale with the sellers.
