Foreign tenderers, may submit a written pledge that they do not have any finalized debts with respect to tax payments and socialsecurity payments under the relevant provisions of the legislation of their own country, instead of the documents evidencing that theyare not in the situation mentioned in sub articles (c) and (d) of the Article 10 of this specification.7.2. Mesleki ve teknik yeterliğe ilişkin aranacak belgeler ve bu belgelerin taşıması gereken kriterler;7.2. Documents related to professional and technical qualification and the Criteria to be met by these documents7.2.1- İstekliler, ihale tarihi itibariyle geçerli olan aşağıda belirtilen mesleki ve teknik yeterlik belgelerini teklifi ilebirlikte vereceklerdir. Tenderers shall submit the below mentioned professional and technical qualification documents, which are still valid at thedate of tender, together with their offers. Documents Relating to Production, Production Capacityİstekliler, tekerlek takımı ve monoblok gövde imalatçısı veya yetkili satıcısı olacaktır.Tenderers shall be a manufacturer or authorized dealer of wheel sets and solid wheels.a) İstekli imalatçı ise imalatçılık belgesi, (sanayi sicil belgesi)a) If the tenderer is a manufacturer, manufacturing certificate. (Commerce/Industry registration document)b) İstekli yetkili satıcı ise, imalatçının imalatçılık belgesi ile kendisine ait yetkili satıcılık belgesi,b) If the tenderer is an authorized dealer, the manufacturing certificate of the manufacturer and its own authorized dealerCertificate.c) Türkiye’de serbest bölgelerde faaliyet gösteren imalatçı veya yetkili satıcı ise yukarıdaki belgelerin yanısıra serbest bölge faaliyet belgesini tekliflerine ekleyeceklerdir.c) If the manufacturer or authorized dealer is operating in free zones in Turkey, along with the above documents, the freezone operation certificate7.2.3- Uluslar Arası Kurallara Uygun Şekilde Akredite Edilmiş Kalite Kontrol Kuruluşları TarafındanVerilen Sertifikalar7.2.3. Certificates given by Quality Control Institutions accredited according to international rules.İstekliler sahip olduğu tekerlek takımı imalatına ve monoblok tekerlek imalatına ait güncel ve geçerli (ISO 9001)kalite belgesini tekliflerine ekleyeceklerdir. İstekli yetkili satıcı ise, imalatçının sahip olduğu yukarıda belirtilen kalitebelgesini verecektir.Tenderers shall submit together with their offer current and valid ISO 9001 Quality Certificates regarding the manufacture of wheelsets and solid wheels. The quality certificate mentioned above of the manufacturer shall be included in case of authorized dealer.7.2.4- İş Deneyim Belgesi, alındığı ülkedeki T.C. Konsolosluğu veya T. Dışişleri Bakanlığının onayından muaftutulacak, resmi makamlardan alınmayan belgelerdir.7.2.4- Work experience certificate is a document that is exempted from approval of Turkish Consulate in the obtained country orTurkish Ministry of Foreign Affairs and that is not obtained from official offices.a-) İstekliler, son beş yıl içerisinde gerçekleştirilen ihale konusu tekerlek takımlarının veya benzer nitelikte tekerlektakımı imalatının ve ihale konusu tekerleklerin veya benzer nitelikte EN13262 standardına uygun monobloktekerlek imalatının kusursuz bir şekilde kabulü ile ilgili UIC üyesi demiryolu idaresinden aldıkları iş deneyimbelgesini tekliflerine ekleyeceklerdir. İş deneyim belgesi, teklif edilen bedelin en az %25’i oranında ve teksözleşmeye ilişkin olacaktır.a-) Tenderers shall include to their offer a work experience certificate obtained from a UIC member railroad administration showingtheir experiences pertaining to the procurements of the wheel sets or equivalent wheel set manufacture and the wheels or equivalentsolid wheels manufacture according to EN 13262 Standard that are subject to the tender within the last 5 years and which aredeemed by the Contracting Entity as being without fault. Work experience certificate shall be at the rate of at least for 25% of theoffered price and related to a single contract.7.2.5. Benzer iş olarak kabul edilecek işler aşağıda belirtilmiştir.7.2.5. Equivalent wheelmanufacture shall refer to all type of wheels used in railway vehicles.7.3. Belgelerin sunuluş şekli7.3. Form of submission of documents7.3.1-İstekliler, yukarıda sayılan belgelerin aslını veya aslına uygunluğu noterce onaylanmış örneklerini vermekzorundadır. İhale konusu iş veya benzer işlere ilişkin iş deneyim belgelerinin istenilmesi halinde, iş deneyim6
elgelerinin noter onaylı olanlarının asılları, ihale üzerinde kalan istekli tarafından ihale yetkilisinin onayından önceidareye ibraz edilecektir. Ancak, Türkiye Ticaret Sicili Gazetesi Nizamnamesinin 9 uncu maddesinde yer alan hükümçerçevesinde; Gazete idaresince veya Türkiye Odalar ve Borsalar Birliğine bağlı odalarca “aslının aynıdır” şeklindeonaylanarak isteklilere verilen Ticaret Sicili Gazetesi suretleri ile bunların noter onaylı suretleri de kabul edilecektir.7.3.1. It is obligatory for tenderers to submit the originals of the above-mentioned documents or their notary public attested copies. Ifthe work experience certificates for the work, subject of the tender or for similar works are required, the tenderer to whom the awardof the tender is given, will submit the originals of the notarised work experience certificates to the Contracting Entity before theapproval of the result of the tender by the contracting entity.7.3.2-Noter onaylı belgelerin aslına uygun olduğunu belirten bir şerh taşıması zorunlu olup, sureti veya fotokopisigörülerek onaylanmış olanlar ile “ibraz edilenin aynıdır” veya bu anlama gelecek bir şerh taşıyanlar geçerli kabuledilmeyecektir.7.3.2. It is obligatory for the notarised documents to bear the annotation “same as the original” and the ones of which photocopiesor copies have been seen and approved as well as the ones bearing the annotation “same as presented copy” or another annotationbearing the same meaning, shall not be accepted as valid.7.3.3- İstekliler, istenen belgelerin aslı yerine ihale tarihinden önce İdare tarafından “aslı idarece görülmüştür” veya buanlama gelecek şekilde şerh düşülen suretlerini tekliflerine ekleyebilirler.7.3.3. The attestation procedure for documents prepared in foreign countries apart from documents prepared by representationof the Republic of Turkey in foreign countries and the documents prepared by representations of foreign countries in Turkey:7.3.4.1.Tasdik işleminden, belgedeki imzanın doğruluğunun, belgeyi imzalayan kişinin hangi sıfatla imzaladığının vevarsa üzerindeki mühür veya damganın aslı ile aynı olduğunun teyidi işlemi anlaşılır.7.3.4.1. The attestation process means the confirmation of the truth of the signature on the document, in which capacity the personwho signed the document signed it and whether the seal or stamp, if any, on it is the same as original.7.3.4.2. Yabancı Resmi Belgelerin Tasdiki Mecburiyetinin Kaldırılması Sözleşmesine taraf ülkelerde düzenlenen ve buSözleşmenin 1 inci maddesi kapsamında bulunan resmi belgeler, “apostil tasdik şerhi” taşıması kaydıyla TürkiyeCumhuriyeti Konsolosluğu veya Türkiye Cumhuriyeti Dışişleri Bakanlığı tasdik işleminden muaftır.7.3.4.2. Official documents prepared in countries party to the Agreement on the Relief of the Attestation Obligation of Foreign Official Documentsand which are covered under the 1st article of that Agreement are exempt from attestation from the Consulates of the Republic of Turkey or theRepublic of Turkey Foreign Affairs Ministry, provided they bear an “apostille annotation of ratification”.7.3.4.3. Türkiye Cumhuriyeti ile diğer devlet veya devletlerarasında, belgelerdeki imza, mühür veya damganın tasdikişlemini düzenleyen hükümler içeren bir anlaşma veya sözleşme bulunduğu takdirde, bu ülkelerde düzenlenenbelgelerin tasdik işlemi, bu anlaşma veya sözleşme hükümlerine göre yaptırılabilir.7.3.4.3. In the event of existence of any agreement or covenant between the Republic of Turkey and the other state or statescontaining provisions which regulate the attestation process of signatures, seals or stamps on documents, the attestation ofdocuments prepared in such countries may be made according to the provisions of that agreement or covenant.7.3.4.4. “Apostil tasdik şerhi” taşımayan veya tasdik işlemine ilişkin özel hükümler içeren bir anlaşma veya sözleşmekapsamında sunulmayan, yabancı ülkelerde düzenlenen belgelerin üzerindeki imzanın, mührün veya damganın,düzenlendiği ülkedeki Türkiye Cumhuriyeti Konsolosluğu tarafından veya sırasıyla, belgenin düzenlendiği ülkeninTürkiye’deki temsilciliği ile Türkiye Cumhuriyeti Dışişleri Bakanlığı tarafından tasdik edilmesi gerekir. TürkiyeCumhuriyeti Konsolosluğunun bulunmadığı ülkelerde düzenlenen belgeler ise sırasıyla, düzenlendiği ülkenin DışişleriBakanlığı, bu ülkeyle ilişkilerden sorumlu Türkiye Cumhuriyeti Konsolosluğu veya bu ülkenin Türkiye’dekitemsilciliği ve Türkiye Cumhuriyeti Dışişleri Bakanlığı tarafından tasdik edilmelidir.7.3.4.4. The signature, seal or stamp on any document prepared in foreign countries which does not bear the “apostille annotation ofratification” or not submitted under any agreement or covenant containing special provisions relating to the attestation process,needs to be attested by the Consulate of the Republic of Turkey in the country where the document was prepared or, in the givenorder, by the representation, in Turkey, of the country in which the document was prepared and the Republic of Turkey ForeignAffairs Ministry. Documents prepared in countries where there is not Consulates of the Republic of Turkey should be attested, in thegiven order, by the Ministry of Foreign Affairs of the country in which it was prepared, the Consulate of the Republic of Turkeyresponsible for relations with that country or the representation of that country in Turkey and the Republic of Turkey Foreign AffairsMinistry.7.3.4.5. Yabancı ülkenin Türkiye’deki temsilciliği tarafından düzenlenen belgeler, Türkiye Cumhuriyeti DışişleriBakanlığı tarafından tasdik edilmelidir.7.3.4.5. Documents prepared by the representation of the foreign country in Turkey should be attested by the Republic of TurkeyForeign Affairs Ministry.7.3.4.6. Fahri konsolosluklarca düzenlenen belgelere dayanılarak işlem tesis edilmez.7.3.4.6. No transaction is effected based on documents prepared by honorary consulates.7
