At the last stage, as a result of the evaluation made, the tenderer who submit economically most advantageous offer is determinedand the award of the tender is given to this tenderer. The Tender Commission takes a justified decision and presents it to the tender authority for approval. Names or trade names oftenderers, the amounts offered, bidding date and the tenderer to whom the award of the tender is given due to which reasons areexplained and if the tender is not carried out, the reasons of which are also explained in the decisions.31.8. İhale yetkilisi, karar tarihini izleyen en geç on (10) gün içinde ihale kararını onaylar veya gerekçesini açıkçabelirtmek suretiyle iptal eder.31.8. Within a maximum of ten (10) days following the date of the decision, the tender authority approves or cancels the tenderdecision, clearly indicating the grounds thereof.31.9. İhale; kararın onaylanması halinde geçerli, iptal edilmesi halinde ise hükümsüz sayılır.31.9. The Contracting Entity is free to reject all of the bids and to cancel the tenderMadde 32- Sözleşmeye davetArticle 32- Invitation to sign the contractİhale üzerinde kalan istekliye veya yetkili temsilcisine tebliğ tarihini izleyen on (10) gün içinde (yabancı istekliye 15gün içinde) kesin teminatı vermek suretiyle sözleşmeyi imzalaması hususu, isteklinin veya yetkili temsilcisinin imzasıalınmak suretiyle İdarede tebliğ edilir veya iadeli taahhütlü mektup ile tebligat adresine postalanmak suretiyle bildirilir.Mektubun postaya verilmesini takip eden yedinci (7.) gün istekliye tebliğ tarihi sayılır. İdarece uygun görülmesihalinde, bu süreye on (10) gün, yabancı istekliye 15 gün ilave edilebilir.The notification for signing the contract by submitting the performance bond, is made to tenderer directly who has been awarded thetender at the Contracting Entity in return for his or his/her representative’s signature or this notification is sent through registered mailto his notification address, (within fifteen (15) days foreign tenderers), within ten (10) days following the notification date to the tendererwho has been awarded the tender or his/her authorized representative. The seventh (7th) day following the mailing date of the letter shallbe deemed as the notification date of the decision to the tenderer. İhale üzerinde kalan istekli, bu şartnamenin 10 uncu maddesinin (a), (b), (c), (d), (e) ve (g) bentlerinde sayılandurumlar da olmadığına dair belgeleri ve kesin teminatı 31 nci maddesindeki süre içinde vererek sözleşmeyi imzalamakzorundadır. Sözleşme imzalandıktan hemen sonra geçici teminat iade edilecektir.34.1. The tenderer who has been awarded the contract has an obligation to submit the performance bond within the period specifiedin Article 31 of this Specification and Documents for bidding attesting that the person is not in a situation mentioned in subarticles(a), (b), (c), (d), (e) and (g) of Article 10 of this specification and to sign the contract. The preliminary guarantee will be returnedimmediately after the contract has been signed.34.2.Yabancı istekliler, bu Şartnamenin 10 uncu maddesinin (a), (b), (c), (d), (e) ve (g) bentlerinde sayılan durumlardaolmadığına dair belgelerden, kendi ülkelerindeki mevzuat uyarınca dengi olan belgeleri sunacaklardır. Bu belgelerin,isteklinin tabi olduğu mevzuat çerçevesinde denginin bulunmaması yada düzenlenmesinin mümkün olmaması halindebu duruma ilişkin yazılı beyanlarını vereceklerdir. Ancak bu husus yabancı gerçek kişi isteklinin uyruğunda bulunduğu20
ya da yabancı tüzel kişi isteklinin şirket merkezinin bulunduğu ülkenin Türkiye’deki misyon şefliklerine veya buülkelerdeki Türkiye Cumhuriyeti misyon şefliklerine teyit ettirilecektir.34.2. Foreign tenderers shall submit equivalent documents that are legally valid in his country stating that he is not in the situationspecified in sub-articles (a), (b),(c), (d), (e) and (g) of Article to in this specification. Foreign tendered shall submit a writtenstatement, if these documents con not be prepared according to the legislations of this country or if their equivalents are not existing.However, this should be confirmed by the chief of mission Department of relevant country in Turkey, where the foreign naturalperson has citizenship or the headquarters of the company is registered or by the chief of Mission Department of Turkey in relevantcountry.34.3. Bu zorunluluklara uyulmadığı takdirde, protesto çekmeye ve hüküm almaya gerek kalmaksızın ihale üzerindekalan isteklinin geçici teminatı gelir kaydedilir.34.3. In case these requirements are not met, the preliminary guarantee of the tenderer who has been awarded the contract shall berecorded as income without the need for protest or obtaining a court order.34.4. Ayrıca üzerine ihale yapıldığı halde mücbir sebep halleri dışında usulüne göre sözleşme yapmayan istekli, 4734sayılı Kanunun 58 inci maddesi uyarınca bir yıl süreyle anılan Kanun kapsamında yer alan bütün kamu kurum vekuruluşlarının ihalelerine katılmaktan yasaklanır.34.4. Furthermore, in case the second economically most advantageous tenderer does not conclude the contract, except in cases offorce majeure, in accordance with the procedures although it has been awarded the contract, it will be prohibited for a period of oneyear from participating in the tenders of all public institutions and organizations in the scope of Article 58 of the Public ProcurementLaw number 4734.Madde 35- İhalenin sözleşmeye bağlanmasıArticle 35- Signing of the contract35.1.
