27.3. Letters of guarantee issued by foreign banks permitted to operate in Turkey under the related legislation and letters ofguarantee issued by banks operating in Turkey based on counter-guarantees of banks or similar credit institutions operating outsideTurkey shall also be accepted as guarantee.27.4. Teklifler ihale dokümanında belirtilen ihale saatine kadar İdareye verilir. İhale komisyonunca ihale dokümanındabelirtilen saatte kaç teklif verilmiş olduğu bir tutanakla tespit edilerek, hazır bulunanlara duyurulur ve hemen ihaleyebaşlanır. İhale komisyonu teklif zarflarını alınış sırasına göre inceler. Şartnamenin 22.1. maddesine uygun olmayanzarflar bir tutanak ile belirlenerek değerlendirmeye alınmaz. Zarflar isteklilerle birlikte hazır bulunanlar önünde alınışsırasına göre açılır.30.1. The bids are be submitted to the Contracting Entity by the deadline bidding time mentioned in this Specification. The number ofthe bids submitted by the deadline bidding time indicated in this Specification is specified by the Tender Commission with minutes,and it is announced to the audience and the tender will start. The tender commission examines the tender envelopes in the order theywere received. Envelopes that do not meet the requirements of Article 22.1 of this specification are specified with a minutes andconsequently excluded from the evaluation process. The envelopes are opened in the presence of the tenderers and the audience inorder of their receipt.30.2. İsteklilerin belgelerinin eksik olup olmadığı ve teklif mektubu ile geçici teminatlarının usulüne uygun olupolmadığı kontrol edilir. A control is carried out as to whether the documents of the tenderers are complete and whether the letter of bid and thepreliminary guarantee conform to the procedures. Tenderers whose documents are not complete or whose letter of bid andpreliminary guarantee do not conform to the procedures are recorded in a minutes. The tenderers and their bid prices areannounced. The minutes issued for these procedures is signed by the tender commission. A decision with regard to the rejection oracceptance of the bid is not made at this stage; the documents constituting the bid cannot be corrected or completed. The session isclosed for the tender commission to evaluate the tenders immediately.Madde 31-Tekliflerin değerlendirilmesiArticle 31- Evaluation of the tenders31.1. Tekliflerin değerlendirilmesinde, öncelikle belgeleri eksik olduğu veya teklif mektubu ile geçici teminatı usulüneuygun olmadığı bu Şartnamenin 29 uncu maddesine göre ilk oturumda tespit edilen isteklilerin tekliflerinindeğerlendirme dışı bırakılmasına karar verilir. Ancak teklifin esasını değiştirecek nitelikte olmaması kaydıyla,belgelerin eksik olması veya belgelerde önemsiz bilgi eksikliği bulunması halinde, idarece belirlenen süredeisteklilerden bu eksik belge veya bilgilerin tamamlanması yazılı olarak istenir. Belirlenen sürede eksik belge veyabilgileri tamamlamayan istekliler değerlendirme dışı bırakılır.31.1. The first decision during the evaluation process for the bids relates to the exclusion of bids according to Article 29 of thisSpecification due to incomplete documents or non-conformity of bids and preliminary guarantees to the procedures that weredetermined in the first session. However, in case that the documents are incomplete or there is omission of unimportant information,provided that these deficiencies do not affect the substance of the bid, the Contracting Entity shall request the tenderer in writing tofurnish these missing documents or information in a time period set out by the Contracting Entity. Tenderers who cannot furnish thesemissing documents or information shall be excluded from the evaluation.31.2. Belgeleri eksiksiz ve teklif mektubu ile geçici teminatı usulüne uygun olan tekliflerin ayrıntılı değerlendirilmesiyapılır. Bu aşamada, isteklilerin ihale konusu işi yapabilme kapasitelerini belirleyen kriterlerine ve tekliflerin ihaledokümanında belirtilen şartlara uygun olup olmadığı tespit edilir.İsteklilerce teklif edilen fiyatları gösteren teklif mektubu ve eki cetvellerde aritmetik hata bulunması halinde,isteklilerce teklif edilen birim fiyatlar esas alınmak kaydıyla, aritmetik hatalar ihale komisyonu tarafından re’sendüzeltilir.31.2. The bids of those tenderers whose documents are complete and whose preliminary guarantees conform to the procedures will besubject to a detailed evaluation. At this stage, it is determined whether tenderers meet the qualification criteria that determine thecapacity of tenderers to carry out the work that is the subject of the contract and whether the bids comply with the conditions set out inthe tender documents.In case of any arithmetic errors in the annexed schedules changing the bid prices, these arithmetic errors are corrected by the tendercommission ex officio, on the basis of the unit prices offered by the tenderers.31.3. Döviz cinsinden verilen teklifler, ihale tarihindeki T.C. Merkez Bankası döviz satış kurundan Türk Lirasınaçevrilerek değerlendirilmeye tabi tutulacaktır.31.3. The offers submitted over foreign exchange, shall be subject to evaluation by being converted into Turkish Liras (TL) over theforeign exchange sale rate of Turkish Central Bank on the tender date.31.4. Yerli ve yabancı isteklilerin vermiş olduğu tekliflerin değerlendirmesi yapılırken yabancı isteklilerin tekliflerindeyer alan fiyata, İdarece ödenmesi gerekecek akreditif masrafları, Gümrük Mevzuatı gereği ödenecek gümrük vergisi,nakliye, sigorta, Damga Vergisi, v.s. ithal masrafları da ilave edilecektir.İdarece yapılacak navlun araştırması sonucu isteklinin CIF teklifindeki navlun bedelinin düşük olması durumundaİdarece ihale CIF olarak sonuçlandırılabilecektir.31.4. During the evaluation of the offers submitted by domestic and foreign tenderers, costs of letter of credit that will be needed to berequested from the Contracting Entity, customs duty to be paid according to Customs Regulation, transport cost, insurance cost, stampduty, etc., import costs shall also be added to the price of the foreign tenderers. As a result of the search for freight to be carried out bythe Contracting Entity, if the freight cost in the CIF offer of the tenderer is low, the Contracting Entity may conclude the tender on CIFbasis.31.5. If the same price is offered by more than one tenderer and if it is understood that these offers are economically mostadvantageous offers, the tender is concluded by determining economically most advantageous offer taking into account the belowmentioned elements other than price:31.5.1.
