What information is required under Section 2<br />
Nature of the proceedings<br />
Please give a brief description of the proceedings and any factors which you think<br />
may be relevant to the assessment of the claim including work claimed under the<br />
FAS.<br />
If there is more than one private law aspect on the certificate e.g. children and<br />
finance which is subject to a fixed fee then you will need to complete this section and<br />
sections 3 and 4 (if applicable) for each proceeding. If the case is exceptional you will<br />
need to complete separate claims for each element that becomes exceptional and all<br />
applicable parts of the claim form will need to be completed. Note that the omission<br />
of section 1 is not mandatory and can be completed if required (i.e. the whole claim<br />
form can be generated multiple times if desired).<br />
You should also use this section to justify any necessary part of the claim such as<br />
where you are claiming a Hearing Unit fee (other than HU1 with no bolt – ons) and<br />
there is no Advocates Attendance Form e.g. where there has been a hearing by<br />
telephone or video conference.<br />
The half fee where there is a change of solicitor only applies to work undertaken<br />
under the public or private law schemes for representation (PFLRS/ CPGFS) where<br />
the costs incurred are less than the standard/ fixed fee that would be payable under<br />
the scheme.<br />
Actual costs incurred<br />
Please refer to the fee table on page 12 of this guidance to ensure you are claiming<br />
the correct fee and to work out whether or not your costs are exceptional.<br />
A) Care and Supervision cases<br />
Profit costs – this figure should be the actual costs you have incurred and<br />
includes the cost of all letters and telephone calls. It does not include the cost<br />
of any work done that falls within the definition of Advocacy i.e. preparation<br />
and travel time associated with advocacy as this is covered under the FAS.<br />
Regions – There are four regions, which all attract different fees (please refer<br />
to the fee table at the end of the guidance for details). The region is<br />
determined by the location of your schedule office and not the Court in which<br />
the case is being heard.<br />
