Indemnification Agreements<br />
Both Agreements must be completed annually.<br />
This years Retailer and Indemnification Agreements<br />
should already be completed, if not please contact<br />
customer service or your sales rep.<br />

Forms should be received at<br />
HEAD TYROLIA WINTERSPORTS INC., USA /<br />
HEAD TYROLIA SPORTS CANADA INC<br />
no later than December 31, <strong>2005</strong>.<br />
An administrative fee of $ 15 Cdn per year for<br />
each Certified Mechanic (maximum $ 75 Cdn per<br />
location) will be charged by TYROLIA in Canada<br />
and $ 30 US per location in the USA.<br />
If a retailer loses his only TYROLIA Certified<br />
Mechanic, he must notify<br />
HEAD TYROLIA WINTERSPORTS INC., USA /<br />
HEAD TYROLIA SPORTS CANADA INC<br />
in writing within 48 hours.<br />
Summary of Requirements<br />
These basic requirements help assure that the<br />
end product which is delivered to the customer<br />
is appropriate.<br />
• Signed, current copies of the HEAD-TYROLIA<br />
Authorized Retailer Agreement and the<br />
TYROLIA Bindings Indemnification Agreement<br />
must be on file with HEAD TYROLIA WINTER-<br />
SPORTS INC., USA / HEAD TYROLIA SPORTS<br />
CANADA INC.<br />
• The shop must adhere to <strong>2005</strong>/<strong>06</strong> TYROLIA<br />
procedures for selection, mounting, adjusting,<br />
testing and/or servicing of system components<br />
as detailed in this manual.<br />
• The actual TYROLIA retention/release adjustment,<br />
or its equivalent, must be used.<br />
• A TYROLIA Certified Mechanic must properly<br />
mount, inspect, adjust and/or service system<br />
components and/or check to make sure all<br />
service, adjustments, testing and record<br />
keeping were properly completed.<br />

• Mechanics must receive full training, including<br />
hands-on practice in the use of system testing<br />
devices, as provided by the testing device<br />
supplier. A multiple operator reproducibility test<br />
should be completed and results documented<br />
by the shop each season.<br />
• The shop must maintain records of all retail/<br />
rental testing and/or service work for 5 years or<br />
for the length of the statute of limitations in the<br />
state where your business resides, whichever is<br />
longer. Bear in mind that the statute of limitations<br />
for minors begins only when they come of<br />
legal age.<br />
Paperwork Requirements<br />
TYROLIA Retail/Rental Workshop tickets have<br />
proven their importance in the legal system, and<br />
we strongly recommend their use (see<br />
elsewhere in this manual).<br />
At the very minimum, records must contain<br />
the following information:<br />
• Identification of shop and customer:<br />
name, address, phone.<br />
• Date of transaction or work.<br />
• Information on which binding settings are based:<br />
skier height, weight, skier type, age, boot sole<br />
length.<br />
• A full description of the equipment being<br />
serviced or rented (skis /boots / bindings),<br />
including but not limited to brand, model,<br />
size and serial numbers.<br />
• Skier code, “Initial” binding release/retention<br />
settings, and final settings.<br />
• Signed, dated statement from the TYROLIA<br />
Certified Mechanic that all manufacturer’s<br />
procedures have been completed, and the<br />
signature of the mechanic who performed the<br />
service (if they are different individuals).<br />
• An agreement dated and signed by the customer,<br />
the language of which is substantially<br />
similar to the current TYROLIA form. This agreement<br />
must include the following points:<br />
• User verification of skier information.<br />
• WARNING that there are risks of injury inherent<br />
in the sport of skiing and that the customer<br />
accepts those risks.<br />
• DISCLOSURE of the equipment’s limitations,<br />
that it will not release, retain or prevent injury<br />
under all circumstances, and is no guarantee<br />
of the user’s safety.<br />
• RELEASE language whereby the user releases<br />
the retailer, manufacturer and distributor from<br />
liability and damages, to the fullest extent<br />
allowed by law.<br />
• STATEMENT that no warranties of any kind are<br />
offered by the shop beyond those offered by<br />
TYROLIA.
