European Railway AgencyGuide <strong>for</strong> <strong>the</strong> <strong>application</strong> <strong>of</strong> <strong>the</strong> CSM Regulation (b) if <strong>the</strong> design parameter cannot be changed, that needs to be considered as a deviationthat will be dealt in compliance with section 2.3.6.2.3.2. The codes <strong>of</strong> practice shall satisfy at least <strong>the</strong> following requirements:(a) be widely acknowledged in <strong>the</strong> railway domain. If this is not <strong>the</strong> case, <strong>the</strong> codes <strong>of</strong>practice will have to be justified and be acceptable to <strong>the</strong> assessment body;(b) be relevant <strong>for</strong> <strong>the</strong> control <strong>of</strong> <strong>the</strong> considered hazards in <strong>the</strong> system underassessment;(c) be publicly available <strong>for</strong> all actors who want to use <strong>the</strong>m.[G 1] It is important that <strong>the</strong> "codes <strong>of</strong> practice" are composed <strong>of</strong> documents acceptable to <strong>the</strong>relevant assessment body.[G 2] Codes <strong>of</strong> practice from o<strong>the</strong>r fields (e.g. nuclear power, military and aviation) can also beapplied to railway systems <strong>for</strong> certain technical <strong>application</strong>s provided <strong>the</strong> concerned actordemonstrates that <strong>the</strong> related codes <strong>of</strong> practice are effective at controlling <strong>the</strong> related railwayhazards.[G 3] In <strong>the</strong> framework <strong>of</strong> <strong>the</strong> Railway <strong>Safety</strong> Directive {Ref. 1} and <strong>the</strong> CSM Regulation, <strong>the</strong>following may be considered as codes <strong>of</strong> practice:(a) TSI and mandatory European standards;(b) Notified National <strong>Safety</strong> Rules;(c) Notified National Technical Rules (technical standards or statutory documents) and ifrelevant non mandatory European standards;(d) provided <strong>the</strong> conditions in section 2.3.2 are fulfilled, internal rules or standards that areissued by an actor <strong>of</strong> <strong>the</strong> railway sector.2.3.3. Where compliance with TSIs is required by Directive 2008/57/EC and <strong>the</strong> relevant TSIdoes not impose <strong>the</strong> risk management process established by this Regulation, <strong>the</strong> TSIsmay be considered as codes <strong>of</strong> practice <strong>for</strong> controlling hazards, provided requirement (c)<strong>of</strong> point 2.3.2 is fulfilled.[G 1] If it can be demonstrated <strong>for</strong> <strong>the</strong> system under assessment that <strong>the</strong> applicable TSI alsoenables <strong>the</strong> adequate control <strong>of</strong> one or more <strong>of</strong> <strong>the</strong> identified hazards, fur<strong>the</strong>r risk analysisand safety measures are not needed <strong>for</strong> those related hazards.[G 2] If <strong>the</strong> relevant TSI cannot fully control <strong>the</strong> identified hazards, o<strong>the</strong>r codes <strong>of</strong> practice orano<strong>the</strong>r risk acceptance principle need to be applied <strong>for</strong> controlling <strong>the</strong>se hazards.2.3.4. National rules notified in accordance with Article 8 <strong>of</strong> Directive 2004/49/EC and Article17(3) <strong>of</strong> Directive 2008/57/EC may be considered as codes <strong>of</strong> practice provided <strong>the</strong>requirements <strong>of</strong> point 2.3.2 are fulfilled.[G 1] Additional explanation is not judged necessary.
