Among the protections offered in this part are those related to individual rights,which are not to be arbitrarily denied by the facility. These rights include: a safe andsanitary environment; freedom from physical or psychological abuse; a writtenindividualized plan of service; a balanced and nutritious diet; the opportunity to requestan alternative residential setting; the right to express grievances and issues; and theopportunity to receive visitors at reasonable times, among others. Any limitations of theaforementioned rights are required to be “on an individual basis, for a specific period oftime and for clinical purposes only.” The rights listed in this section may only be deniedon a temporary basis for a valid treatment purpose.Section 633.9 addresses follow-up activities subsequent to a reported allegation ofabuse. It demands that: situations be immediately evaluated; investigations launched ifdeemed appropriate; removal, reassignment, relocation or suspension of the allegedabuser; and an immediate report to law enforcement “when it appears that a crime mayhave been committed against a person receiving services.”1314Although Part 635 is one of the three universal regulations for all sites, it is notrelevant to this investigation. As noted above, Part 635 which addresses the physicalplant and other services is not related to the complaints made by the Careys.APPLICABLE POLICIES AND PROCEDURESThe Anderson School has created policies and standard operating procedures thatreflect the duties imposed upon it by the abovementioned regulations. Pertinent to thisinvestigation are several policies of importance. For example, the Anderson School’s13 14 NYCRR 633.4(a)(4).14 14 NYCRR 633.9.46
policy on behavior plans applies to individuals exhibiting maladaptive behaviors andprovides a very specific protocol for staff to follow toward the goal of eliminating these15behaviors. Not all students have behavior plans. For example, it does not appear thatJonathan had a behavior plan for his first 12 months at the facility.The Anderson School’s policy entitled Individual Rights/Objection to ServicesProcess ensures that individuals and their parents can object to any plan of service.16 TheAnderson School’s policy for management of endangering behaviors by students requiresthat students who exhibit these behaviors are not excluded from educationalprogramming unless absolutely necessary and with concurrent notification of the school17district. In most cases, parents are to be notified of the behavior plan at the individual’seducational plan meeting and all plans are to be mailed to the parents.Other provisions related to this case include Anderson School’s policy on anstudent’s education plan, which seeks to ensure that the plan is compliant with applicable18regulations.
