Asrequired, the Anderson School responded with a Plan <strong>of</strong> Corrective Action to remedy theproblems identified. The Careys received a copy <strong>of</strong> the <strong>State</strong>ment <strong>of</strong> Deficiencies and thePlan <strong>of</strong> Corrective Action after making a request in accordance with the state’s Freedom<strong>of</strong> Information Law.OMRDD’s Taconic Developmental Disabilities Services Office (Taconic regional<strong>of</strong>fice) conducted an investigation, and issued a report finding “mistreatment” and“neglect” pursuant to OMRDD regulations. Although services to Jonathan and his familywere coordinated through the Capital District regional <strong>of</strong>fice, the Taconic regional <strong>of</strong>ficeconducted the investigation because the Anderson School was within Taconic’sjurisdiction. The Taconic regional <strong>of</strong>fice completed its investigatory report on December1, 2004, and communicated a summary <strong>of</strong> its findings to the Anderson School in a letterdated December 20, 2004. In a letter dated the same day, the Taconic regional <strong>of</strong>ficeprovided the Careys with a summary <strong>of</strong> its findings.<strong>State</strong> Education DepartmentThe Anderson School’s educational programs, but not its residential and treatmentprograms, are licensed by the <strong>State</strong> Education Department. The Education Department’sdivision <strong>of</strong> Vocational and Educational Services for Individuals with Disabilitiesreviewed the allegations but determined that the alleged abuses occurred in the residentialprogram at the Anderson School, and were therefore outside <strong>of</strong> its jurisdiction.However, the Education Department, which oversees the preparation, licensure,and practice <strong>of</strong> certain pr<strong>of</strong>essions, opened an investigation <strong>of</strong> a registered nurse at the38
