III. BackgroundNEW YORK STATE SERVICES FOR INDIVIDUALS WITHDEVELOPMENTAL DISABILITIESA child with developmental disabilities is entitled to special services from stateand local government. Local school districts are required to provide special educationservices to qualifying students within their jurisdictions. Jonathan was served by theBethlehem Central School District and his services were coordinated in consultation withthe district’s Committee for Special Education. As required, the committee developedand regularly reviewed an Individualized Education Program for Jonathan. TheIndividualized Education Program detailed his learning needs, goals for the coming year,and the services that the school district would provide to help him meet those goals. Atthe Careys’ request, Jonathan’s transfer to the Anderson School was approved by theBethlehem Central School District’s Committee for Special Education.OMRDD is responsible for administering the state’s programs for citizens withdevelopmental disabilities and for overseeing and certifying private providers of servicesto those individuals within the state. Approximately 140,000 individuals withdevelopmental disabilities within the state receive services, but the majority of servicesare not provided directly by the state. Private, or “voluntary,” providers certified byOMRDD administer nearly 80% of services for individuals with developmentaldisabilities in New York. The Anderson School is one such voluntary provider.Individuals or families of individuals with developmental disabilities gain accessto services through OMRDD’s regional developmental disabilities services offices.32
Some individuals with disabilities and their families receive case management from aMedicaid Service Coordinator, who is a single point of contact and helps to identify andmanage services available to the family or the individual.
