limiting Jonathan’s contact with his parents prompted them to remove him from theschool on October 22, 2004.ALLEGATIONSOn the same day, Michael and Lisa Carey alleged to their Medicaid ServiceCoordinator that their 11-year-old child, Jonathan, who had developmental disabilities,had been abused at the Anderson School. The Anderson School is a not-for-pr<strong>of</strong>itinstitution that is certified by New York <strong>State</strong> to care for individuals with developmentaldisabilities. The Careys’ complaint resulted in investigations by several state agencieswith jurisdiction over the matter. OMRDD, which certifies the Anderson School,conducted a program review and its Taconic regional <strong>of</strong>fice completed an investigation,each <strong>of</strong> which resulted in a report. In addition, CQC, an independent oversight body, alsoinvestigated the matter and issued two reports. The <strong>State</strong> Education Department’s Office<strong>of</strong> Pr<strong>of</strong>essional Discipline opened an investigation regarding licensed pr<strong>of</strong>essionals at theschool that were involved in the matter. Several months later, the Dutchess CountyDistrict Attorney’s <strong>of</strong>fice, with the assistance <strong>of</strong> the <strong>State</strong> Police, reviewed the case forpotential criminal charges.Although the Careys named several individuals as instrumental in the allegedmistreatment <strong>of</strong> Jonathan, none <strong>of</strong> the investigating agencies identified any individual asbeing liable in the matter. CQC, which was responsible in this case for determiningwhether any employee committed child abuse or neglect under the state’s definition inSocial Services Law § 412, did not find any individual responsible. However, CQCissued a separate report criticizing systemic deficiencies related to Jonathan’s care andtreatment at the school.
