7. There is no justification for a child placed in a private, state-certified facility to beafforded less protection from abuse than a child in a state-run facility. TheInspector General encourages OMRDD to re-examine draft regulations onbehavior management (14 NYCRR § 633.16) to ensure consistent safety andoversight protections for all consumers statewide.8. The Inspector General recommends that CQC re-evaluate its policies regardingSocial Services Law § 412(10), “Institutionally neglected child in residentialcare,” to ensure that the law is applied in accordance with its plain language andits legislative intent to identify systemic problems at regulated institutions andensure that the appropriate agency is aware of and addresses the problem.9.
