In conducting its survey, OMRDD failed to obtain information collected by theTaconic regional <strong>of</strong>fice or to learn <strong>of</strong> its findings. As a result, the <strong>State</strong>ment <strong>of</strong>Deficiencies was incomplete and, in places, inconsistent with the findings <strong>of</strong> the Taconicregional <strong>of</strong>fice’s investigation. OMRDD <strong>of</strong>ficials, including the Commissioner at thetime, conceded that this lack <strong>of</strong> coordination was a problem.OMRDD Central Office also did not interview Jonathan’s parents and did notseek to examine an Anderson School logbook in the Careys’ possession that they claimedheld evidence <strong>of</strong> abuse against Jonathan.While OMRDD cited several regulatory violations by the Anderson Schoolregarding Jonathan’s care, it obtained evidence <strong>of</strong> other violations, some very serious innature, that were not included in the <strong>State</strong>ment <strong>of</strong> Deficiencies.Notably, OMRDD failedto mention potential violations <strong>of</strong> regulations prohibiting seclusion, unauthorized timeout,or neglect, all <strong>of</strong> which are forms <strong>of</strong> abuse under OMRDD regulations.OMRDD Central Office accepted a Plan <strong>of</strong> Corrective Action from the AndersonSchool in response to the <strong>State</strong>ment <strong>of</strong> Deficiencies, even though the school’s Plan <strong>of</strong>Corrective Action contained erroneous or dubious information that should have beenrejected.OMRDD also provided inaccurate and misleading information regarding theirinvestigative efforts to the Governor’s Office when asked to respond to the Careys’complaint to Governor George Pataki.Finally, the Inspector General learned that there are inconsistent regulatorysafeguards for OMRDD consumers receiving services in some private settings when11
