Standing With Hong Kong IndustryAmid the FinancialStormEvery year is a busy one, rapiddevelopments and unforeseenchallenges will always keep us busyand on our toes, yet 2008 stands outas we entered the worst economicturmoil since the Great Depression.As a globalised economy with clientsand suppliers worldwide, we are notimmune. And as traditional marketsfold, we see some manufacturerscollapse as well. However, we also seemany businesses fighting back. Yet onthe whole we rethink the traditionalapproach of conducting business anddevise new ones to ensure not only oursurvival, but our leading edge for thefuture.Much of the FHKI’s work during thelatter half of the past financial yearhas been occupied with addressingthe impact of the Financial Tsunami,where many of our members havebeen hit hard. The economic falloutpiles on top of existing challengesfaced by industries as they operate inan increasingly stringent regulatoryenvironment. As difficulties mountwith tightening regulations, decreasingorders and limited credit lines, thebusiness environment becomes moreprecarious for many businesses,particularly for resource-strapped SMEs.In recognising the urgency of thesituation, we have promptly respondedwith initiatives that engage bothindustries and governments. Earlythis year, we took discussions directlyto Beijing, where we met with StateCouncillor Liu Yandong and othersenior trade and government officialsto discuss how Hong Kong industry isdealing with the Financial Crisis. Reflecting Members’ Concernsto Authorities反 映 會 員 意 見State Councillor Liu Yandongmeets the FHKI delegation atZiguangge in Zhongnanhai,Beijing.國 務 委 員 劉 延 東 在 北 京中 南 海 紫 光 閣 會 見 工 總 代表 團 。Global Financial TurmoilIn view of the acute economic impactof the global financial turmoil, last yearthe FHKI concentrated its efforts onlobbying the Central, Guangdong andSAR governments to assist Hong Kongmanufacturers who faced declining ordersand difficulties in obtaining bank credit.Following an urgent survey conductedin October to assess the extent to whichmembers were affected by the creditcrunch, the FHKI wrote to the ChiefExecutive and Financial Secretary callingtheir attention to the severity of theproblem and offering suggestions onrelief measures. The FHKI also attendedspecial meetings of the LegCo Panel onCommerce and Industry to give viewson actions the SAR Government shouldtake to mitigate the impact of the globalfinancial turmoil on local companies. Inaddition, the FHKI leadership met withsenior executives of major banks to sharewith them members’ concerns over thecredit crunch.To step up the lobbying effort, inNovember the FHKI wrote separately tothe Premier and Guangdong Governor,appealing for support and relief measuresto help ease the hardships of Hong Kongmanufacturers operating in the PRD. TheFHKI also raised the requests with StateCouncillor Liu Yandong during the highlevelvisit to Beijing in January.The FHKI was greatly encouraged bythe positive responses of the Central,Guangdong and SAR governments. Whilewelcoming the measures they promptlyintroduced to solve the credit crunchproblem and alleviate the cost andcompliance burden on manufacturers,the FHKI will keep a close watch ondevelopments and if necessary continueto reflect the concerns of members to thegovernments.12 FHKI Annual Report 2008-09

FHKI leadership reflects the problems faced byHong Kong manufacturers amid the financialturmoil.工 總 領 導 向 廣 東 省 省 長 黃 華 華 反 映 珠 三 角港 商 在 金 融 危 機 下 遇 到 的 困 難 。Mainland’s New Labour LegislationAside from the global financial turmoil,the proliferation of labour legislation inthe Mainland also aroused much concernamong members. Over the year, the FHKIstudied several labour and related billsproposed by the Central and Guangdonggovernments. These included: Draft SocialSecurity Law(《 社 會 保 險 法 ( 草 案 )》),Draft Ordinance on Implementation of theLabour Contract Law (《 勞 動 合 同 法 實 施條 例 》), Draft Democratic Management inEnterprises Ordinance of the GuangdongProvince(《 廣 東 省 企 業 民 主 管 理 條 例( 草 案 )》), Draft Surveillance of LabourProtection Ordinance of the GuangdongProvince(《 廣 東 省 勞 動 保 障 監 察 條 例 ( 草案 )》).In the submissions commenting on theselegislative proposals, the FHKI cautionedagainst hasty and drastic changes to thelabour protection regime and suggestedthat any improvements to be made shouldbenchmark against the standards adoptedby other economies, so as to minimise theirdetrimental effects on the Mainland’sinvestment environment. The FHKI alsourged the authorities to ensure that anynew labour legislation would not interferewith the normal and effective operationof enterprises or entail excessive cost andadministrative burden on employers.With the assistance of the Liaison Office ofthe Central People’s Government in HongKong SAR, Hong Kong Deputies to theNational People’s Congress, and membersof the National Committee of the ChinesePeople’s Political Consultative Conference,the FHKI’s views were reflected to therelevant authorities of the Central andGuangdong governments.Promoting Innovation and MarketDevelopmentUnder the economic downturn and withthe world economy getting increasinglyglobalised and competitive, the needfor Hong Kong industry to upgrade andinnovate has become more pressing. Aspart of its continued effort to promoteR&D, design and branding, the FHKIlobbied the SAR Government to offertax incentives to encourage the businesssector to invest in these high value-addedactivities. During the Pre-Policy Addressand Pre-Budget consultations as well asthe mid-term review of the R&D Centres,the FHKI reiterated the importance for theSAR Government to take a leading role andprovide necessary support for companiesin fostering Hong Kong’s innovation andtechnology development.As for market development, the FHKIargued for enhancements to the SMEExport Marketing Fund to strengthen theassistance for companies in exploringnew business opportunities in emergingmarkets. The FHKI also offered suggestionsto the Central and SAR Governments forfacilitating Hong Kong manufacturerspursuing domestic sales in the Mainland.In response to our approach, a numberof support measures were introduced toassist manufacturers.Other IssuesThe FHKI also responded to severalpublic consultations with significantbearing on members. These includedthe proposed competition law, thehealthcare reform, and the Draft Code ofPractice on Employment under the RacialDiscrimination Ordinance. Closer Mainland Collaboration與 內 地 更 緊 密 協 作With seven liaison offices in Shenzhen,Dongguan, Guangzhou, Foshan,Zhongshan, Huizhou and Jiangmen, thePRD Council (PRDC) is well positioned torespond to the rapid changes to the PRDbusiness environment and deal with thefinancial crisis.In the past year, the PRDC providedservices and information that catered tomembers’ needs, it issued PRD Newsletters,transcribed memos on new industrialand commercial policies, held a total of85 seminars and regular communicationmeetings with government officials,and provided free ‘Ask-the Professionals’advice on policies and regulations suchas the Labour Contract Law, adjustmentsin processing trade measures, tax andcustoms affairs, inspection and quarantineetc. Furthermore, the PRDC assistedmembers in seeking solutions to businessproblems encountered in the PRD withthe ‘Enquiry Hotline’ where 3,537 inquirieswere received as well as conductingsupport services to 304 cases.To further strengthen cooperation andcommunication with Mainland authorities,the PRDC organised goodwill missions tothe Guangdong provincial governmentand related departments of variousmunicipal governments. The PRDC activelyreflected views and suggestions of HongKong industries and developed importantcommunication links between HongKong industries and Mainland authorities.On 2 June and 1 December 2008, thePRDC visited Guangdong Provincial ViceGovernor Wan Qingliang and GovernorHuang Huahua respectively, andreflected the impacts of PRD regulatorydevelopments on industries.On 10 September and 12 November 2008,the PRDC visited the Shenzhen MunicipalPeople’s Congress and GuangdongPeople’s Congress separately to representindustries’ views on various employmentlegislations and proposed a legislativeconsultation period, grace period andprobationary period. Moreover, missions tothe Guangdong Labour and Social SecurityBureau, Guangdong EnvironmentalProtection Bureau, Guangdong Entry-Exit Inspection and Quarantine Bureau,and various PRD municipal functionaldepartments were organised. Duringthese missions, problems experiencedby Hong Kong industries concerning theLabour Contract Law, entry-exit inspectionand quarantine policy, tax measures,processing trade and environmentalprotection rules were discussed. Aimed to help the victimswith medical treatment and rehabilitation,the Fund raised a total of HK$2,295,820,out of which HK$1,439,000 was donatedto Operation Concern for sponsoring TheSecond People’s Hospital in Chongzhouand Dayi People’s Hospital to replacedamaged medical equipment anddiagnostic instruments. The kickoff ceremony washeld on 25 November 2008. The Awardsrecognise outstanding environmentalpractices and organise an array ofeducational and promotional activities toraise green consciousness of manufacturersin both Hong Kong and the PRD. A seriesof activities including seminars on cleanerproduction were held in Dongguan,Foshan, Shenzhen and Guangzhou alongwith visits to the production plants of lastyear’s awardees.Response to the Awards has beenpositive and encouraging. There were113 applications with a total of 339environmental projects for the 2007Awards. The Grand Award went to LeoPaper Group (Hong Kong) Ltd. During the two years, fourseminars and three workshops were heldto inform industries on how to deal withprevailing environmental regulations.The HKGMA organised a study missionto Brussels, Belgium from 13 to 17 April2008. The main objective was to gainthe latest information on REACH byattending a workshop co-organised bythe European Commission and EuropeanChemicals Agency (ECHA). The delegationsuccessfully held meetings with officialsfrom various organisations such as theECHA as well as the Hong Kong Economicand Trade Office in Brussels. The dinner was well attendedwith 46 Q-Mark licencees and 700 guests.During the year, the Council participatedin various events to promote the Q-MarkSchemes and Green Mark Scheme,including trade shows, seminars and casuallunch gatherings in Hong Kong and in theMainland.Street surveys were commissioned bythe Council between December 2007and January 2008 and were conducted inHong Kong, Guangzhou, Dongguan andShenzhen involving 1,800 respondents.Based on the surveys’ findings, twoversions of Q-Mark TV commercials wereproduced and aired on TVB Jade Channelbetween November and December2008. The TV commercials helped raiseconsumer awareness about Q-Mark and itslicencees. The total cost of the commercialswas supported by the Council and fivelicencees - A-Fontane Co Ltd, Hoe HinPak Fah Yeow Manufactory Ltd, Kin HipMetal & Plastic Factory Ltd, Lee Kum KeeCo Ltd and Wing Wah Food ManufactoryLtd. Protecting Intellectual AssetsThe Intellectual Property Centre (IPC)carried on with its mandate to encourageinnovation and product development ofthe business sector. Over 1,000 cases werehandled last year.The IPC worked closely with the IntellectualProperty Department, Customs & ExciseDepartment and other organisations topromote intellectual property servicesand awareness. The IPC also cooperatedwith the Hong Kong Trade DevelopmentCouncil (HKTDC) and Trade and IndustryDepartment as a consultant and providedfree ‘Meet the Advisors’ consultant servicesfor enterprises and the public. In August 2008, the Divisionstarted a new service to facilitate traders’application for consulate legalisation onendorsed commercial documents. Theservice has been extended to cover sevendestination countries.And in taking customer service to a newlevel, last year the Division designateda customer service officer to managecustomer relationships and enhanceresponsiveness.The Division also provides paper-toelectronicconversion service for importand export trade declaration. SinceJanuary 2009, the Division has providedthe service with a new partner - Globale-Trading Services Ltd. This competition isrecognised as the most prestigious productdesign competition in Hong Kong, and toreflect the high standards of the Awards,only one Grand Award is presented as themost outstanding entry each year.In 2008, 85 entries for the competitionwere received. After two stringent judgingsessions, one Grand Award, six second-tierAwards and nine Certificates of Merit weregiven. Group 1 Chemical &Pharmaceutical IndustriesCouncilIn the year, Group Chairman JimmyKwok and Group members provideduseful technical advice for the FHKIleadership in lobbying the Guangdongand SAR Governments to help establishan environmental industrial park for theexclusive use of Hong Kong electroplatingfactories based in the PRD. The twogovernments were supportive of theFHKI’s proposal and a suitable sitein Jiangmen was identified. Delegates met with representativesfrom the Department of Commerce ofHunan Provincial Government, TaojiangMunicipal Government, Yiyang andTaojiang Municipal Investment PromotionBureau. Delegates raised suggestionson the integrated development of theHunan bamboo industry. They visited abamboo forest as well as several bamboobusinesses. The delegation also conductedsite inspection at three local schools hit bysnowstorms in early 2008. Over 180 participants attendedthe event.After the seminar, the HKEIC hosted theAnnual Dinner 2008 at the HKCEC whichwas well attended by over 180 guests.Rita Lau, then Permanent Secretary forCommerce and Economic Development(Communications and Technology), wasthe guest of honour.On 24 November, the HKEIC and Group25 Hong Kong Information TechnologyIndustry Council co-organised a crossgroupcasual luncheon, which providedan opportunity for members to sharetheir expertise and explore businessopportunities between the two industries.In July, officials from the Liaison Office ofthe Central Government in Hong KongSAR were invited to a special meeting tohear members’ concerns over the CentralGovernment’s decision to withdraw theexport tax rebate for alkaline electricalcells. CDC Software AsiaManaging Director Ian Whitehouse andProfessional Services Manager C P Fungwere invited as guest speakers; both talkedabout Multi-Dimensional Traceability(MDT), which is a business processthat allows food processors to rapidlydetermine the source of defective foodproduct at any stage in the productionprocess.Last year, the Hong Kong food tradewas deeply disturbed by the incidentof melamine-contaminated milk anddairy products. In September, the Groupconvened an urgent meeting to discussthe new regulations introduced by the SARGovernment to prohibit the supply of foodproducts containing an excessive amountof melamine. Immediately following themeeting, Group Chairman Eddy Lee wroteto the Chief Secretary for Administrationto express members’ concerns over thepractical aspects of the regulations. InNovember, officials of the Centre for FoodSafety met with members to hear theirconcerns and brief them on the measuresundertaken by the Government to assistthe food trade in compliance.During the year, the Group also presentedits views to the Legislative Council onlegislative proposals to enhance publichealth and food safety, such as the Foodand Drugs (Composition and Labelling)(Amendment: Requirements for NutritionLabelling and Nutrition Claim) Regulation2008 and the Public Health and MunicipalServices (Amendment) Bill 2008. The Awardpresentation ceremony was held inconcurrence with the HKMDC’s AnnualDinner on 1 December that featuredYvonne Choi, Permanent Secretary forCommerce and Economic Development(Commerce, Industry and Tourism), as theguest of honour.Capitalising on the success of the previousyear, the HKMDC joined hands again withGuangzhou Guangya Messe Frankfurt andDEMAT to co-organise the 2 nd Asiamold2008 between 24 and 26 September2008 at the Guangzhou InternationalConvention and Exhibition Centre. Witha 20,000 sq.m. exhibition area, the fairattracted over 300 exhibitors and 15,000visitors from around the world. A newlydesigned ‘Automation Workshop’ waslaunched during the fair to demonstratethe latest technology trends in automationgears and industry solutions.To nurture the mould-making talent pool,the HKMDC partnered with the VocationalTraining Council (VTC) to facilitate trainingand job placement by organising seminarsand providing internship opportunitiesand scholarship.In May 2008, the HKMDC organised a visitto Datamatic CNC Engineering and InmoldTechnology Ltd to enhance members’knowledge on industrial technology. A series of seminars, funded by theTrade and Industry Department’s SMEDevelopment Fund, were jointly organisedby the HKTC and Toys Manufacturers’Association of Hong Kong (TMHK). Theseseminars covered recent challenges,new technological developments, theproposed Toy Safety CoordinationInitiative of the US Toy IndustryAssociation, development strategies,recent costs issues and new internationalsafety standards.The HKTC and TMHK also jointly organisedthe first-ever Annual Dinner of HongKong Toys Industry on 16 December atthe HKCEC. With the theme ‘One IndustryOne Mission’, local industry memberspledged their dedication for unity andcontinued efforts to strive for success withmotivation, innovation and creativity. Over700 guests attended the dinner.Capitalising on the success of the HongKong International Toys Festival 2008, theHKTC and TMHK organised the Festivalfor the second time in 2009. A kick-offceremony was held on 5 January at theHotel Nikko Hongkong, which attractedover 400 guests including local andoverseas industry members, buyers andmedia, to celebrate Hong Kong’s enviabletrack record of achievement as the‘World’s Toy Centre’.To raise manufacturers’ understandingof international product safety standards,the Council and HKTDC co-organised theLatest Product Safety Directives of the ToysIndustry Conference on 7 January at theHKCEC. Distinguished speakers includedgovernment officials and industry expertsfrom mainland China, US and Europe.Funded by the SME Development Fund,the Conference attracted around 600participants. A press conference was heldafterwards to address local and overseasmedia.At the request of the Liaison Office ofthe Central Government in Hong KongSAR, the HKTC in collaboration with theTMHK compiled a report on the businessoutlook for Hong Kong’s toys industryas well as the challenges it faced. Inthe submission, the HKTSC highlightedthe practical problems which retailersof the regulated electronic productsmight have in complying with the Orderand suggested simplifying some of itsrequirements.The HKTSC organised a wine-tastinggathering at the Sogo Club in September2008 to further foster the communal spiritamong members. This event was coorganisedby the ExCom member LifestyleInternational Holdings Ltd, and variousItalian wines were introduced.In October 2008, a hairy crab dinnergathering was organised at the Yau YatChuen Garden City Club. Gourmet expertWilliam Mark was invited to attend thedinner which was hosted by ExCommember Hing Lung Food Place Ltd.Delicious hairy crabs and Chinese yellowwine were served to 100 guests.The HKTSC’s Spring Dinner 2009 was heldin March at the Kowloon Club. Group 25 Hong KongInformation TechnologyIndustry Council (HKITIC)In the past year, the HKITIC continuedto support the development of theinformation technology industry as well asthe Hong Kong business environment withthe establishment of the Ethics Committeein April 2008.The HKITIC held a cross-group casuallunch with the Hong Kong ElectronicsIndustry Council on 24 November 2008to foster closer communications betweenboth groups and explore businessopportunities. Moreover, in April 2008and February 2009, with co-sponsorshipfrom the Hong Kong IT Alliance, iProASIG Venture Capital and New BusinessDevelopment, the HKITIC organised aseries of seminars on topics such as Use ofPrivate Equity as Funding Source and Jointevent in Venture Capital and New BusinessDevelopment. Two otherprofessionals in environmental protection -Environmental Protection Department’sRaymond Wong and Sun Hing IndustriesHolding Ltd’s Patrick Yeung, also spokeat the luncheon. They respectivelyintroduced the Cleaner ProductionPartnership Program and sharedsuccessful experience on water reusetechnology. On 17 September 2008, a crossgroupnetworking luncheon was heldwith Group 20 (Hong Kong TradeServices Council) to foster greatercommunications. Group ChairmanIr Daniel Cheng and Group 20 Vice-Chairman Dr Measure Hung introducedtheir industries’ latest developments aswell as two environmental programmes.The gathering created an ideal platformfor members to explore businesscollaboration; it was well received withover 30 participants. The Group alsoorganised members to exhibit at the HongKong Pavilion as part of the Eco Expo Asia2008 from 28 to 31 October 2008; a totalof 24 companies were showcased at thePavilion to highlight industries’ efforts inenvironmental protection.Group Chairman Ir Daniel Chengand LegCo Representative the HonAndrew Leung led Group members andtenants of the EcoPark to meet with theEnvironmental Protection Departmenton 18 December 2008. Group 27 AutomobileComponentsSince the implementation of the LabourContract Law in January 2008, labourdisputes have increased. Thus the Grouporganised a seminar on 14 November 2008to give members an in-depth overview ofthe Law.FHKI Deputy Chairman Stanley Lau keptmembers abreast of the latest updatesof the Law, while FHKI Group 7 (Metal& Machinery) Chairman Peter Sun andSurface Mount Technology Ltd’s AugustineLai shared labour dispute cases withparticipants and provided useful tips onlegal proceedings.
