Pilot, etc.) or $2,000 per episode of a Series directly to the CMPA.ii) If the Producer is a Member in Good Standing of the APFTQ as of thedate of the remittance of the fee, (which membership in good standingshall be confirmed by the APFTQ by written notice), 2% to a maximumof $1,000 per production or episode to the Guild, and any levies whichmay be due to the APFTQ directly to the APFTQ.iii) If the Producer is not a Member in Good Standing of one of theAssociations as of the date of the remittance of the fee, as evidenced bywritten notice from one of the Associations to such effect, 7% with nomaximum for any Production or Episode, such amount to be sentdirectly to the Guild.A1202 The Producer shall remit the administration fees to the Guild and to therelevant Association on or before the 15 th of the month following thepayments of the Writer’s, Story Editor’s or Story Consultant’s fees. Thefees shall be payable by cheques to the Guild and to the relevantAssociation and mailed to the Guild and Association offices.A1203 All amounts collected under Article A1201 (iii) above shall be divided asfollows: 50% shall be retained by the Guild and 50% shall be paid to therelevant Association. The Guild shall remit the respective shares of theadministration fees itemized by production to the relevant Associationwithin 30 days of the end of each calendar quarter. Upon seventy-two (72)hours notice, an authorized representative of the relevant Association may,during normal business hours, inspect the books and records of the Guildpertaining to the collection and remittance of the administration fee.A1204 Amounts paid under Article A1201 to the Guild and to the Associationsshall each be accompanied by a completed copy of the RemittanceStatement Form Provided to Producers.A1205 During the life of this Agreement, the CMPA and APFTQ may amend theamounts payable to their respective Association by their members set outin article A1201(i) and A1201 (ii).52
ARTICLE A13 – INSURANCE AND RETIREMENT PLAN, ANDDEDUCTIONS FROM WRITER’S FEESA1301 Insurance. The Producer shall contribute an amount equal to five percent(5%) of the Gross Fees of each Writer, Story Editor or Story Consultantwho is a Guild member for insurance benefits.A1302 Retirement Plan. The Producer shall contribute an amount equal to sixpercent (6%) of the Gross Fees of each Writer, Story Editor or StoryConsultant who is a Guild member for retirement benefits. As of January1, 2013, this contribution shall be increased to seven percent (7%) onScript Fees only. As of January 1, 2014, the increase to seven percent(7%) shall apply to all remaining fees under this Agreement. For clarity,the contribution on Script Fees shall remain at seven percent (7%) in 2014.A1303 Deduction from Writer’s Fees – Retirement Plan. The Producer shall deduct,for retirement purposes, from the Gross Fees earned by each Writer, StoryEditor or Story Consultant, three percent (3%) of such Gross Fees.A1304A1305Deduction from Writer’s Fees – Guild DuesThe Producer shall deduct two percent (2%) of the Gross Fees paid to anyWriter, Story Editor or Story Consultant who is a member of the Guild,and shall deduct five percent (5%) of the Gross Fees paid to any nonmemberWriter, Story Editor or person designated by the Guild as a nonmember(except persons excluded under Article A106).Non-member Equalization Payments & Deductionsa) In order to equalize the payments and deductions in respect of Guildmembers and non-members, the Producer shall contribute an amountequal to eleven percent (11%) of the Gross Fees paid to each Writer orStory Editor who is not a member of the Guild. As of January 1, 2013,this contribution shall be increased to twelve percent (12%) on ScriptFees only. As of January 1, 2014, the increase to twelve percent (12%)shall apply to all remaining fees under this Agreement. For clarity, thecontribution on Script Fees shall remain at twelve percent (12%) in2014.b) The Equalization payments and deductions made in respect of nonmembersmay be used and applied by the Guild and the agent or broker53
