1. a) In the case of a Blended Production where fifty-one percent (51%) ormore of the longest initial version of the program consists of live-actioncontent, the Writer(s) shall be contracted under the general provisions ofthe Independent Production Agreement.b) In the case of a Blended Production where fifty-one percent (51%) ormore of the longest initial version of the program consists of animationcontent, the Writer(s) shall be contracted under the Animation Section.2. Where a program does not clearly fall into 1a) or b) above, the Guild, theProducer and the relevant Association shall discuss the appropriatecontracting for the program. Where the parties above are unable to agree, thematter shall be referred to a Joint Standing Committee, or, at the request ofany of the parties, to Arbitration.152
Animation Section – Schedule 1Voluntary Recognition Agreement for Animation ProductionsPrior to contracting a Writer or Story Editor, Producers who agree to becomeparties to this Section shall sign a Voluntary Recognition Agreement as follows ontheir own letterhead and forward it to the Guild. This Voluntary RecognitionAgreement shall constitute a binding and irrevocable obligation by the Producer tothe terms and conditions of the Animation Section of the Independent ProductionAgreement:VOLUNTARY RECOGNITION AGREEMENT FOR ANIMATIONPRODUCTIONS(Bargaining Authorization And Voluntary Recognition Agreement)I, _________________________(Insert name of individual) for the Production_______________________ (title of Production) on behalf of the Producer herebyacknowledge receipt of the Animation Section of the Independent ProductionAgreement dated November 1, 2012 to December 31, 2014 covering Writers ofAnimation Productions between the Canadian Media Production Association(CMPA), the Association des Producteurs de Films et Télévision du Québec(APFTQ), and the Writers Guild of Canada (the Guild). We hereby becomesignatory to said Section and only this Section of the Agreement and state that Iam authorized to execute this Agreement on behalf of___________________________________________________________, (the“Producer”).The Producer hereby acknowledges that by executing this Voluntary RecognitionAgreement it is becoming signatory to the said Animation Section for theProduction.
