then the credited Writer(s) contracted under this Agreement shall receivethe following share <strong>of</strong> the Production Fee and Distribution Royalty:i) when the Writer has written 1 element(e.g. Story, Treatment) 25%ii) when the Writer has written 2 elements(e.g. Story and Rewrite, 2 Rewrites) 50%iii) when the Writer has written 3 elements 75%iv) when the Writer has written 4 elements 100%Should the Production Fee share based on writing credit as per ArticleA1109 exceed the above amounts the Writer shall receive the greater share<strong>of</strong> the Production Fee.<strong>Writers</strong> not contracted under this Agreement shall be paid in accordancewith their own guild agreement and/or individual contract.ARTICLE C11 – DISTRIBUTION ROYALTYC1101 The Producer shall pay to the credited Writer(s) contracted under thisAgreement (subject to Article C1010) a Distribution Royalty <strong>of</strong> three pointtwo per cent (3.2%) <strong>of</strong> the total amount <strong>of</strong> the Distributors’ Gross Revenueless one hundred (100%) <strong>of</strong> the Budget in accordance with the provisionsherein. i.e. 3.2% x (DGR – 100% <strong>of</strong> Budget)C1102 Distribution Royalty payments shall be made at least annually.C1103 Distributors’ Gross Revenue shall mean all monies derived by theProducer, the Head Distributor and/or sub-distributors, as provided below,in any manner whatsoever from the distribution <strong>of</strong> the production,including through the sale, license or other like means <strong>of</strong> distribution <strong>of</strong>the production and shall be calculated before or simultaneously with anyother gross participants from first dollar, without deductions <strong>of</strong> expenses<strong>of</strong> any kind. For greater certainty:a) Monies derived though the exploitation <strong>of</strong> ancillary, allied andunderlying rights and like rights, such as merchandising, novelizationand sequel rights, shall not be included in Distributors’ Gross Revenue.101
