B.01)Organizations engaged in the activities <strong>of</strong> maintenance <strong>of</strong> aircraft and aircraftcomponents will be approved by the <strong>Civil</strong> <strong>Aviation</strong> <strong>Authority</strong> <strong>of</strong> Nepal (CAAN). Thissection describes the administrative procedures that the <strong>of</strong>ficers <strong>of</strong> <strong>Airworthiness</strong>Inspection Division will follow while exercising their power <strong>of</strong> delegation to perform thetasks <strong>of</strong> issuance, continuation, change, suspension or revocation <strong>of</strong> aircraft maintenanceorganization approvals under applicable rules and NCAR 145. Applications for approvalaircraft maintenance organization including Nepalese organization are to be processedby the <strong>Airworthiness</strong> Inspection Division following the procedures explained in thissection.2. <strong>Civil</strong> <strong>Aviation</strong> <strong>Authority</strong> <strong>of</strong> Nepal (NCAR 145.B.10)2.1 CAAN and Power <strong>of</strong> Delegation:Director General <strong>of</strong> <strong>Civil</strong> <strong>Aviation</strong> is the Chief Executive <strong>of</strong> CAAN under <strong>Civil</strong> <strong>Aviation</strong><strong>Authority</strong> Act 1996. The Director General delegates his power to the <strong>of</strong>ficers workingunder various sections <strong>of</strong> the <strong>Authority</strong>. The <strong>Airworthiness</strong> Inspection Division has beenvested with the responsibilities <strong>of</strong> issuance, continuation, change, suspension orrevocation approval <strong>of</strong> maintenance organizations following the guidelines stipulatedhereunder. Notwithstanding the procedures described here, all applicable nationalregulations in connection with approval <strong>of</strong> organization will also be followed. Noprocedures will override or contradict with national regulations. Will there be any suchcontradiction or overriding, the matter be brought to the notice <strong>of</strong> Director General, CAANepal for necessary clarification and resolution. The power <strong>of</strong> delegation are given inAppendix-1.2.2 Organizational structure:CAAN has to establish an organizational structure in manner it could discharge variousfunctions continuously and smoothly. Therefore, the organizational structure is formedto ensure that the various tasks and obligations are not relying on individuals. Theorganization’s structure is made in such a way to ensure continuing and undisturbedfulfillment <strong>of</strong> these tasks and obligations <strong>of</strong> the CAA during illness, accident or leave <strong>of</strong>individual employees. Terms <strong>of</strong> Reference (TOR) has been issued to each <strong>of</strong>ficer toperform his function as well as standby or contingency activities <strong>of</strong> other <strong>of</strong>ficers whoare on leave.The CAA Nepal established its system to retain effective control <strong>of</strong> importantsurveillance functions and not to delegate them in any means to any authority. Theorganization structure is shown in Appendix-2.2.3 ResourcesIn order to ensure satisfactory performance <strong>of</strong> approval and associated activities, theCAAN has to ensure availability <strong>of</strong> adequate resources in terms <strong>of</strong> facilities, manpower,July 2012 Page 4

This includes resources required for approving andmonitoring <strong>of</strong> continued compliance <strong>of</strong> NCAR 145 organization.It is important to note that the <strong>Airworthiness</strong> Inspection Division will have resources andcapabilities in commensurate with the scope and nature <strong>of</strong> the organization that seeksapproval. In other words, the organization desire to maintain new generation airliners ortraining aircraft seeking approval may be dealt in an appropriate manner for which the<strong>Airworthiness</strong> Inspection Division will have adequate resources as mention below:2.3.1 Description <strong>of</strong> Facility:Facilities and <strong>of</strong>fice space equipped with adequate number <strong>of</strong> <strong>of</strong>fice equipment such ascomputers, printers, document/record storage racks and security system and so on. The<strong>of</strong>fice accommodations are environmentally controlled to provide comfortable workplace to the <strong>Airworthiness</strong> Officers.2.3.2 Manpower plan and Review:Qualified and trained personnel in commensurate with quantum <strong>of</strong> activities have to beappointed to perform the approval tasks in a systematic and competent manner. Theadequacy <strong>of</strong> personnel is assessed and quantified based on reasonable justificationconsidering the quantum <strong>of</strong> existing activities and future activities in terms <strong>of</strong> manhours.Manpower requirements are being reviewed during the month <strong>of</strong> Decemberevery year or in the situation <strong>of</strong> increased activities; or based on number <strong>of</strong> certificatesissued and to be issued; the number and size <strong>of</strong> potential <strong>Part</strong>-145 approvedmaintenance organizations within the Country and outside, as well as the level <strong>of</strong> civilaviation activity, number and complexity <strong>of</strong> aircraft.2.3.3 Systems and Procedure:<strong>Airworthiness</strong> Office Procedures are endorsed by the Director General, CAA Nepal forsystematic processing <strong>of</strong> application, auditing and approval <strong>of</strong> organization. Thisprocedure manual is a reference document that provides guidance for day-to-dayactivities <strong>of</strong> <strong>of</strong>ficers.2.3.4 <strong>Authority</strong>:Each <strong>of</strong>ficer is issued with duties and responsibilities. The powers <strong>of</strong> delegationrelevant to the approval <strong>of</strong> maintenance organization have also been issued by theDirector General, CAA Nepal.2.4 Qualification and training (NCAR 145.B.10 (3))<strong>Airworthiness</strong> <strong>of</strong>ficer who performs this function will have requisite qualification,experience, skill and competency. Personal files containing the evidence <strong>of</strong> qualification,experience, skill and competency assessment will be maintained for each <strong>of</strong>ficer. Head<strong>of</strong> the <strong>Airworthiness</strong> Inspection Division will ensure that the <strong>of</strong>ficers involved in theprocess <strong>of</strong> approving aircraft maintenance organization under NCAR 145 must have:July 2012 Page 5


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M2.4.1 practical experience and expertise in the application <strong>of</strong> aviation safety standardsand safe operating practices2.4.2 comprehensive knowledge <strong>of</strong>:a. relevant parts <strong>of</strong> implementing rules, certification specifications andguidance material;b. the CAAN’s procedures;c. the rights and obligations <strong>of</strong> a surveyor;d. maintenance quality systems;e. continuing airworthiness management.f. operational procedures when affecting the continuing airworthinessmanagement <strong>of</strong> the aircraft or the maintenance <strong>of</strong> aircraft2.4.3 training on auditing techniques.2.4.4 Five years relevant work experience to be allowed to work independently as aninspector or auditor. This may include experience gained during training to obtainthe qualification.2.4.5 a relevant engineering degree or an aircraft maintenance technician qualificationwith additional education; ‘relevant engineering degree’ means an engineeringdegree from aeronautical, mechanical, electrical, electronic, avionic or otherstudies relevant to the maintenance and continuing airworthiness <strong>of</strong>aircraft/aircraft components.2.4.6 knowledge <strong>of</strong> maintenance standards, including Fuel Tank Safety (FTS) trainingas described2.4.7 In addition to technical competency, auditing <strong>of</strong>ficers have to be trained to have ahigh degree <strong>of</strong> integrity, be impartial in carrying out their tasks, be tactful, andhave a good understanding <strong>of</strong> human nature.2.4.8 A programme for continuation training has also been developed to ensure that the<strong>of</strong>ficers and auditors remain competent to perform their allocated tasks.2.5 Approving <strong>Authority</strong> (NCAR 145.B.10 (4))The Director General, CAA Nepal is the Chief Executive <strong>of</strong> CAA Nepal for approval <strong>of</strong>Maintenance Organization. He may delegate the power under rule 87 <strong>of</strong> <strong>Civil</strong> <strong>Aviation</strong>Regulations 2002, to the subordinate <strong>of</strong>ficers to ensure that all aviation activitiesincluding the aircraft maintenance activities are performed in an orderly manner. TheCAAN has established documented procedures containing the following information:(i) The title(s) and name(s) <strong>of</strong> the Officer(s) <strong>of</strong> the CAAN and their duties andresponsibilities.(ii) Organisation chart(s) showing associated chains <strong>of</strong> responsibility <strong>of</strong> the seniorpersons.July 2012 Page 6


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M(iii) A procedure defining the qualifications for staff together with a list <strong>of</strong> staffauthorized to sign certificates.(iv) A general description <strong>of</strong> the facilities.(v) Procedures specifying how the CAAN ensure compliance with NCAR 145(vi) The CAAN has established this procedures detailing in this section as howcompliance with this Section is accomplished. The procedures are required to bereviewed once in a year in the month <strong>of</strong> December. The documentary support forimplementation the above mentioned guidelines are already covered in this section.3. Organizations located in countries outside Nepal (NCAR 145.B.15)Applications <strong>of</strong> foreign firms seeking approval under NCAR 145 are dealt in the samemanner as organizations located in Nepal. All such applications will be accompanied bythe following:(i) Letter <strong>of</strong> Intent from the Nepalese operator desirous <strong>of</strong> using the facility.(ii) Copy or any evidence <strong>of</strong> FAA/CAAN and Local <strong>Authority</strong> approval.(iii) Recent audit findings from the above mentioned authorities and internal audit report.(iv) Resolution <strong>of</strong> the audit findings.(v) Work done on similar scope in the last three years.(vi) MOE & Capability List.(vii) Fees.Upon satisfactory scrutiny, the case file will be submitted to the Head <strong>of</strong> the<strong>Airworthiness</strong> Inspection Division or higher rank. Check lists in this regard must be usedto avoid missing <strong>of</strong> essential check points <strong>of</strong> approval. Approvals <strong>of</strong> the firm may beissued only after confirming that no deficiency is pending closure. Where maintenancefacilities are located outside Nepal the investigation and continued oversight <strong>of</strong> theapproval may be carried out by a team appointed by the Director General, CAA Nepal.4. Approval procedure (NCAR 145.B.20)4.1 Initial phase approvalThe <strong>of</strong>ficers who look after the approval process will follow the following procedureswhile processing the approval request.4.1.1 Introductory Meeting:Introductory meeting with the applicants, especially with the proposed accountablemanager along with post holders will be organized to emphasis the responsibility <strong>of</strong>upholding the maintenance quality and safety. The applicant may be asked to give apresentation on preparedness to compliance the requirements stipulated in the NCARand growth plan prior to start operation. Record <strong>of</strong> discussions will also be maintainedin the organization file.July 2012 Page 7


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M4.1.2 Opening <strong>of</strong> Organization File:On receipt <strong>of</strong> application Form CAAN Form 2, a file with unique number will beopened for each organization. All correspondence related to the organization will befiled in the folder.4.1.3 Receipt <strong>of</strong> Completed ApplicationThe <strong>of</strong>ficer responsible for dealing this matter will ensure that the acceptedapplication is made in a prescribed format submitted with requisite fees andsupporting documents. The <strong>of</strong>ficer will verify whether the applicant submitted thefollowing items:(i) Duly filled application(ii) Completed Checklist internal audit covering the entire areas <strong>of</strong> operation(iii)Maintenance Organization Exposition (MOE)(iv) Declaration <strong>of</strong> Accountable Manager(v) Nomination <strong>of</strong> Post holders with CAAN Form 4(vi) FeesThe applicants will be informed in writing regarding the incomplete or deficientapplication for corrective action before proceeding with the approval process.4.2 Detailed Review <strong>of</strong> application4.2.1 Acceptance <strong>of</strong> Management Personnel (NCAR 145.B.20 (1))The partially filled CAAN Form-4 submitted for acceptance <strong>of</strong> post holders –Maintenance Manager, Quality Manager and other Management Personnel – will bereviewed based on the qualification, experience, skill and competency stipulated in theMOE. The decision on the minimum number <strong>of</strong> post holders required may be taken onthe basis <strong>of</strong> fleet-size and nature <strong>of</strong> operation. The organization has liberty to have morenumber <strong>of</strong> post holders to function effectively and efficiently. The guidelines forexamining and approving the post holders are as follows:(i) Accountable Manager: The initial presentation <strong>of</strong> Accountable Managerdemonstrating how he will monitor the functioning <strong>of</strong> maintenance quality andSafety system may be considered as means for acceptance <strong>of</strong> Accountable Person.The MOE will indicate the duties and responsibilities including criteria foracceptance. He/ She must have authority to finance aircraft maintenance.(ii) Maintenance Manager, Workshop manager and Production Manager may beappointed separately or one person can look after all activities. It is all depends onthe size <strong>of</strong> the organization.(iii) Assessment <strong>of</strong> suitability <strong>of</strong> Post holders: Post holders are to be assessed todetermine the suitability based on the Term <strong>of</strong> Reference issued to the managers ordescribed in the MOE. Technical competency in aircraft maintenance andJuly 2012 Page 8


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/Mmanagement capabilities including communication and PR skills may be assessedto accept as maintenance post holder.(iv) On satisfactory assessment <strong>of</strong> post holders suitability, if the Post Holder is foundsuitable for the position, the partially filled Form-4 will be completed by theexamining <strong>of</strong>ficer and indicate the acceptance by signing the copies.(v) In the set <strong>of</strong> three signed copies <strong>of</strong> Form-4, one copy is maintained at theorganization file <strong>of</strong> CAAN <strong>of</strong>fice, while two signed copies in the sealed envelopeare forwarded to the Accountable Manager for maintaining a copy at theorganization and to issue a copy to the individual post holders.(vi) Submission <strong>of</strong> Form-4 is not a requirement for accepting Accountable Executive.Approval <strong>of</strong> MOE in writing implies the acceptance <strong>of</strong> Accountable Manager.4.2.2 Approval <strong>of</strong> MOE (NCAR 145.B.20 (2))The <strong>of</strong>ficer who has been given the responsibility to examine the suitability <strong>of</strong>organization will scrutinize the MOE. The MOE is scrutinized focusing that it coversthe broad policy <strong>of</strong> the organization. It will serve as reference handbook containingpolicies and procedures that the organization committed to follow. The chapter-wisecontent <strong>of</strong> the MOE will be verified with suitable checklist. The approval <strong>of</strong> MOE isintimated to the organization by issuing MOE acceptance letter which also serves asletter <strong>of</strong> acceptance <strong>of</strong> the Accountable manager.4.2.3 Compliance Report:The para-wise compliance report submitted by the applicant will be reviewed to confirmthe availability <strong>of</strong> facility, management personnel, Certifying staff and Certificationsystem; it to be verified for availability <strong>of</strong> document system, record system, internaloccurrence reporting system and Quality and safety system. <strong>Airworthiness</strong> <strong>of</strong>ficers willalso verify the same during the physical inspection. The audit will cover minimumfollowing areas <strong>of</strong> major maintenance and line stations.(a) Hangar facilities (Applicable even for applicant hiring hangar)(b) Management personnel(c) Certifying Staff(d) Tools and Storage facility(e) Production Planning(f) Approved Maintenance data (Documents)(g) Certification System(h) Record System(i) Internal Occurrence Reporting System(j) MOE(k) Safety and Quality SystemJuly 2012 Page 9


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/MThe organization will also indicate the evidence <strong>of</strong> closing all the finding raised duringthe internal audit.4.2.4 Acceptance <strong>of</strong> Deficiency:No deficiency in compliance <strong>of</strong> requirements, especially on appointment <strong>of</strong> post holdersand acquiring minimum tools and equipment or maintenance data are allowed for theinitial approval. However, any deficiencies that no way hamper the operation may bepermitted for a limited period by following the procedures given in Para 11 <strong>of</strong> thisSection. Example, tools that may not be required immediately may be agreed upon forlimited period and such acceptance is granted based on written request and justificationas per the procedure given for concession and exemptions.4.3 CAA audit (NCAR 145.B.20 (3))A team <strong>of</strong> minimum two auditors will carry out audit at the maintenance facility usingdetailed checklist. The detailed checklist will cover the salient points <strong>of</strong> the requirementsstipulated in the Operating Procedures and NCARs parts.4.3.1 CAA Audit Team sizeFor a large organization, one large team audit or a short series <strong>of</strong> small teamaudits may be carried out. Small team will have minimum <strong>of</strong> two auditors.4.3.2 Accompanying <strong>of</strong> Senior OfficersThe auditors will always ensure that they are accompanied by a senior technicallyqualified member <strong>of</strong> the organization throughout the audit. Normally, the qualitymanager accompanies the audit team. The reason for being accompanied is toensure the organization is fully aware <strong>of</strong> any findings noted during the audit.4.3.3 Complete or Sample CheckIt is recommended that the audit is carried out on a product line type basis in that,for example, in the case <strong>of</strong> an organisation seeking approval for maintenance <strong>of</strong>Airbus A310, A320 and A340 ratings, the audit be concentrated on one type onlyfor a full compliance check. Depending upon the result, the second type mayonly require a sample check against those activities seen to be weak oncompliance for the first type.4.3.4 Audit de-briefingThe <strong>Airworthiness</strong> Inspection Division will de-brief the senior technical member<strong>of</strong> the organization at the end <strong>of</strong> the audit visit on all findings made during theaudit. In the event <strong>of</strong> producing any evidence for rectification or complying withany requirement during the audit, all such findings need not be included in thereport. The filled checklist must be enclosed in the organization file.July 2012 Page 10


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M4.3.5 Decision on Compliance IssuesThere may be occasions wherein auditor may find situations in the applicant'sorganization which is unsure or unclear about compliance. In this case, theorganization will be informed about possible non-compliance at the time and thefact that the situation will be reviewed within the <strong>Airworthiness</strong> InspectionDivision before a decision is made. If the decision is a finding <strong>of</strong> being incompliance then a verbal confirmation to the organization will suffice.4.3.6 Issuance <strong>of</strong> deficiency FormIn the event <strong>of</strong> finding any deficiency, a standardized deficiency Form CAANDeficiency Form may be issued. Findings are classified as level 1 or level 2based on the criticality. For confirmation <strong>of</strong> corrected findings a re-inspectionthrough spot checks will be carried out upon intimation <strong>of</strong> corrective action. Inany case, all findings are to be closed to issue an initial approval. The <strong>of</strong>ficers <strong>of</strong><strong>Airworthiness</strong> Inspection Division will record all findings, closure actions(actions required to close a finding) and recommendations.4.3.7 Issuance <strong>of</strong> Discrepancy letterFindings will be recorded on the audit report form with a provisionalcategorization as a level 1 or 2. Subsequent to the audit visit that identified theparticular findings, <strong>Airworthiness</strong> <strong>of</strong>ficers will review the provisional findinglevels, adjusting them if necessary and change the categorization accordingly.All findings will be confirmed in writing to the applicant organization within 2weeks <strong>of</strong> the audit visit. The auditing <strong>of</strong>ficers will inform the head <strong>of</strong> the <strong>of</strong>fice<strong>of</strong> the findings made during the audit, who will in turn inform the same to theQuality Manager for necessary corrective action.4.3.8 Closure Findings:The reports will include the date each finding was cleared together with referenceto the <strong>Airworthiness</strong> <strong>of</strong>fice report or letter. For initial approval all findings mustbe corrected before the approval can be issued.4.3.9 Audit Completion Report:Audit completion report in a standard format CAAN Form 6 including approvalrecommendation page are required to be submitted to the Head <strong>of</strong> the<strong>Airworthiness</strong> Inspection Division or approving authority for facilitating issue <strong>of</strong>initial approval.4.4 Recommendation <strong>of</strong> approval (NCAR 145.B.20 (5))Corrective actions for all findings must be confirmed in writing from the organization ina standard format as described in the previous paragraphs.July 2012 Page 11


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M4.4.1 Approval Recommendation:The audit completion report will be submitted through CAAN Form 6. Thecompleted CAAN Form 6 including approval recommendation page will bereviewed by the head <strong>of</strong> the <strong>of</strong>fice, approving authority or any other <strong>of</strong>ficerauthorized by the Director General, CAA Nepal. The review will take intoaccount the relevant paragraphs <strong>of</strong> NCAR 145, the categorization <strong>of</strong> findinglevels and the proper closure action taken. Completion <strong>of</strong> satisfactory review <strong>of</strong>the audit form and acceptance <strong>of</strong> organization will be indicated by the signature<strong>of</strong> the auditors and approving authority in the CAAN Form 6.4.5 Issue <strong>of</strong> approval (NCAR 145.B.25)The authorized <strong>of</strong>ficers in CAAN will formally approve the exposition and issue to theapplicant the duly filled CAAN Form 3, the approval certificate, which includes theCertificate, approval schedules or ratings and capability register. The certificate <strong>of</strong>approval will only be issued when the organization is in full compliance with NCAR 145requirements.4.5.1 Capability ListingThe approval will be based only upon the organizational capability (including anyassociated sub-contractors) relative to NCAR 145 and not limited by reference toFAA/ CAAN type certificated products. For example, if the organisation iscapable <strong>of</strong> maintaining within the limitation <strong>of</strong> NCAR 145 the Boeing 737-200series aircraft, the approval schedule will state A1 Boeing 737-200 series and notBoeing 737-2H6 which is a particular airliner designator for one <strong>of</strong> many -200series.4.5.2 Signing <strong>of</strong> Approval CertificateThe approval <strong>of</strong> the exposition will be intimated in writing. The following pageswill be signed and stamped with <strong>of</strong>fice seals:(a)(b)(c)(d)(e)(f)List <strong>of</strong> effective pages.Scope <strong>of</strong> activities (at each site if applicable).List <strong>of</strong> nominated persons (Including Accountable Manager).Facility details (at each site if applicable).Scope <strong>of</strong> Quality System.Authorization SystemOn satisfying that the organization is complying all requirement stipulated in theregulation, the CAAN may issue an organization approval Certificate ensuringthe following.(i) Signing <strong>of</strong> Approval Certificate(ii) Signing <strong>of</strong> Approval ScheduleJuly 2012 Page 12


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M(iii) Verifying and signing <strong>of</strong> Capability List(iv) Ensure that the organization file contains all necessary document forapproval evidence(v) Update the Register <strong>of</strong> Approved Organization(vi) Completion <strong>of</strong> fees deduction procedures4.5.3 Approval validity (NCAR 145.B.25 (2))The conditions <strong>of</strong> the approval will also be indicated on the CAAN Form 3approval certificate. The validity <strong>of</strong> the NCAR 145 approvals will be for a periodnot exceeding 12 months.4.5.4 Approval Number (NCAR 145.B.25 (3))The reference number will be included on the CAAN Form 3 approvalcertificate. The numeric sequence will be unique to the particular approvedmaintenance organization.4.5.5 Multi-base Operation4.5.6 FeesFor organizations having multiple locations, the approval will be issued for themain base. In such cases the airworthiness <strong>of</strong>fice may carry out the inspection atthe sub base and line stations and forward the recommendations to include thesub-base or line station in the schedule. The periodic renewal may also be carriedout by the <strong>Authority</strong> based on the receipt <strong>of</strong> recommendations <strong>of</strong> theairworthiness <strong>of</strong>fice.For grant <strong>of</strong> approvals, or changes to the approval ratings by inclusion <strong>of</strong>additional type <strong>of</strong> Aircraft (aircraft and engine combination) on the Certificate <strong>of</strong>approval, fees will be charged in accordance with <strong>Civil</strong> <strong>Aviation</strong> Regulations2002. Enhancement <strong>of</strong> the scope <strong>of</strong> maintenance <strong>of</strong> an aircraft already included inthe certificate <strong>of</strong> approval will not attract charging <strong>of</strong> additional fees. For renewal<strong>of</strong> approvals the fees will be charged in accordance with <strong>Civil</strong> <strong>Aviation</strong>Regulations 2002.5. Continuation <strong>of</strong> an approval (NCAR 145.B.30)The continuation <strong>of</strong> an approval will be monitored in accordance with the applicableinitial approval process under NCAR 145.B.20. In addition, the <strong>of</strong>fice will maintain andupdate a program listing the approved maintenance organization under its supervision,the dates when audit visits are due and when such visits were carried out. Credit may beclaimed by the <strong>of</strong>ficers for specific item audits completed during the preceding 11months period (i.e., each item <strong>of</strong> CAAN Form 6 may be deferred by 11 months from thedue date <strong>of</strong> the same item, if the previous results were satisfactory) subject to followingfour conditions:July 2012 Page 13


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M(i)(ii)the specific item audit will be the same as that required by NCAR 145 latestamendment;there will be satisfactory evidence on record that such specific item auditswere carried out and that all corrective actions have been taken;(iii) the <strong>of</strong>ficers <strong>of</strong> <strong>Airworthiness</strong> Inspection Division will be satisfied that there isno reason to believe standards have deteriorated in respect <strong>of</strong> those specificitem audits being granted a back credit; and(iv) the specific item audit being granted a back credit will be audited not laterthan 23 months after the last audit <strong>of</strong> the item.(v)The audit <strong>of</strong> the entire organization will be covered not exceeding the period<strong>of</strong> 12 months. This includes subcontractors’ facility as well.5.1 Each organization must be completely reviewed (audited) by the <strong>Airworthiness</strong>Inspection Division for compliance with NCAR 145 at periods not exceeding 12months.(i)(ii)CAAN will carry out audit at the approved facility as per the annual auditplan. Where it has been decided that a series <strong>of</strong> audit visits are necessary toarrive at a complete audit <strong>of</strong> an organisation, the program will indicate whichaspects <strong>of</strong> the approval will be covered on each visit.It is recommended that part <strong>of</strong> an audit concentrates on two ongoing aspects <strong>of</strong>the NCAR 145 approval, namely the organisations internal self monitoringquality reports produced by the quality monitoring personnel to determine ifthe organization is identifying and correcting its problems and secondly thenumber <strong>of</strong> concessions granted by the quality manager and the proceduresfollowed there under.(iii) At the successful conclusion <strong>of</strong> the audit including approval <strong>of</strong> the exposition,an audit report form will be completed by the auditing <strong>of</strong>ficer including allrecorded findings, closure actions and recommendation. A CAAN Form 6will be used for this activity.(iv) In the case <strong>of</strong> line stations a sampling program based upon number <strong>of</strong> linestations and complexity may be adopted.5.2 A meeting with the accountable manager will be convened at least once every 12months to ensure he/she remains informed <strong>of</strong> significant issues arising during auditsand to ensure he/she fully understands the significance <strong>of</strong> the approval. The minutes<strong>of</strong> the meeting will be preserved in the organization files.6. Changes (NCAR 145.B.35)6.1 <strong>Airworthiness</strong> Office will receive application from the organization <strong>of</strong> anyproposed change as listed in NCAR 145.A.85.6.2 <strong>Airworthiness</strong> Office will comply with the applicable elements <strong>of</strong> the initialprocess paragraphs for any change to the organisation.July 2012 Page 14


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M6.3 <strong>Airworthiness</strong> Office may prescribe the conditions under which organisation mayoperate during such changes unless it determines that the approval will besuspended.6.4 To have adequate control over any changes to the management personnelspecified in NCAR 145.A.30 (a) and (b) will require an amendment to theexposition.Changes to the NCAR 145 approvals include the following:Name changeAddress changeApproval scope and ratingNew base facilityThe applicable part(s) <strong>of</strong> the CAAN Form-6 will be used for the change.7. Amendment <strong>of</strong> MOE (NCAR 145.B.40)7.1 The <strong>of</strong>ficers <strong>of</strong> <strong>Airworthiness</strong> Inspection Division will verify that the proceduresspecified in the exposition are in compliance with NCAR 145 before formallynotifying the approved organization <strong>of</strong> the approval.7.2 A simple exposition status sheet will be maintained which contains information onwhen an amendment was received by <strong>Airworthiness</strong> <strong>of</strong>fice and when it wasapproved.7.3 The organization will submit each exposition amendment to the airworthiness<strong>of</strong>fice for approval. On being satisfied that the amendment meets the requirement<strong>of</strong> NCAR 145, an approval to the same will be grated in writing.8. Suspension or Limiting <strong>of</strong> approval(a)(b)In the event <strong>of</strong> organization that are not complying with the requirements <strong>of</strong> NCAR,<strong>Airworthiness</strong> <strong>of</strong>fice may issue admonition, warning, revocation, suspension andlimitation <strong>of</strong> approval (NCAR 145.B.45) as may be deemed fit. The procedure as laiddown in Rule 28 <strong>of</strong> <strong>Civil</strong> <strong>Aviation</strong> Regulation 2002 and instructions issued by DirectorGeneral, CAA Nepal from time to time will be followed in order to:suspend an approval on reasonable grounds in the case <strong>of</strong> potential safety threat; oradmonish, warn, suspend, revoke or limit the approval granted to a person ororganization iaw CAR 2002 Rule 29.9. Findings (NCAR 145.B.50)When during audits or by other means evidence is found showing non-compliance withthe requirements <strong>of</strong> NCAR- 145, the following actions will be taken:9.1 For level 1 findings, immediate action will be taken to revoke, limit or suspend inwhole or in part <strong>of</strong> approval, depending upon the extent <strong>of</strong> the level 1 finding, themaintenance organization approval, until successful corrective action has been takenJuly 2012 Page 15

The following are examples <strong>of</strong> level 1finding:Failure to gain access to the organisation during normal operating hours <strong>of</strong> theorganisation in accordance with NCAR 145.A.90 (2) after two written requests.If the calibration control <strong>of</strong> equipment as specified in NCAR 145.A.40 (b) hadpreviously broken down on a particular type product line such that most“calibrated” equipment was suspect from that time then that would be a level 1finding.Note: A complete product line is defined as all the aircraft, engine or component<strong>of</strong> a particular type.9.2 For a level 1 finding it may be necessary for <strong>of</strong>ficers <strong>of</strong> <strong>Airworthiness</strong> InspectionDivision to ensure that further maintenance and re-certification <strong>of</strong> all affected productsis accomplished, dependent upon the nature <strong>of</strong> the finding.9.3 For level 2 findings, the corrective action period granted must be appropriate to thenature <strong>of</strong> the finding, but in any case initially must not be more than three months. Incertain circumstances and subject to the nature <strong>of</strong> the finding, the three month periodmay be extended subject to a satisfactory corrective action plan agreed. In practicalterms where an <strong>of</strong>ficer <strong>of</strong> <strong>Airworthiness</strong> <strong>of</strong>fice finds a non-compliance with NCAR -145 against one product, it is deemed to be a level 2 finding. The following areexample level 2 findings:One time use <strong>of</strong> a component without any serviceable tag.The training documents <strong>of</strong> the certifying staff are not completed.9.4 Action will be taken to suspend in whole or part the approval in case <strong>of</strong> failure tocomply within the timescale granted. Where the organisation has not implemented thenecessary corrective action within that period, it may be appropriate to grant a furtherperiod <strong>of</strong> up to three months, subject to notifying the accountable manager. Inexceptional circumstances and subject to a realistic action plan being in place, theDirector General, CAA Nepal may specifically vary the maximum 6 month correctiveaction period. However, in granting such a change the past performance <strong>of</strong> theorganization will be considered.9.5 It may be necessary to ensure that further maintenance and re-certification <strong>of</strong> allaffected products is accomplished, dependent upon the nature <strong>of</strong> the finding.10. Record-keeping (NCAR 145.B.55)Records <strong>of</strong> approval <strong>of</strong> an organisation will be retained for an adequate period thatallows adequate traceability <strong>of</strong> the process to issue, continue, change, suspend or revokeeach individual organization approval.10.1 The records will include as a minimum:10.1.1 the application for an organisation approval, including the continuationthere<strong>of</strong>.July 2012 Page 16


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M10.1.2 the continued oversight program including all audit records.10.1.3 the organization approval certificate including any change thereto.Register in this regard may also be maintained.10.1.4 a copy <strong>of</strong> the audit program listing the dates when audits are due andwhen audits were carried out.10.1.5 copies <strong>of</strong> all formal correspondence including CAAN Form 4 orequivalent.10.1.6 details <strong>of</strong> any exemption and enforcement action(s).10.1.7 any other regulatory authority audit report forms.10.2 maintenance organization expositions.10.3 The minimum retention period for the above records will be four years unless it isrequired to be retained permanently.10.4 Either a paper or computer system or any combination <strong>of</strong> both may be used subject toappropriate controls.10.5 The record-keeping system will ensure that all records are accessible wheneverneeded within a reasonable time. These records will be organized in a consistent waythroughout (chronological, alphabetical order, etc.). Copies <strong>of</strong> policy letters will alsobe retained in separate folders for future reference.10.6 All records containing sensitive data regarding applicants or organizations will bestored in a secure manner with controlled access to ensure confidentiality <strong>of</strong> this kind<strong>of</strong> data.10.7 All computer hardware used to ensure data backup will be stored in a differentlocation from that containing the working data in an environment that ensures theyremain in good condition. When hardware or s<strong>of</strong>tware changes take place specialCare will be taken to ensure that all necessary data continues to be accessible at leastthrough the full period as specified above.11. Exemption and concession control (NCAR 145.B.60)At times the organization may seek exemption from the manufacturer establishedmaintenance task or concession for deviating from the CAAN approved procedures. Thisparagraph provides authority the procedures for such exemptions and concession.11.1 Exemptions proceduresMaintenance task exemptions are permitted provided the organization submitsjustification including technical substantiation from the aircraft manufacturer forsuch exemption. If the Director General, CAA Nepal is convinced that theexemption is no way affecting the safety <strong>of</strong> the aircraft or hazardous to the flight,<strong>Airworthiness</strong> Inspection Division can issue exemption. All exemptions grantedas per this section will be recorded and retained by the <strong>Airworthiness</strong> Offices.July 2012 Page 17

The same information will be kept on CAA Nepal file.3. Procedure for the issue <strong>of</strong> an aircraft maintenance licence via the NCAR-145approved maintenance organization (NCAR 66.B.105)3.1 A NCAR-145 maintenance organisation which has been authorised to carry out thisactivity by CAA Nepal may prepare the aircraft maintenance licence on behalf <strong>of</strong>CAA Nepal or make recommendations to CAA Nepal regarding the application fromJuly 2012 Page 37


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/Man individual for a aircraft maintenance licence so that CAA Nepal may prepare andissue such licence.3.2 The NCAR-145 maintenance organisation will ensure compliance with 2.1 and 2.2 inall cases, CAA Nepal will issue the aircraft maintenance licence to the applicant.4. Procedure for the amendment <strong>of</strong> an aircraft maintenance licence to include anadditional basic category or subcategory (NCAR 66.B.110)4.1 In addition to the documents required under Para 2 or Para 3, as appropriate, theapplicant for additional basic categories or subcategories to an aircraft maintenancelicence will submit his/her current original aircraft maintenance licence to CAA Nepaltogether with CAAN Form 19.4.2 At the completion <strong>of</strong> the procedure as specified in Para 2 or Para 3, CAA Nepal willendorse the additional basic category or subcategory on the aircraft maintenancelicence by stamp and signature or reissue the licence. CAA Nepal file will beamended accordingly.5. Procedure for the amendment <strong>of</strong> an aircraft maintenance licence to include anaircraft type or group (NCAR 66.B.115)On receipt <strong>of</strong> a satisfactory CAAN Form 19 and any supporting documentationdemonstrating compliance with the applicable type rating and/or group ratingrequirements and the accompanying aircraft maintenance licence, CAA Nepal willeither endorse the applicant's aircraft maintenance licence with the aircraft type orgroup or reissue the said licence to include the aircraft type or group. CAA Nepal filewill be amended accordingly.6. Procedure for the renewal <strong>of</strong> an aircraft maintenance licence validity (NCAR66.B.120)6.1 The holder <strong>of</strong> an aircraft maintenance licence will complete the relevant requirements<strong>of</strong> CAAN Form 19 and submit it with the holder's copy <strong>of</strong> the licence to CAA Nepalthat issued the original aircraft maintenance licence, unless the NCAR-145 approvedmaintenance organisation has a procedure in its exposition whereby such organizationmay submit the necessary documentation on behalf <strong>of</strong> the aircraft maintenance licenceholder.6.2 CAA Nepal will compare the holder's aircraft maintenance licence with CAA Nepalfile and verify any pending revocation, suspension or variation action pursuant toPara 13. If the documents are identical and no action is pending pursuant to Para 13,the holder's copy will be renewed for five years and the file endorsed accordingly.6.3 If CAA Nepal file is different from the aircraft maintenance licence held by the licenceholder:a. CAA Nepal will investigate the reasons for such differences and may choose notto renew the aircraft maintenance licence.July 2012 Page 38

CAA Nepal will inform both the licence holder and any known NCAR-145 orNCAR-M approved maintenance organisation affected <strong>of</strong> such fact and will, ifnecessary, take action under paragraph Para 13 to revoke, suspend or amend thelicence in question.7. Examination by CAA Nepal (NCAR 66.B.200)7.1 All examination questions will be kept in a secure manner prior to an examination, toensure that candidates will not know which particular questions will form the basis <strong>of</strong>the examination. CAA Nepal will nominate those persons who control the questionsto be used for each examination.7.2 CAA Nepal will appoint examiners who will be present during all examinations toensure the integrity <strong>of</strong> the examination.7.3 Basic examinations will follow the standard specified in Appendix I and <strong>II</strong> to thisNCAR 66.7.4 Type examinations must follow the standard specified in Appendix <strong>II</strong>I to this NCAR66.7.5 New essay questions will be raised at least every six months and used questionswithdrawn or rested from use. A record <strong>of</strong> the questions used will be retained in therecords for reference.7.6 All examination papers will be handed out at the start <strong>of</strong> the examination to thecandidate and handed back to the examiner at the end <strong>of</strong> the allotted examination timeperiod. No examination paper may be removed from the examination room during theallotted examination time period.7.7 Apart from specific documentation needed for type examinations, only the examinationpaper may be available to the candidate during the examination.7.8 Examination candidates will be separated from each other so that they cannot read eachother's examination papers. They may not speak to any person other than theexaminer.7.9 Candidates who are proven to be cheating will be banned from taking any furtherexamination within 12 months <strong>of</strong> the date <strong>of</strong> the examination in which they werefound cheating.8. General (NCAR 66.B.300)8.1 CAA Nepal may only perform the conversion specified in NCAR 66.A.70 inaccordance with a conversion report prepared pursuant to Para 9 or Para 10, asapplicable.8.2 The conversion report will be either developed by CAA Nepal or approved by CAANepal.July 2012 Page 39

Conversion report for CAAN qualifications (NCAR 66.B.305)The report will describe the scope <strong>of</strong> each type <strong>of</strong> qualification and show to whichaircraft maintenance licence it will be converted, which limitation will be added andthe NCAR-66 module/subjects on which examination is needed to ensure conversionto the aircraft maintenance licence without limitation, or to include an additional (sub)category. The report will include a copy <strong>of</strong> the existing regulation defining the licencecategories and scopes.10. Conversion report for approved maintenance organisations authorizations (NCAR66.B.310)For each approved maintenance organisation concerned, the report will describe thescope <strong>of</strong> each type <strong>of</strong> authorization and show to which aircraft maintenance licence itwill be converted, which limitation will be added and the module/subjects on whichexamination is needed to convert to the licence, or to include an additional (sub-)category. The report will include a copy <strong>of</strong> the relevant approved maintenanceorganisation's procedures for the qualification <strong>of</strong> certifying staff, on which theconversion process is based.11. General (NCAR 66.B.400)11.1 CAA Nepal may only grant examination credit on the basis <strong>of</strong> an examination creditreport prepared in accordance with NCAR 66.B.405.11.2 The examination credit report must be either developed by CAA Nepal or approved byCAA Nepal.12. Examination credit report (NCAR 66.B.400)12.1 For each technical qualification concerned the report will identify the subject matterand knowledge levels contained in Appendix I to this NCAR-66 relevant to theparticular category being compared.12.2 The report will include a statement <strong>of</strong> compliance against each subject stating where,in the technical qualification, the equivalent standard can be found. If there is noequivalent standard for the particular subject, the report will state such facts.12.3 Based upon Para 12.2 comparison, the report will indicate for each technicalqualification concerned the Appendix I subject matters subject to examinationcredits.12.4 Where the CAAN qualification standard is changed, the report will be amended asnecessary.July 2012 Page 40

CAAN – General (AMC M.B.102 (a))1.1 In deciding upon the required airworthiness organisational structure, the CAAN willreview the number <strong>of</strong> certificates to be issued, the number and size <strong>of</strong> potentialoperators, the number <strong>of</strong> M.A. Subpart F approved maintenance organisations and M.A.Subpart G continuing airworthiness management organisations within Nepal.1.2 The CAAN will retain effective control <strong>of</strong> important inspection functions and notdelegate them in such a way that aircraft owners, operators, M.A. Subpart F approvedmaintenance organisations and M.A. Subpart G continuing airworthiness managementorganisations, in effect, regulate themselves in airworthiness matters.1.3 The set-up <strong>of</strong> the organisational structure will ensure that the various tasks andobligations <strong>of</strong> the CAAN are not relying on individuals. That means that a continuingand undisturbed fulfillment <strong>of</strong> these tasks and obligations <strong>of</strong> the CAAN will also beguaranteed in case <strong>of</strong> illness, accident or leave <strong>of</strong> individual employees.2. CAAN – Qualification and training (AMC M.B.102 (c))2.1 CAAN inspectors will have:2.1.1 practical experience and expertise in the application <strong>of</strong> aviation safety standards andsafe operating practices;2.1.2 comprehensive knowledge <strong>of</strong>:(a) relevant parts <strong>of</strong> implementing rules, certification specifications and guidancematerial;(b) the CAAN’s procedures;(c) the rights and obligations <strong>of</strong> an inspector;(d) quality systems;(e) continuing airworthiness management.2.1.3 training on auditing techniques.2.1.4 five years relevant work experience to be allowed to work as an inspectorindependently.This may include experience gained during training to obtain the Para 2.1.5qualification.2.1.5 a relevant engineering degree or an aircraft maintenance technician qualificationwith additional education. 'Relevant engineering degree’ means an engineeringdegree from aeronautical, mechanical, electrical, electronic, avionic or otherstudies relevant to the maintenance and continuing airworthiness <strong>of</strong> aircraft/aircraft components.July 2012 Page 60


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M2.1.6 knowledge <strong>of</strong> a relevant sample <strong>of</strong> the type(s) <strong>of</strong> aircraft gained through aformalized training course including Fuel Tank Safety (FTS) training as describedin Appendix X<strong>II</strong> to AMC to M.A.706 (f) and Para 2. These courses will be at leastat a level equivalent to <strong>Part</strong>-66 Appendix <strong>II</strong>I Level 1 General Familiarisation.“Relevant sample” means that these courses will cover typical systems embodied inthose aircraft being within the scope <strong>of</strong> approval.2.1.7 knowledge <strong>of</strong> maintenance standards.2.2 In addition to technical competency, inspectors will have a high degree <strong>of</strong> integrity, beimpartial in carrying out their tasks, be tactful, and have a good understanding <strong>of</strong> humannature.2.3 A programme for continuation training will be developed which provides for theinspectors, at regular intervals, to visit appropriate manufacturers and attend technicalsymposia as well as training or refresher courses to gain first-hand knowledge <strong>of</strong> newdevelopments. As a general policy, it is not desirable for the inspectors to obtaintechnical qualifications from those entities under their direct regulatory jurisdiction.3. CAAN organisation – Procedures (AMC M.B.102 (d))The documented procedures will contain the following information:(a) The CAAN’s designation.(b) The title(s) and name(s) <strong>of</strong> the manager(s) <strong>of</strong> the CAAN and their duties andresponsibilities.(c) Organisation chart(s) showing associated chains <strong>of</strong> responsibility <strong>of</strong> the seniorpersons.(d) A procedure defining the qualifications for staff together with a list <strong>of</strong> staffauthorised to sign certificates.(e) A general description <strong>of</strong> the facilities.(f) Procedures specifying how the CAAN ensure(s) compliance with <strong>Part</strong>-M.4. Acceptable means <strong>of</strong> compliance (NCAR M.B.103)CAAN will develop acceptable means <strong>of</strong> compliance CAAN may use to establishcompliance with this <strong>Part</strong>. When the acceptable means <strong>of</strong> compliance are complied with,the related requirements <strong>of</strong> this <strong>Part</strong> will be considered as met.5. Record-keeping (NCAR M.B.104)5.1 CAAN will establish a system <strong>of</strong> record-keeping that allows adequate traceability <strong>of</strong>the process to issue, continue, change, suspend or revoke each certificate.July 2012 Page 61


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M5.2 The records for the oversight <strong>of</strong> <strong>Part</strong>-M approved organisations will include as aminimum:(a) the application for an organisation approval.(b) the organisation approval certificate including any changes.(c) a copy <strong>of</strong> the audit program listing the dates when audits are due and when auditswere carried out.(d) the CAAN continued oversight records including all audit records.(e) copies <strong>of</strong> all relevant correspondence.(f) details <strong>of</strong> any exemption and enforcement actions.(g) organisation exposition or manual and amendments.(h) copy <strong>of</strong> any other document directly approved by the CAAN.5.3 The retention period for the Para 5.2 records will be at least four years.5.4 The minimum records for the oversight <strong>of</strong> each aircraft will include, at least, a copy<strong>of</strong>:(a) aircraft certificate <strong>of</strong> airworthiness,(b) airworthiness review certificates,(c) Section A Subpart G organisation recommendations,(d) reports from the airworthiness reviews carried out directly by CAAN,(e) all relevant correspondence relating to the aircraft,(f) details <strong>of</strong> any exemption and enforcement action(s),5.5 The records specified in Para 5.4 will be retained until two years after the aircrafthas been permanently withdrawn from service.6. Record-keeping (AMC M.B.104 (a))6.1 The record-keeping system will ensure that all records are accessible wheneverneeded within a reasonable time. These records will be organized in a consistentway throughout the CAAN (chronological, alphabetical order, etc.).6.2 All records containing sensitive data regarding applicants or organisations will bestored in a secure manner with controlled access to ensure confidentiality <strong>of</strong> thiskind <strong>of</strong> data.July 2012 Page 62

When hardware- or s<strong>of</strong>tware-changes take place specialcare will be taken that all necessary data continues to be accessible at least throughthe full period specified in Para 5.3 and/or Para 5.57. Record-keeping (AMC M.B.104 (f))The cases, when records will be made available will be limited to:- incidents or accidents,- findings through the aircraft continuing monitoring program where organisationsapproved by another CAAN are involved, to determine the root cause,8. Responsibilities (NCAR M.B.201)The CAAN as specified in AMC M.1 are responsible for conducting inspections andinvestigations in order to verify that the requirements <strong>of</strong> this <strong>Part</strong> are complied with.9. Maintenance programme (NCAR M.B.301)9.1 The CAAN will verify that the maintenance programme is in compliance withM.A.302.9.2 Except where stated otherwise in point M.A.302(c) the maintenance programme andits amendments will be approved directly by the CAAN.9.3 In the case <strong>of</strong> indirect approval, the maintenance programme procedure will beapproved by the CAAN through the continuing airworthiness managementexposition.9.4 In order to approve a maintenance programme according to Para 9.2, the CAAN willhave access to all the data required in points NCAR M.A. 302(d), (e) and (f).Para 9.1, Maintenance programme, For the CAAN to verify compliance with NCARM.A.302, the auditing surveyor/inspector will have received training on maintenanceprogramme development and control.10. Maintenance Programme (AMC M.B.301 (b))10.1 When assessing aircraft maintenance programmes for approval, the CAAN willverify that the maintenance programme is acceptable for the continuedairworthiness <strong>of</strong> the specific aircraft listed and it is appropriate for the proposedoperating environment and scheduled utilisation.10.2 The CAAN will assess the contents taking into account the origins <strong>of</strong> the documenti.e. the manufacturers recommended maintenance programme, a MRB report, theoperators own experience or another approved programme.July 2012 Page 63


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M10.3 A CAAN may elect to publish a proposed maintenance schedule for a pistonengined aircraft type or a group <strong>of</strong> piston engined aircraft types below 2730 Kgsmaximum take <strong>of</strong>f mass (MTOM) or for a sailplane, powered sailplane or balloontype or for a group <strong>of</strong> sailplanes, powered sailplanes or balloon types. Whenowners/operators <strong>of</strong> the aircraft mentioned above elect to use a CAAN proposedmaintenance schedule, all the out <strong>of</strong> phase manufacturer recommendations will beincorporated into the final maintenance programme in order for it to be approved.10.4 A copy <strong>of</strong> the approved programme will be retained by the CAAN, unless theprogramme is approved by a M.A. Subpart G approved organisation.10.5 The documentation issued by the CAAN to approve the operator’s maintenanceprogramme may include details <strong>of</strong> who may issue certificates <strong>of</strong> release to servicein a particular situation and may define which tasks are considered as complexmaintenance tasks or limited pilot owner maintenance according to Appendix V<strong>II</strong>Ito NCAR <strong>Part</strong> M.10.6 In the case <strong>of</strong> commercial air transport or large aircraft, development <strong>of</strong> theapproved operator’s maintenance programme is dependent upon sufficientsatisfactory in-service experience which has been properly processed. In general,the task being considered for escalation beyond the MRB limits will have beensatisfactorily repeated at the existing frequency several times before beingproposed for escalation. Appendix I to AMC M.A.302 and Para 10 gives furtherinformation.10.7 The CAAN may approve an incomplete maintenance programme at the start <strong>of</strong>operation <strong>of</strong> an aircraft or an operator, subject to limiting the approval <strong>of</strong> themaintenance programme to a period that does not exceed any requiredmaintenance not yet approved.10.8 If the CAAN is no longer satisfied that a safe operation can be maintained, theapproval <strong>of</strong> a maintenance programme or part <strong>of</strong> it may be suspended or revoked.Events giving rise to such action include:(a) An operator changing the utilisation <strong>of</strong> an aircraft;(b) The owner or M.A. Subpart G approved organisation has failed to ensure that theprogramme reflects the maintenance needs <strong>of</strong> the aircraft such that safe operationcan be assured.11. Maintenance Programme (AMC M.B.301 (c))11.1 Approval <strong>of</strong> an aircraft maintenance programme through a procedure establishedby a M.A. Subpart G organisation will require the organisation to demonstrate tothe CAAN that it has competence, procedures and record keeping provisions,which will enable the organisation to analyse aircraft reliability, TC holder’sinstructions, and other related operating and maintenance criteria.11.2 According to the complexity <strong>of</strong> the aircraft and the nature <strong>of</strong> the operation, themaintenance programme procedures will contain reliability centred maintenanceJuly 2012 Page 64


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/Mand condition monitored maintenance programme procedures and have proceduresrelating to the programme control which contain the following provisions:(a) task escalation or adjustment,(b) maintenance programme review,(c) SB or Service Information assessment,(d) component and structures in service performance review,(e) maintenance programme revision,(f) maintenance procedure effectiveness review and amendment,(g) maintenance review board report (MRBR) or manufacturer maintenance planningdocument (MPD) review and assessment, as appropriate,(h) AD review and assessment,(i) owner/maintenance/M.A. Subpart G organisation liaison,(j) training.11.3 When the CAAN requests, the organisation will make provision for the attendancea CAAN representative at meetings held to consider maintenance implicationsarising from reviews <strong>of</strong> the above provisions.12. Maintenance programme (AMC M.B.301 (d))Programmes and all associated airworthiness data, including that data used forsubstantiating the escalation <strong>of</strong> programmes will be made available to the CAAN uponrequest.13. Exemptions (NCAR M.B.302)All exemptions granted in accordance with Article 14(4) <strong>of</strong> the basic Regulation will berecorded and retained by the CAAN.14. Aircraft continuing airworthiness monitoring (NCAR M.B.303)14.1 The CAAN will develop a survey programme to monitor the airworthiness status<strong>of</strong> the fleet <strong>of</strong> aircraft on its register.14.2 The survey programme will include sample product surveys <strong>of</strong> aircraft.14.3 The programme will be developed taking into account the number <strong>of</strong> aircraft onthe register, local knowledge and past surveillance activities.July 2012 Page 65

Furthermore, the CAAN will analyse each finding todetermine its root cause.14.5 All findings will be confirmed in writing to the person or organisation accountableaccording to NCAR M.A.201.14.6 The CAAN will record all findings, closure actions and recommendations.14.7 If during aircraft surveys evidence is found showing non-compliance to a NCAR-M requirement, the CAAN will take actions in accordance with Para 63.14.8 If the root cause <strong>of</strong> the finding identifies non-compliance with any Subpart or withanother <strong>Part</strong>, the non-compliance will be dealt with as prescribed by the relevant<strong>Part</strong>.14.9 In order to facilitate appropriate enforcement action, CAAN will exchangeinformation on non-compliances identified in accordance with Para 14.8.15. Aircraft continuing airworthiness monitoring (AMC M.B.303)The CAAN may create an adapted airworthiness survey programme for the aircraft forwhich it performs the airworthiness review.16. Aircraft continuing airworthiness monitoring (*) (AMC M.B.303 (b))16.1 Sample product surveys <strong>of</strong> aircraft include:(a) in depth surveys carried out during extensive maintenance that fully encompassselected aspects <strong>of</strong> an aircraft’s airworthiness.(b) ramp surveys carried out during aircraft operations to monitor the apparentcondition <strong>of</strong> an aircraft’s airworthiness.(c) in-flight surveys, as deemed necessary by the CAAN.16.2 The CAAN will undertake regular sample product surveys <strong>of</strong> aircraft on itsregister to verify that:(a) the condition <strong>of</strong> an aircraft as sampled is to a standard acceptable for theCertificate <strong>of</strong> <strong>Airworthiness</strong> to remain in force,(b) the operator/Owner’s management <strong>of</strong> the airworthiness <strong>of</strong> their aircraft iseffective,(c) satisfactory levels <strong>of</strong> continued airworthiness are being achieved,(d) the approval and licenses granted to organisations and persons continue to beapplied in a consistent manner to achieve the required standards.July 2012 Page 66

Aircraft continuing airworthiness monitoring (AMC M.B.303 (c))CAAN will create an annual programme <strong>of</strong> surveys, selecting aircraft and/or operatorsdepending on local knowledge <strong>of</strong> the maintenance environment, operating conditions,airworthiness standards and past surveillance experience. The programme will be used toidentify the operator/fleet/aircraft, which are causing the greatest concern.18. Aircraft continuing airworthiness monitoring (AMC M.B.303 (d))18.1 Appendix <strong>II</strong>I to this AMC is an example format for an annual in depth surveyprogramme. A sample <strong>of</strong> the 14 key risk airworthiness elements identified onthe example will be assessed during each survey and the survey will include theaircraft as the product sample. The survey will be a ‘deep cut’ through theelements or systems selected and all findings will be recorded.Surveyors/inspectors in conjunction with the owners, operators and maintenanceorganisations will identify the root cause <strong>of</strong> each confirmed finding.18.2 In addition, an annual ramp survey programme will be developed based ongeographical locations, taking into account airfield activity, and focusing on keyissues that can be surveyed in the time available without unnecessarily delayingthe aircraft.18.3 Surveyors/inspectors will be satisfied that the root cause found and the correctiveactions taken are adequate to correct the deficiency and to prevent reoccurrence.18.4 Where the aircraft continuing airworthiness monitoring survey visit can be linkedto the oversight <strong>of</strong> an approved organisation then credit can be taken in themonitoring process <strong>of</strong> that approved organisation.19. Revocation, suspension and limitation (NCAR M.B.304)The CAAN will:(a) suspend an airworthiness review certificate on reasonable grounds in the case <strong>of</strong>potential safety threat, or;(b) suspend, revoke or limit an airworthiness review certificate pursuant to NCARM.B.303(g) (14.7)20. Initial Approval (NCAR M.B.602)20.1 Provided the requirements <strong>of</strong> NCAR M.A. 606 (a) and (b) are complied with,the CAAN will formally indicate its acceptance <strong>of</strong> the NCAR M.A. 606 (a) and(b) personnel to the applicant in writing.20.2 The CAAN will establish that the procedures specified in the maintenanceorganisation manual comply with M.A Subpart F and ensure the accountablemanager signs the commitment statement.July 2012 Page 67


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M20.3 The CAAN will verify that the organisation is in compliance with the <strong>Part</strong>-M.ASubpart F requirements.20.4 A meeting with the accountable manager will be convened at least once duringthe investigation for approval to ensure that he/she fully understands thesignificance <strong>of</strong> the approval and the reason for signing the commitment <strong>of</strong> theorganisation to compliance with the procedures specified in the manual.20.5 All findings will be confirmed in writing to the applicant organisation.20.6 The CAAN will record all findings, closure actions (actions required to close afinding) and recommendations.20.7 For initial approval all findings will be corrected by the organisation and closedby the CAAN before the approval can be issued.21. Initial approval (AMC M.B.602 (a))21.1 ‘Formally indicate in writing’ means that a CAAN Form 4 (Appendix X) willbe used for this activity. With the exception <strong>of</strong> the accountable manager, aCAAN Form 4 will be completed for each person nominated to hold a positionrequired by NCAR M.A.606 (b).21.2 In the case <strong>of</strong> the accountable manager approval <strong>of</strong> the maintenance organisationmanual containing the accountable manager’s signed commitment statementconstitutes formal acceptance.22. Initial approval (AMC M.B.602 (b))The CAAN will indicate approval <strong>of</strong> the maintenance organisation manual in writing.23. Initial approval (AMC M.B.602 (c))23.1 The CAAN will determine by whom, and how the audit will be conducted. Forexample, it will be necessary to determine whether one large team audit or ashort series <strong>of</strong> small team audits or a long series <strong>of</strong> single man audits are mostappropriate for the particular situation.23.2 The audit may be carried out on a product line type basis. For example, in thecase <strong>of</strong> an organisation with Socata TB20 and Piper PA 28 ratings, the audit isconcentrated on one type only for a full compliance check. Dependent upon theresult, the second type may only require a sample check that will at least coverthe activities identified as weak for the first type.23.3 The CAAN auditing surveyor will always ensure that he/she is accompaniedthroughout the audit by a senior technical member <strong>of</strong> the organisation.The reason for being accompanied is to ensure the organisation is fully aware <strong>of</strong> anyfindings during the audit.July 2012 Page 68


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M23.4 The auditing surveyor will inform the senior technical member <strong>of</strong> theorganisation at the end <strong>of</strong> the audit visit on all findings made during the audit.24. Initial approval (AMC M.B.602 (e))24.1 Findings will be recorded on an audit report form with a provisionalcategorization as a level 1 or 2. Subsequent to the audit visit that identified theparticular findings, the CAAN will review the provisional finding levels,adjusting them if necessary and change the categorisation from ‘provisional’ to‘confirmed’.24.2 All findings will be confirmed in writing to the applicant organisation within 2weeks <strong>of</strong> the audit visit.24.3 There may be occasions when the CAAN finds situations in the applicant’sorganisation on which it is unsure about compliance. In this case, theorganisation will be informed about possible non-compliance at the time andthe fact that the situation will be reviewed within the CAAN before a decisionis made. If the review concludes that there is no finding then a verbalconfirmation to the organisation will suffice.25. Initial approval (*) (AMC M.B.602 (f))25.1 The audit report will be made on a CAAN Form 6F (see appendix VI).25.2 A quality review <strong>of</strong> the CAAN Form 6F audit report will be carried out by acompetent independent person nominated by the CAAN. The review will takeinto account the relevant paragraphs <strong>of</strong> M.A. Subpart F, the categorization <strong>of</strong>finding levels and the closure action taken. Satisfactory review <strong>of</strong> the audit formwill be indicated by a signature on the CAAN Form 6F.26. Initial approval (AMC M.B.602 (g))The audit reports will include the date each finding was cleared together with referenceto the CAAN report or letter that confirmed the clearance.27. Issue <strong>of</strong> approval (NCAR M.B.603)27.1 The CAAN will issue to the applicant a CAAN Form 3 approval certificate(Appendix V) which includes the extent <strong>of</strong> approval, when the maintenanceorganisation is in compliance with the applicable paragraphs <strong>of</strong> this <strong>Part</strong>.27.2 The CAAN will indicate the conditions attached to the approval on the CAANForm 3 approval certificate.27.3 The reference number will be included on the CAAN Form 3.July 2012 Page 69


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M28. Issue <strong>of</strong> approval (AMC M.B.603 (a))1. CAA Nepal will issue the approval for maintenance organizations. CAA Nepal will carryout the initial and subsequent audits in this regard.The approval will be based upon the organisational capability relative to M.A. Subpart Fcompliance and not limited by reference to individual CAAN certificated products.For example, if the organisation is capable <strong>of</strong> maintaining within the limitation <strong>of</strong> M.A.Subpart F the Cessna 100 series aircraft the approval schedule will state A2 Cessna 100 seriesand not Cessna 172 RG which is a particular designator for one <strong>of</strong> many Cessna 100 series.29. Issue <strong>of</strong> approval (AMC M.B.603 (c))The numeric sequence <strong>of</strong> the approval reference will be unique to the particularapproved maintenance organisation.30. Continuing oversight (NCAR M.B.604)30.1 The CAAN will keep and update a program listing for each M.A Subpart Fapproved maintenance organisations under its supervision, the dates when auditvisits are due and when such visits were carried out.30.2 Each organisation will be completely audited at periods not exceeding 24months.30.3 All findings will be confirmed in writing to the applicant organisation.30.4 The CAAN will record all findings, closure actions (actions required to close afinding) and recommendations.30.5 A meeting with the accountable manager will be convened at least once every 24months to ensure he/she remains informed <strong>of</strong> significant issues arising duringaudits31. Continuing oversight (AMC M.B.604 (b))31.1 Where the CAAN has decided that a series <strong>of</strong> audit visits are necessary to arriveat a complete audit <strong>of</strong> an approved maintenance organisation, the program willindicate which aspects <strong>of</strong> the approval will be covered on each visit.31.2 It is recommended that part <strong>of</strong> an audit concentrates on the organisations internalself monitoring reports produced by the organisational review to determine if theorganisation is identifying and correcting its problems.31.3 At the successful conclusion <strong>of</strong> the audit(s) including verification <strong>of</strong> the manual,an audit report form will be completed by the auditing surveyor including allrecorded findings, closure actions and recommendation. A CAAN Form 6F willbe used for this activity.July 2012 Page 70


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M31.4 Credit may be claimed by the CAAN surveyor(s) for specific item auditscompleted during the preceding 23-month period subject to four conditions:(a) the specific item audit will be the same as that required by M.A. Subpart F latestamendment, and(b) there will be satisfactory evidence on record that such specific item audits werecarried out and that all corrective actions have been taken, and(c) the CAAN surveyor(s) will be satisfied that there is no reason to believe standardshave deteriorated in respect <strong>of</strong> those specific item audits being granted a back credit;(d) the specific item audit being granted a back credit will be audited not later than 24months after the last audit <strong>of</strong> the item.31.5 When performing the oversight <strong>of</strong> organisations that hold both M.A. Subpart Fand M.A. Subpart G approvals, the CAAN will arrange the audits to cover bothapprovals avoiding duplicated visit <strong>of</strong> a particular area.32. Findings (NCAR M.B.605)32.1 When during audits or by other means evidence is found showing noncomplianceto the <strong>Part</strong>-M requirement, the CAAN will take the followingactions:(a) For level 1 findings, immediate action will be taken by the CAAN to revoke,limit or suspend in whole or in part, depending upon the extent <strong>of</strong> the level 1finding, the maintenance organisation approval, until successful correctiveaction has been taken by the organisation.(b) For level 2 findings, the CAAN will grant a corrective action periodappropriate to the nature <strong>of</strong> the finding that will not be more than threemonths. In certain circumstances, at the end <strong>of</strong> this first period and subject tothe nature <strong>of</strong> the finding, the CAAN can extend the three month periodsubject to a satisfactory corrective action plan.32.2 Action will be taken by the CAAN to suspend in whole or part the approval incase <strong>of</strong> failure to comply within the timescale granted by the CAAN.33. Findings (AMC M.B.605 (a)(1))For a level 1 finding it may be necessary for the CAAN to ensure that furthermaintenance and re-certification <strong>of</strong> all affected products is accomplished, dependentupon the nature <strong>of</strong> the finding.34. Changes M.B.60634.1 The CAAN will comply with the applicable elements <strong>of</strong> the initial approval forany change to the organisation notified in accordance with point M.A.617.July 2012 Page 71


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M34.2 The CAAN may prescribe the conditions under which the approved maintenanceorganisation may operate during such changes, unless it determines that theapproval will be suspended due to the nature or the extent <strong>of</strong> the changes.34.3 For any change to the maintenance organisation manual:(a) In the case <strong>of</strong> direct approval <strong>of</strong> changes in accordance with point M.A. 604(b),the CAAN will verify that the procedures specified in the manual are incompliance with this Annex (<strong>Part</strong>-M) before formally notifying the approvedorganisation <strong>of</strong> the approval.(b) In the case an indirect approval procedure is used for the approval <strong>of</strong> the changesin accordance with point M.A.604(c), the CAAN will ensure(i) that the changes remain minor and(ii) that it has an adequate control over the approval <strong>of</strong> the changes to ensure theyremain in compliance with the requirements <strong>of</strong> this Annex (<strong>Part</strong>-M).35. Changes (AMC M.B.606)35.1 Changes in nominated personsThe CAAN will have adequate control over any changes to personnel specifiedin M.A.606 (a) and (b). Such changes will require an amendment to the manual.35.2 It is recommended that a simple manual status sheet is maintained whichcontains information on when an amendment was received by the CAAN andwhen it was approved.35.3 The CAAN will define the minor amendments to the manual which may beincorporated through indirect approval. In this case a procedure will be stated inthe amendment section <strong>of</strong> the maintenance organisation manual.Changes notified in accordance with M.A.617 are not considered minor.For all cases other than minor, the applicable part(s) <strong>of</strong> the CAAN Form 6F willbe used for the change.35.4 The approved maintenance organisation will submit each manual amendment tothe CAAN whether it be an amendment for CAAN approval or an indirectlyapproved amendment. Where the amendment requires CAAN approval, theCAAN when satisfied, will indicate its approval in writing. Where theamendment has been submitted under the indirect approval procedure theCAAN will acknowledge receipt in writing.July 2012 Page 72

Revocation, suspension and limitation <strong>of</strong> an approval (NCAR M.B.607)The CAAN will:(a) suspend an approval on reasonable grounds in the case <strong>of</strong> potential safety threat,or;(b) suspend, revoke or limit an approval pursuant to NCAR M.B.605 (Para 32).37. Application (NCAR M.B.701)37.1 For commercial air transport the CAAN will receive for approval with the initialapplication for the air operator’s certificate and where applicable any variationapplied for and for each aircraft type to be operated:(a) the continuing airworthiness management exposition;(b) the operator’s aircraft maintenance programmes;(c) the aircraft technical log;(d) where appropriate the technical specification <strong>of</strong> the maintenance contractsbetween the operator and <strong>Part</strong>-145 approved maintenance organisation.37.2 The investigation and continuous oversight <strong>of</strong> the facility will be carried out byDirector General, CAA Nepal.38. Application (AMC M.B.701 (a))38.1 The CAAN will not expect the documents listed in NCAR M.B.701 (a) to besubmitted in a completed state with the initial application for grant or changesince each may require approval in its own right and may be subject toamendment as a result <strong>of</strong> CAAN assessment during the technical investigations.Draft documents will be submitted at the earliest opportunity so thatinvestigation <strong>of</strong> the application can begin. Grant or change cannot be achieveduntil the CAAN is in possession <strong>of</strong> completed documents.38.2 This information is required to enable the CAAN to conduct its investigation, toassess the volume <strong>of</strong> maintenance work necessary and the locations at which itwill be accomplished.38.3 The applicant will inform the CAAN where base and scheduled line maintenanceis to take place and give details <strong>of</strong> any contracted maintenance which is inaddition to that provided in response to M.A.201 (h) 2 or M.A.708 (c).38.4 At the time <strong>of</strong> application, the operator will have arrangements for all base andscheduled line maintenance in place for an appropriate period <strong>of</strong> time, asJuly 2012 Page 73

The operator will establish further arrangements in duecourse before the maintenance is due.Base maintenance contracts for high-life time checks may be based on one timecontracts, when the CAAN considers that this is compatible with the operator’sfleet size.39. Initial approval M.B.70239.1 Provided the requirements <strong>of</strong> NCAR M.A.706(a), (c), (d) and NCAR M.A.707are complied with, the CAAN will formally indicate its acceptance <strong>of</strong> theM.A.706(a), (c), (d) and M.A.707 personnel to the applicant in writing.39.2 The CAAN will establish that the procedures specified in the continuingairworthiness management exposition comply with <strong>Part</strong>-M.A. Subpart G andensure the accountable manager signs the commitment statement.39.3 The CAAN will verify the organisation’s compliance with M.A. Subpart Grequirements.39.4 A meeting with the accountable manager will be convened at least once duringthe investigation for approval to ensure that he/she fully understands thesignificance <strong>of</strong> the approval and the reason for signing the expositioncommitment <strong>of</strong> the organisation to compliance with the procedures specified inthe continuing airworthiness management exposition.39.5 All findings will be confirmed in writing to the applicant organisation.39.6 The CAAN will record all findings, closure actions (actions required to close afinding) and recommendations.39.7 For initial approval all findings will be corrected by the organisation and closedby the CAAN before the approval can be issued.40. Initial approval (AMC M.B.702 (a))40.1 ‘Formally indicate in writing’ means that a CAAN Form 4 will be used for thisactivity. With the exception <strong>of</strong> the accountable manager, a CAAN Form 4 willbe completed for each person nominated to hold a position required by NCARM.A.706 (c) (d) and NCAR M.A.707.40.2 In the case <strong>of</strong> the accountable manager, approval <strong>of</strong> the continuing airworthinessmanagement exposition containing the accountable manager’s signedcommitment statement constitutes formal acceptance, once the authority hasheld a meeting with the accountable manager and is satisfied with its results.41. Initial approval (AMC M.B.702 (b))41.1 The CAAN will indicate approval <strong>of</strong> the continuing airworthiness managementexposition in writing.July 2012 Page 74


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M41.2 Contracts for sub-contracting continuing airworthiness management tasks bycontinuing airworthiness management organisations will be included in thecontinuing airworthiness management exposition. The CAAN will verify thatthe standards set forth in AMC M.A. 201(h) 1 are being met when approvingthe exposition.41.3 The CAAN while investigating the acceptability <strong>of</strong> the proposed subcontractedcontinuing airworthiness management tasks arrangements will take into account,in the subcontracted organisation, all other such contracts that are in placeirrespective <strong>of</strong> state <strong>of</strong> registry in terms <strong>of</strong> sufficiency <strong>of</strong> resources, expertise,management structure, facilities and liaison between the contracting continuingairworthiness management organisation, the subcontracted organisation andwhere applicable contracted <strong>Part</strong>-145 maintenance organisation(s).42. Initial approval (AMC M.B.702 (c))42.1 The CAAN will determine by whom, and how the audit will be conducted. Forexample, it will be necessary to determine whether one large team audit or ashort series <strong>of</strong> small team audits or a long series <strong>of</strong> single man audits are mostappropriate for the particular situation.42.2 The audit may be carried out on a product line type basis. For example, in thecase <strong>of</strong> an organisation with Airbus A320 and Airbus A310 ratings, the audit isconcentrated on one type only for a full compliance check. Dependent upon theresult, the second type may only require a sample check that will at least coverthe activities identified as weak for the first type.42.3 When determining the scope <strong>of</strong> the audit and which activities <strong>of</strong> the organisationwill be assessed during the audit, the privileges <strong>of</strong> the approved organisationwill be taken into account, e.g. approval to carry out airworthiness reviews.42.4 The CAAN auditing surveyor will always ensure that he/she is accompaniedthroughout the audit by a senior technical member <strong>of</strong> the organisation.Normally this is the quality manager. The reason for being accompanied is toensure the organisation is fully aware <strong>of</strong> any findings during the audit.42.5 The auditing surveyor will inform the senior technical member <strong>of</strong> theorganisation at the end <strong>of</strong> the audit visit on all findings made during the audit.43. Initial approval (AMC M.B.702 (e))43.1 Findings will be recorded on an audit report form with a provisionalcategorization as a level 1 or 2. Subsequent to the audit visit that identified theparticular findings, the CAAN will review the provisional finding levels,adjusting them if necessary and change the categorisation from ‘provisional’ to‘confirmed’.July 2012 Page 75

Initial approval (*) (AMC M.B.702 (f))44.1 The audit report form will be the CAAN Form 13 (Appendix V<strong>II</strong>).44.2 A quality review <strong>of</strong> the CAAN Form 13 audit report will be carried out by acompetent independent person nominated by the CAAN. The review will takeinto account the relevant paragraphs <strong>of</strong> M.A. Subpart G, the categorisation <strong>of</strong>finding levels and the closure action taken. Satisfactory review <strong>of</strong> the audit formwill be indicated by a signature on the CAAN Form 13.45. Initial approval (AMC M.B.702 (g))The audit reports will include the date each finding was cleared together with referenceto the CAAN report or letter that confirmed the clearance.46. Issue <strong>of</strong> approval (NCAR M.B.703)46.1 The CAAN will issue to the applicant a CAAN Form 14 approval certificate(Appendix VI) which includes the extent <strong>of</strong> approval, when the continuingairworthiness management organisation is in compliance with M.A. Subpart G.46.2 The CAAN will indicate the validity <strong>of</strong> the approval on the CAAN Form 14approval certificate.46.3 The reference number will be included on the CAAN Form 14 approvalcertificate.46.4 In the case <strong>of</strong> commercial air transport, the information contained on a CAANForm 14 will be included on the air operator’s certificate47. Issue <strong>of</strong> approval (AMC M.B.703)The table shown for the Approval Schedule in CAAN Form 14 includes a fielddesignated as “Aircraft type/series/group”.The intention is to give maximum flexibility to the CAAN to customise the approval to aparticular organisation.Possible alternatives to be included in this field are the following:July 2012 Page 76


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M- A specific type designation that is part <strong>of</strong> a type certificate, such as Airbus 340-211or Cessna 172R.- A type rating (or series) as listed in <strong>Part</strong>-66 Appendix I to AMC, which may befurther subdivided, such as Boeing 737-600/700/800, Boeing 737-600, Cessna 172Series.- An aircraft group such as Cessna single piston engined aircraft.Reference to the engine type installed in the aircraft may or may not be included, asnecessary.In all cases, the CAAN will be satisfied that the organisation has the capability tomanage the requested types/groups/series.48. Continuing oversight (NCAR M.B.704)48.1 The CAAN will keep and update a program listing for each M.A. Subpart Gapproved continuing airworthiness organisations under its supervision, the dateswhen audit visits are due and when such visits were carried out.48.2 Each organisation will be completely audited at periods not exceeding 24months.48.3 A relevant sample <strong>of</strong> the aircraft managed by the M.B. Subpart G approvedorganisation will be surveyed in every 24 month period. The size <strong>of</strong> the samplewill be decided by the CAAN based on the result <strong>of</strong> prior audits and earlierproduct surveys.48.4 All findings will be confirmed in writing to the applicant organisation.48.5 The CAAN will record all findings, closure actions (actions required to close afinding) and recommendations.48.6 A meeting with the accountable manager will be convened at least once every 24months to ensure he/she remains informed <strong>of</strong> significant issues arising duringaudits49. Continuing oversight (NCAR M.B.704)49.1 Where the CAAN has decided that a series <strong>of</strong> audit visits are necessary to arriveat a complete audit <strong>of</strong> an approved continuing airworthiness managementorganisation, the program will indicate which aspects <strong>of</strong> the approval will becovered on each visit.49.2 It is recommended that part <strong>of</strong> an audit concentrates on two ongoing aspects <strong>of</strong>the M.A. Subpart G approval, namely the organisations internal self monitoringquality reports produced by the quality monitoring personnel to determine if theorganisation is identifying and correcting its problems and secondly the number<strong>of</strong> concessions granted by the quality manager.July 2012 Page 77


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M49.3 At the successful conclusion <strong>of</strong> the audit(s) including verification <strong>of</strong> theexposition, an audit report form will be completed by the auditing surveyorincluding all recorded findings, closure actions and recommendation. A CAANForm 13 will be used for this activity.49.4 Credit may be claimed by the CAAN Surveyor(s) for specific item auditscompleted during the preceding 23 month period subject to four conditions:(a) the specific item audit will be the same as that required by M.A. Subpart G latestamendment, and(b) there will be satisfactory evidence on record that such specific item audits werecarried out and that all corrective actions have been taken, and(c) the CAAN surveyor(s) will be satisfied that there is no reason to believe standardshave deteriorated in respect <strong>of</strong> those specific item audits being granted a back credit;(d) the specific item audit being granted a back credit will be audited not later than 24months after the last audit <strong>of</strong> the item.49.5 When an operator sub-contracts continuing airworthiness management tasks allsub-contracted organisations will also be audited by the CAAN <strong>of</strong> operator atperiods not exceeding 24 months (credits per paragraph 4 above are permitted)to ensure they fully comply with M.A. Subpart G. For these audits, the CAANauditing surveyor will always ensure that he/she is accompanied throughout theaudit by a senior technical member <strong>of</strong> the operator. All findings will be sent toand corrected by the operator.49.6 When performing the oversight <strong>of</strong> organisations that hold both M.A. Subpart Fand M.A. Subpart G approvals, the CAAN will arrange the audits to cover bothapprovals avoiding duplicated visit <strong>of</strong> a particular area.50. Findings (NCAR M.B.705)50.1 When during audits or by other means evidence is found showing noncomplianceto the <strong>Part</strong>-M requirement, the CAAN will take the followingactions:(a) For level 1 findings, immediate action will be taken by the CAAN to revoke, limitor suspend in whole or in part, depending upon the extent <strong>of</strong> the level 1 finding,the continuing airworthiness management organisation approval, until successfulcorrective action has been taken by the organisation.(b) For level 2 findings, the CAAN will grant a corrective action period appropriate tothe nature <strong>of</strong> the finding that will not be more than three months. In certaincircumstances, at the end <strong>of</strong> this first period, and subject to the nature <strong>of</strong> thefinding the CAAN can extend the three month period subject to a satisfactorycorrective action plan.July 2012 Page 78


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M50.2 Action will be taken by the CAAN to suspend in whole or part the approval incase <strong>of</strong> failure to comply within the timescale granted by the CAAN.51. Findings (AMC M.B.705 (a) (1))51.1 For a level 1 finding the CAAN will inform the owner/operator and the CAAN<strong>of</strong> any potentially affected aircraft in order that corrective action can be taken toensure possible unsafe conditions on these aircraft are corrected before furtherflight.51.2 Furthermore, a level 1 finding could lead to a non compliance to be found on anaircraft as specified in NCAR M.B. 303 (g). In this case, proper action asspecified in NCAR M.B.303 would be taken.52. Changes (NCAR M.B.706)52.1 The CAAN will comply with the applicable elements <strong>of</strong> the initial approval forany change to the organisation notified in accordance with point NCARM.A.713.52.2 The CAAN may prescribe the conditions under which the approved continuingairworthiness management organisation may operate during such changes unlessit determines that the approval will be suspended due to the nature or the extent<strong>of</strong> the changes.52.3 For any change to the continuing airworthiness management exposition:(a) In the case <strong>of</strong> direct approval <strong>of</strong> changes in accordance with NCAR M.A.704(b),the CAAN will verify that the procedures specified in the exposition are incompliance with this Annex (<strong>Part</strong>-M) before formally notifying the approvedorganisation <strong>of</strong> the approval.(b) In the case an indirect approval procedure is used for the approval <strong>of</strong> the changesin accordance with point NCAR M.A.704(c), the CAAN will ensure(i) that the changes remain minor and(ii) that it has an adequate control over the approval <strong>of</strong> the changes to ensurethey remain in compliance with the requirements <strong>of</strong> this Annex (<strong>Part</strong>-M);53. Changes (AMC M.B.706)53.1 Changes in nominated personsThe CAAN will have adequate control over any changes to the personnelspecified in NCAR M.A.706 (a), (c), (d) and (i). Such changes will require anamendment to the exposition.July 2012 Page 79


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M53.2 It is recommended that a simple exposition status sheet is maintained whichcontains information on when an amendment was received by the CAAN andwhen it was approved.53.3 The CAAN will define the minor amendments to the exposition which may beincorporated through indirect approval. In this case a procedure will be stated inthe amendment section <strong>of</strong> the approved continuing airworthiness managementexposition.Changes notified in accordance with NCAR M.A.713 are not considered minor.For all cases other than minor, the applicable part(s) <strong>of</strong> the CAAN Form 13 willbe used for the change.53.4 The approved continuing airworthiness management organisation will submiteach exposition amendment to the CAAN whether it be an amendment forCAAN approval or an indirectly approved amendment. Where the amendmentrequires CAAN approval, the CAAN when satisfied, will indicate its approval inwriting. Where the amendment has been submitted under the indirect approvalprocedure the CAAN will acknowledge receipt in writing.54. Revocation, suspension and limitation <strong>of</strong> an approval (NCAR M.B.707)The CAAN will:(a) suspend an approval on reasonable grounds in the case <strong>of</strong> potential safety threat,or;(b) suspend, revoke or limit an approval pursuant to NCAR M.B.705.55. Assessment <strong>of</strong> recommendations (NCAR M.B.901)Upon receipt <strong>of</strong> an application and associated airworthiness review certificaterecommendation in accordance with NCAR M.A.901:55.1 Appropriate qualified personnel from the CAAN will verify that the compliancestatement contained in the recommendation demonstrates that a completeNCAR M.A.710 airworthiness review has been carried out.55.2 The CAAN will investigate and may request further information to support theassessment <strong>of</strong> the recommendation.56. Assessment <strong>of</strong> recommendations (AMC M.B.901)56.1 The result <strong>of</strong> the verification and the investigation <strong>of</strong> a recommendation will besent to the applicant within 30 days. If corrective action has been requestedbefore the issuance <strong>of</strong> an airworthiness review certificate, the CAAN maydecide a further period for the assessment <strong>of</strong> the requested corrective action.July 2012 Page 80


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M56.2 The verification <strong>of</strong> the compliance statement required by NCAR M.B.901 doesnot mean repeating the airworthiness review itself. However the CAAN willverify that the M.A. Subpart G organisation has carried out a complete andaccurate assessment <strong>of</strong> the airworthiness <strong>of</strong> the aircraft.56.3 Depending on the content <strong>of</strong> the recommendation, the history <strong>of</strong> the particularaircraft, and the knowledge <strong>of</strong> the M.A.Subpart G organisation or NCARM.A.901 (g) certifying staff making the recommendation in terms <strong>of</strong> experience,number and correction <strong>of</strong> findings and previous recommendations the extent <strong>of</strong>the investigation will vary. Therefore, whenever possible the person carrying outthe investigation will be involved in the oversight <strong>of</strong> the M.A.Subpart Gorganisation making the recommendation.56.4 In some cases, the inspector may decide that it is necessary to organise:- a physical survey <strong>of</strong> the aircraft, or;- a full or partial airworthiness review.In this case, the inspector will inform the M.A.Subpart G organisation orM.A.901(g) certifying staff making the recommendation with sufficient noticeso that it may organise itself according to M.A.901 (j).Furthermore, this part <strong>of</strong> the investigation will be carried out by appropriateairworthiness review staff in accordance with M.B. 902 (b).5. Only when satisfied the aircraft is airworthy, should the inspector issue an airworthinessreview certificate.57. <strong>Airworthiness</strong> review by CAAN (NCAR M.B.902)57.1 When the CAAN carries out the airworthiness review and issues theairworthiness review certificate CAAN Form 15a (Appendix <strong>II</strong>I), the CAANwill carry out an airworthiness review in accordance with point NCARM.A.710.57.2 The CAAN will have appropriate airworthiness review staff to carry out theairworthiness reviews.(a) For all aircraft used in commercial air transport, and aircraft above 2730 kgMTOM, except balloons, these staff will have acquired:(i) at least five years experience in continuing airworthiness, and;(ii) an appropriate licence in compliance with Annex <strong>II</strong>I (<strong>Part</strong>-66) or a nationallyrecognized maintenance personnel qualification appropriate to the aircraftcategory (when Annex <strong>II</strong>I (<strong>Part</strong>-66) refers to national rules) or an aeronauticaldegree or equivalent, and;(iii) formal aeronautical maintenance training, and;July 2012 Page 81


AIRWORTHINESS INSPECTORSHANDBOOK-FOR NCAR 145/66/147/M(iv) a position with appropriate responsibilities.Notwithstanding the points “i” to “iv” above, the requirement laid down in Para57.2(a)(ii) may be replaced by five years <strong>of</strong> experience in continuingairworthiness additional to those already required by Para 57.2(a)(i).(b) For aircraft not used in commercial air transport <strong>of</strong> 2730 kg MTOM and below,and balloons, these staff will have acquired:(i) at least three years experience in continuing airworthiness, and;(ii) an appropriate licence in compliance with Annex <strong>II</strong>I (<strong>Part</strong>-66) or a nationallyrecognized maintenance personnel qualification appropriate to the aircraftcategory (when Annex <strong>II</strong>I (<strong>Part</strong>-66) refers to national rules) or an aeronauticaldegree or equivalent, and;(iii) appropriate aeronautical maintenance training, and;(iv) a position with appropriate responsibilities.Notwithstanding the points “i” to “iv” above, the requirement shown in Para57.2(b)(ii) may be replaced by four years <strong>of</strong> experience in continuingairworthiness additional to those already required by Para 57.2(b)(i).(c) The CAAN will maintain a record <strong>of</strong> all airworthiness review staff, which willinclude details <strong>of</strong> any appropriate qualification held together with a summary <strong>of</strong>relevant continuing airworthiness management experience and training.(d) The CAAN will have access to the applicable data as specified in points NCARM.A.305, NCAR M.A.306 and NCAR M.A.401 in the performance <strong>of</strong> theairworthiness review.(e) The staff that carries out the airworthiness review will issue a CAAN Form 15aafter satisfactory completion <strong>of</strong> the airworthiness review.”58. <strong>Airworthiness</strong> review by the CAAN (AMC M.B.902 (b))58.1 A person qualified in accordance with Para 2.1.5 will be considered as holdingthe equivalent to an aeronautical degree.58.2 “experience in continuing airworthiness” means any appropriate combination <strong>of</strong>experience in tasks related to aircraft maintenance and/or continuingairworthiness management (engineering) and/or surveillance <strong>of</strong> such tasks.58.3 An appropriate licence in compliance with Annex <strong>II</strong>I (<strong>Part</strong>-66) is a category B orC licence in the subcategory <strong>of</strong> the aircraft reviewed. It is not necessary tosatisfy the recent experience requirements <strong>of</strong> <strong>Part</strong> 66 at the time <strong>of</strong> the review orto hold the type rating on the particular aircraft.July 2012 Page 82
