The repairs shall be carried out in a time <strong>an</strong>d m<strong>an</strong>ner as required bythe owner of the infrastructure. Council must be notified in writing, prior <strong>to</strong> commencement of the activity, of <strong>an</strong>yexisting damage <strong>to</strong> roads, s<strong>to</strong>rmwater drainage, kerb <strong>an</strong>d gutter or footpaths. Absence of notification signifies that nodamage exists, <strong>an</strong>d the applic<strong>an</strong>t is, therefore, liable for the cost of reinstatement of <strong>an</strong>y damage found at thecompletion of the works.<strong>Section</strong> <strong>138</strong> <strong>Road</strong>s Act Application – Richmond Valley Council (version May 2015)


CONDITIONSAccept<strong>an</strong>ceCouncil's accept<strong>an</strong>ce of the application does not imply that a consent will necessarily be gr<strong>an</strong>ted inrespect of the activity. Consent may not be issued if insufficient information or details are provided asrelev<strong>an</strong>t <strong>to</strong> the type <strong>an</strong>d scale of activity or for <strong>an</strong>y reason. Details <strong>to</strong> be provided include:A Site Pl<strong>an</strong>.Traffic Control Pl<strong>an</strong>(s) prepared by <strong>an</strong> accredited provider No. ____________________A Traffic M<strong>an</strong>agement Pl<strong>an</strong> may be required <strong>to</strong> show overall m<strong>an</strong>agement with various TCPs.Engineering pl<strong>an</strong>s (if applicable).A Certificate of currency as evidence of holding public liability insur<strong>an</strong>ce valued at a minimum of$10m <strong>an</strong>d suitable for the activity.Processing Immediate processing of requests is not guar<strong>an</strong>teed <strong>an</strong>d Council will not be responsiblefor the consequences caused by late applications (allow 3 - 5 working days for Council roads, <strong>an</strong>d 3weeks if RMS (formerly RTA) concurrence is required. A minimum of 2 weeks is required for roadclosures <strong>to</strong> allow advertising.Responsibility The applic<strong>an</strong>t is, by way of signature <strong>to</strong> the application, responsible for compli<strong>an</strong>ce withall of the agreements, declarations <strong>an</strong>d consent conditions <strong>an</strong>d is likewise responsible for compli<strong>an</strong>ce inrespect of all agents, sub-contrac<strong>to</strong>rs <strong>an</strong>d <strong>an</strong>yone else carrying out part or all of the activity authorizedunder the consent as if they were the applic<strong>an</strong>t.The applic<strong>an</strong>t must not request consent for <strong>an</strong> activity which is known <strong>to</strong> be contrary <strong>to</strong> a consent,requirement or condition applied under <strong>an</strong>y other authority or jurisdiction. A consent issued under thesecircumst<strong>an</strong>ces will become null <strong>an</strong>d void.Consent Consent for the activity is gr<strong>an</strong>ted following the signing of the application by Council'sAuthorising Officer <strong>an</strong>d issue of <strong>an</strong> official receipt for payment of the prescribed fee (if applicable). <strong>Road</strong>s Act 1993Part 9 Regulation of works, structures <strong>an</strong>d activitiesDivision 3 Other works <strong>an</strong>d structures<strong>138</strong> Works <strong>an</strong>d Structures1. A person must not:(a) Erect a structure or carry out a work in, on or over a public road, or(b) Dig up or disturb the surface of a public road, or(c) Remove or interfere with a structure, work or tree on a public road, or(d) Pump water in<strong>to</strong> a public road from <strong>an</strong>y l<strong>an</strong>d adjoining the road, or(e) Connect a road (whether public or private) <strong>to</strong> a classified road,Otherwise th<strong>an</strong> with the consent of the appropriate roads authority.Maximum penalty:10 penalty units.2. A consent may not be given with respect <strong>to</strong> a classified road except with the concurrence ofthe RMS (formerly RTA).3. If the applic<strong>an</strong>t is a public authority, the roads authority <strong>an</strong>d, in the case of a classified road,the RMS (formerly RTA) must consult with the applic<strong>an</strong>t before deciding whether or not <strong>to</strong>gr<strong>an</strong>t consent or concurrence.4. This section applies <strong>to</strong> a roads authority <strong>an</strong>d <strong>to</strong> <strong>an</strong>y employee of a roads authority in the sameway as it applies <strong>to</strong> <strong>an</strong>y other person.5. This section applies despite the provisions of <strong>an</strong>y other Act or law <strong>to</strong> the contrary, but does notapply <strong>to</strong> <strong>an</strong>ything done under the provisions of the Pipelines Act 1967 or under <strong>an</strong>y otherprovision of <strong>an</strong> Act that expressly excludes the operation of this section.142 Mainten<strong>an</strong>ce of works <strong>an</strong>d structures1. A person who has a right <strong>to</strong> the control, use or benefit of a structure or work in, on or over apublic road:(a) must maintain the structure or work in a satisfac<strong>to</strong>ry state of repair, <strong>an</strong>d(b) in the case of a structure (such as a grating or inspection cover) located on thesurface of the road, must ensure that the structure is kept flush with the surroundingroad surface <strong>an</strong>d that the structure <strong>an</strong>d surrounding road surface are so maintainedas <strong>to</strong> facilitate the smooth passage of traffic along the road,<strong>an</strong>d the person is, by this section, empowered <strong>to</strong> do so accordingly.Maximum penalty: 30 penalty units.2. Subsection (1) applies <strong>to</strong> all structures <strong>an</strong>d works in, on or over a public road, includingstructures <strong>an</strong>d works for which there is no consent in force under this Division.3. Subsection (1) does not apply <strong>to</strong> a person whose right <strong>to</strong> the control, use or benefit of astructure or work consists merely of a right of passage that the person has as a member of thepublic or a right of access that the person has as the owner of adjoining l<strong>an</strong>d.4. If:(a) a roads authority has gr<strong>an</strong>ted a consent under this Division <strong>to</strong> the doing of <strong>an</strong>ything, <strong>an</strong>d(b) that thing has been or is being done otherwise th<strong>an</strong> in accord<strong>an</strong>ce with the consent,the roads authority may direct the holder of the consent <strong>to</strong> take specified action <strong>to</strong> remedy <strong>an</strong>ydamage arising from the doing of that thing otherwise th<strong>an</strong> in accord<strong>an</strong>ce with the consent.<strong>Section</strong> <strong>138</strong> <strong>Road</strong>s Act Application - Richmond Valley Council (version 27 September 2012)
