Part OneGENERAL <str<strong>on</strong>g>RULES</str<strong>on</strong>g>Chapter I status and compositi<strong>on</strong>Chapter II MembershipRule 3StatusRule 5Term <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficeRule 41.The African Commissi<strong>on</strong> is anaut<strong>on</strong>omous treaty body workingwithin <str<strong>on</strong>g>the</str<strong>on</strong>g> framework <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> AfricanUni<strong>on</strong> to promote human andpeoples’ rights and ensure <str<strong>on</strong>g>the</str<strong>on</strong>g>irprotecti<strong>on</strong> in Africa.Compositi<strong>on</strong>In c<strong>on</strong>formity with Article 31 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>African Charter, <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong>shall c<strong>on</strong>sist <str<strong>on</strong>g>of</str<strong>on</strong>g> eleven (11)members chosen from am<strong>on</strong>gstAfrican pers<strong>on</strong>alities <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> highestreputati<strong>on</strong>, known for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir highmorality, integrity, impartiality andcompetence in matters <str<strong>on</strong>g>of</str<strong>on</strong>g> humanand peoples’ rights, particularc<strong>on</strong>siderati<strong>on</strong> being given to pers<strong>on</strong>shaving legal experience.1.2.3.Members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> areelected for six years and shall beeligible for re-electi<strong>on</strong>.If a member <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> isre-elected at <str<strong>on</strong>g>the</str<strong>on</strong>g> expiry <str<strong>on</strong>g>of</str<strong>on</strong>g> his or herterm <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>fice, or elected to replacea member whose term <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>fice hasexpired or will expire, <str<strong>on</strong>g>the</str<strong>on</strong>g> term <str<strong>on</strong>g>of</str<strong>on</strong>g><str<strong>on</strong>g>of</str<strong>on</strong>g>fice shall begin from that expirydate.In c<strong>on</strong>formity with Article 39(3) <str<strong>on</strong>g>of</str<strong>on</strong>g><str<strong>on</strong>g>the</str<strong>on</strong>g> African Charter, <str<strong>on</strong>g>the</str<strong>on</strong>g> member <str<strong>on</strong>g>of</str<strong>on</strong>g><str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> elected to replacea member whose term has notexpired, shall complete <str<strong>on</strong>g>the</str<strong>on</strong>g> term <str<strong>on</strong>g>of</str<strong>on</strong>g>his or her predecessor. However, if<str<strong>on</strong>g>the</str<strong>on</strong>g> remaining term <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>fice is lessthan six m<strong>on</strong>ths, <str<strong>on</strong>g>the</str<strong>on</strong>g>re shall be noreplacement.2.The members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong>shall serve in <str<strong>on</strong>g>the</str<strong>on</strong>g>ir pers<strong>on</strong>alcapacity.Rule 61.Order <str<strong>on</strong>g>of</str<strong>on</strong>g> precedenceIn <str<strong>on</strong>g>the</str<strong>on</strong>g> discharge <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir duties,members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> shallfollow <str<strong>on</strong>g>the</str<strong>on</strong>g> Chairpers<strong>on</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g>Vice-Chairpers<strong>on</strong> according to<str<strong>on</strong>g>the</str<strong>on</strong>g>ir seniority in <str<strong>on</strong>g>of</str<strong>on</strong>g>fice. When <str<strong>on</strong>g>the</str<strong>on</strong>g>reare two or more members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>Commissi<strong>on</strong> with equal seniority,precedence shall be given to <str<strong>on</strong>g>the</str<strong>on</strong>g>oldest.Part One : General Rules7
