Part OneGENERAL <strong>RULES</strong>Chapter I status and compositionChapter II MembershipRule 3StatusRule 5Term <strong>of</strong> <strong>of</strong>ficeRule 41.The African Commission is anautonomous treaty body workingwithin <strong>the</strong> framework <strong>of</strong> <strong>the</strong> AfricanUnion to promote human andpeoples’ rights and ensure <strong>the</strong>irprotection in Africa.CompositionIn conformity with Article 31 <strong>of</strong> <strong>the</strong>African Charter, <strong>the</strong> Commissionshall consist <strong>of</strong> eleven (11)members chosen from amongstAfrican personalities <strong>of</strong> <strong>the</strong> highestreputation, known for <strong>the</strong>ir highmorality, integrity, impartiality andcompetence in matters <strong>of</strong> humanand peoples’ rights, particularconsideration being given to personshaving legal experience.1.2.3.Members <strong>of</strong> <strong>the</strong> Commission areelected for six years and shall beeligible for re-election.If a member <strong>of</strong> <strong>the</strong> Commission isre-elected at <strong>the</strong> expiry <strong>of</strong> his or herterm <strong>of</strong> <strong>of</strong>fice, or elected to replacea member whose term <strong>of</strong> <strong>of</strong>fice hasexpired or will expire, <strong>the</strong> term <strong>of</strong><strong>of</strong>fice shall begin from that expirydate.In conformity with Article 39(3) <strong>of</strong><strong>the</strong> African Charter, <strong>the</strong> member <strong>of</strong><strong>the</strong> Commission elected to replacea member whose term has notexpired, shall complete <strong>the</strong> term <strong>of</strong>his or her predecessor. However, if<strong>the</strong> remaining term <strong>of</strong> <strong>of</strong>fice is lessthan six months, <strong>the</strong>re shall be noreplacement.2.The members <strong>of</strong> <strong>the</strong> Commissionshall serve in <strong>the</strong>ir personalcapacity.Rule 61.Order <strong>of</strong> precedenceIn <strong>the</strong> discharge <strong>of</strong> <strong>the</strong>ir duties,members <strong>of</strong> <strong>the</strong> Commission shallfollow <strong>the</strong> Chairperson and <strong>the</strong>Vice-Chairperson according to<strong>the</strong>ir seniority in <strong>of</strong>fice. When <strong>the</strong>reare two or more members <strong>of</strong> <strong>the</strong>Commission with equal seniority,precedence shall be given to <strong>the</strong>oldest.Part One : General Rules7
