Part FourRELATIONSHIPS WITH THE <str<strong>on</strong>g>AFRICAN</str<strong>on</strong>g> COURTCHAPTER I GENERAL PROVISIONSRule 114 Complementarity with <str<strong>on</strong>g>the</str<strong>on</strong>g> AfricanCourt1.2.Pursuant to Article 2 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Protocol,<str<strong>on</strong>g>the</str<strong>on</strong>g> Court shall complement<str<strong>on</strong>g>the</str<strong>on</strong>g> protective mandate <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>Commissi<strong>on</strong> as provided for inArticles 30 and 45 (2) <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> AfricanCharter.The complementarity relati<strong>on</strong>shipbetween <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g>Court is set out and organized byArticles 5, 6(1) & (3), 8 and 33 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>Protocol.Rule 115 C<strong>on</strong>sultati<strong>on</strong>s with <str<strong>on</strong>g>the</str<strong>on</strong>g> Court1. In pursuance <str<strong>on</strong>g>of</str<strong>on</strong>g> Article 2 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>Protocol, <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> shall meetwith <str<strong>on</strong>g>the</str<strong>on</strong>g> Court at least <strong>on</strong>ce a yearand whenever necessary to ensuregood working relati<strong>on</strong>ship between<str<strong>on</strong>g>the</str<strong>on</strong>g> two instituti<strong>on</strong>s.2. The Bureau <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> maymeet <str<strong>on</strong>g>the</str<strong>on</strong>g> Bureau <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Court as<str<strong>on</strong>g>of</str<strong>on</strong>g>ten as necessary to undertake anyfuncti<strong>on</strong>s assigned to <str<strong>on</strong>g>the</str<strong>on</strong>g>m by <str<strong>on</strong>g>the</str<strong>on</strong>g>two instituti<strong>on</strong>s.3. The c<strong>on</strong>clusi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> meetings <str<strong>on</strong>g>of</str<strong>on</strong>g><str<strong>on</strong>g>the</str<strong>on</strong>g> Bureaus shall be c<strong>on</strong>sidered andif adopted by <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong>, shallbe included in <str<strong>on</strong>g>the</str<strong>on</strong>g> Activity Report.4. The Commissi<strong>on</strong> shall c<strong>on</strong>sult with<str<strong>on</strong>g>the</str<strong>on</strong>g> Court before <str<strong>on</strong>g>the</str<strong>on</strong>g> modificati<strong>on</strong><str<strong>on</strong>g>of</str<strong>on</strong>g> any <str<strong>on</strong>g>of</str<strong>on</strong>g> its Rules relating to <str<strong>on</strong>g>the</str<strong>on</strong>g>irrelati<strong>on</strong>ship.Rule 116 Interpretati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Charter by <str<strong>on</strong>g>the</str<strong>on</strong>g>Commissi<strong>on</strong>1.2.If <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> is requested tointerpret <str<strong>on</strong>g>the</str<strong>on</strong>g> Charter under Article45(3), it shall immediately inform<str<strong>on</strong>g>the</str<strong>on</strong>g> President <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Court.A copy <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> interpretati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>Charter by <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> shall besent to <str<strong>on</strong>g>the</str<strong>on</strong>g> President <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Court asso<strong>on</strong> as it is adopted.Rule 117 Advisory Opini<strong>on</strong>The Commissi<strong>on</strong> may request tobe heard by <str<strong>on</strong>g>the</str<strong>on</strong>g> Court up<strong>on</strong> beingnotified by <str<strong>on</strong>g>the</str<strong>on</strong>g> Court <str<strong>on</strong>g>of</str<strong>on</strong>g> a requestfor an Advisory Opini<strong>on</strong> pursuant toArticle 4(1) <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Protocol.Rule 118 Seizure <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Court1.If <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> has takena decisi<strong>on</strong> with respect to acommunicati<strong>on</strong> submitted underArticles 48, 49 or 55 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Charterand c<strong>on</strong>siders that <str<strong>on</strong>g>the</str<strong>on</strong>g> State has notcomplied or is unwilling to complywith its recommendati<strong>on</strong>s in respect<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> communicati<strong>on</strong> within <str<strong>on</strong>g>the</str<strong>on</strong>g>Part Four : Relati<strong>on</strong>ships With The African Court43
