4.5.6.7.8.9.If no response is received from<strong>the</strong> State, <strong>the</strong> Commission maysend a reminder to <strong>the</strong> State Partyconcerned to submit its informationwithin ninety (90) days from <strong>the</strong>date <strong>of</strong> <strong>the</strong> reminder.The Rapporteur for <strong>the</strong>Communication, or any o<strong>the</strong>rmember <strong>of</strong> <strong>the</strong> Commissiondesignated for this purpose, shallmonitor <strong>the</strong> measures taken by<strong>the</strong> State Party to give effect to <strong>the</strong>Commission’s recommendations oneach Communication.The Rapporteur may make suchcontacts and take such actionas may be appropriate to fulfillhis/her assignment includingrecommendations for fur<strong>the</strong>r actionby <strong>the</strong> Commission as may benecessary.At each Ordinary Session, <strong>the</strong>Rapporteur shall present <strong>the</strong> reportduring <strong>the</strong> Public Session on <strong>the</strong>implementation <strong>of</strong> <strong>the</strong> Commission’srecommendations.The Commission shall draw <strong>the</strong>attention <strong>of</strong> <strong>the</strong> Sub-Committee<strong>of</strong> <strong>the</strong> Permanent RepresentativesCommittee and <strong>the</strong> ExecutiveCouncil on <strong>the</strong> Implementation <strong>of</strong><strong>the</strong> Decisions <strong>of</strong> <strong>the</strong> African Union,to any situations <strong>of</strong> non-compliancewith <strong>the</strong> Commission’s decisions.The Commission shall includeinformation on any follow-upactivities in its Activity Report.Rule 113 Extension <strong>of</strong> time1.2.Subject to <strong>the</strong> provisions <strong>of</strong> Rule111, when a deadline is fixed for aparticular submission, ei<strong>the</strong>r partymay apply to <strong>the</strong> Commission forextension <strong>of</strong> <strong>the</strong> period stipulated.The Commission may grant anextension which shall not exceedone (1) month, and shall not grantmore than one extension per partyfor any given submission.42Part Three : Protection Activities
Part FourRELATIONSHIPS WITH THE <strong>AFRICAN</strong> COURTCHAPTER I GENERAL PROVISIONSRule 114 Complementarity with <strong>the</strong> AfricanCourt1.2.Pursuant to Article 2 <strong>of</strong> <strong>the</strong> Protocol,<strong>the</strong> Court shall complement<strong>the</strong> protective mandate <strong>of</strong> <strong>the</strong>Commission as provided for inArticles 30 and 45 (2) <strong>of</strong> <strong>the</strong> AfricanCharter.The complementarity relationshipbetween <strong>the</strong> Commission and <strong>the</strong>Court is set out and organized byArticles 5, 6(1) & (3), 8 and 33 <strong>of</strong> <strong>the</strong>Protocol.Rule 115 Consultations with <strong>the</strong> Court1. In pursuance <strong>of</strong> Article 2 <strong>of</strong> <strong>the</strong>Protocol, <strong>the</strong> Commission shall meetwith <strong>the</strong> Court at least once a yearand whenever necessary to ensuregood working relationship between<strong>the</strong> two institutions.2. The Bureau <strong>of</strong> <strong>the</strong> Commission maymeet <strong>the</strong> Bureau <strong>of</strong> <strong>the</strong> Court as<strong>of</strong>ten as necessary to undertake anyfunctions assigned to <strong>the</strong>m by <strong>the</strong>two institutions.3. The conclusions <strong>of</strong> <strong>the</strong> meetings <strong>of</strong><strong>the</strong> Bureaus shall be considered andif adopted by <strong>the</strong> Commission, shallbe included in <strong>the</strong> Activity Report.4. The Commission shall consult with<strong>the</strong> Court before <strong>the</strong> modification<strong>of</strong> any <strong>of</strong> its Rules relating to <strong>the</strong>irrelationship.Rule 116 Interpretation <strong>of</strong> <strong>the</strong> Charter by <strong>the</strong>Commission1.2.If <strong>the</strong> Commission is requested tointerpret <strong>the</strong> Charter under Article45(3), it shall immediately inform<strong>the</strong> President <strong>of</strong> <strong>the</strong> Court.A copy <strong>of</strong> <strong>the</strong> interpretation <strong>of</strong> <strong>the</strong>Charter by <strong>the</strong> Commission shall besent to <strong>the</strong> President <strong>of</strong> <strong>the</strong> Court assoon as it is adopted.Rule 117 Advisory OpinionThe Commission may request tobe heard by <strong>the</strong> Court upon beingnotified by <strong>the</strong> Court <strong>of</strong> a requestfor an Advisory Opinion pursuant toArticle 4(1) <strong>of</strong> <strong>the</strong> Protocol.Rule 118 Seizure <strong>of</strong> <strong>the</strong> Court1.If <strong>the</strong> Commission has takena decision with respect to acommunication submitted underArticles 48, 49 or 55 <strong>of</strong> <strong>the</strong> Charterand considers that <strong>the</strong> State has notcomplied or is unwilling to complywith its recommendations in respect<strong>of</strong> <strong>the</strong> communication within <strong>the</strong>Part Four : Relationships With The African Court43
