SECTION 3 CONSIDERATION <str<strong>on</strong>g>OF</str<strong>on</strong>g>COMMUNICATIONS RECEIVED UNDERARTICLES 48 & 49 <str<strong>on</strong>g>OF</str<strong>on</strong>g> THE CHARTER:COMMUNICATIONS - COMPLAINTS <str<strong>on</strong>g>OF</str<strong>on</strong>g>STATES PARTIESRule 87 Seizure <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong>1. Any Communicati<strong>on</strong> under Articles48 and 49 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Charter may besubmitted to <str<strong>on</strong>g>the</str<strong>on</strong>g> Chairpers<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>Commissi<strong>on</strong> through <str<strong>on</strong>g>the</str<strong>on</strong>g> Secretaryby an interested State Party.2. The Communicati<strong>on</strong> shall c<strong>on</strong>taininformati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> following or beaccompanied particularly by:a.b.c.Measures taken to resolve <str<strong>on</strong>g>the</str<strong>on</strong>g>issue pursuant to Article 47 <str<strong>on</strong>g>of</str<strong>on</strong>g><str<strong>on</strong>g>the</str<strong>on</strong>g> African Charter including <str<strong>on</strong>g>the</str<strong>on</strong>g>text <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> initial communicati<strong>on</strong>and any subsequent writtenexplanati<strong>on</strong> from <str<strong>on</strong>g>the</str<strong>on</strong>g> interestedStates Parties relating to <str<strong>on</strong>g>the</str<strong>on</strong>g>issue;Measures taken to exhaustregi<strong>on</strong>al or internati<strong>on</strong>alprocedures <str<strong>on</strong>g>of</str<strong>on</strong>g> settlement orgood <str<strong>on</strong>g>of</str<strong>on</strong>g>fices;Any o<str<strong>on</strong>g>the</str<strong>on</strong>g>r procedure <str<strong>on</strong>g>of</str<strong>on</strong>g>internati<strong>on</strong>al investigati<strong>on</strong> orinternati<strong>on</strong>al settlement towhich <str<strong>on</strong>g>the</str<strong>on</strong>g> interested StatesParties have resorted.Rule 88 C<strong>on</strong>siderati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Communicati<strong>on</strong>1.Where, pursuant to Articles 48and 49 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> African Charter, aCommunicati<strong>on</strong> is brought before<str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> by a State Party,<str<strong>on</strong>g>the</str<strong>on</strong>g> Chairpers<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong>,through <str<strong>on</strong>g>the</str<strong>on</strong>g> Secretary, shall givenotice <str<strong>on</strong>g>of</str<strong>on</strong>g> such Communicati<strong>on</strong> to<str<strong>on</strong>g>the</str<strong>on</strong>g> State Party against which <str<strong>on</strong>g>the</str<strong>on</strong>g>complaint is made and shall inviteit to submit to <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong>2.3.its observati<strong>on</strong>s in writing <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>admissibility <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Communicati<strong>on</strong>within ninety (90) days. Theobservati<strong>on</strong>s so obtained in writingshall be immediately communicatedto <str<strong>on</strong>g>the</str<strong>on</strong>g> complaining State Party, whichshall resp<strong>on</strong>d within ninety (90)days <str<strong>on</strong>g>of</str<strong>on</strong>g> receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> observati<strong>on</strong>s.The Commissi<strong>on</strong> shall designate<strong>on</strong>e or more <str<strong>on</strong>g>of</str<strong>on</strong>g> its members asRapporteur for <str<strong>on</strong>g>the</str<strong>on</strong>g> Communicati<strong>on</strong>.Rapporteurs, through <str<strong>on</strong>g>the</str<strong>on</strong>g> Secretary,may:a. Request relevant informati<strong>on</strong><strong>on</strong> matters c<strong>on</strong>nected with<str<strong>on</strong>g>the</str<strong>on</strong>g> Communicati<strong>on</strong> from <str<strong>on</strong>g>the</str<strong>on</strong>g>States Parties c<strong>on</strong>cerned. Suchinformati<strong>on</strong> shall be provided byboth parties within ninety (90)days <str<strong>on</strong>g>of</str<strong>on</strong>g> receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> such request;b. Transmit any informati<strong>on</strong>obtained from <strong>on</strong>e party to <str<strong>on</strong>g>the</str<strong>on</strong>g>o<str<strong>on</strong>g>the</str<strong>on</strong>g>r for comments. The partiesshall be given ninety (90) daysto resp<strong>on</strong>d to <str<strong>on</strong>g>the</str<strong>on</strong>g> observati<strong>on</strong>smade by <str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r party.4. Prior to <str<strong>on</strong>g>the</str<strong>on</strong>g> sessi<strong>on</strong> at which <str<strong>on</strong>g>the</str<strong>on</strong>g>Communicati<strong>on</strong> is to be c<strong>on</strong>sidered,<str<strong>on</strong>g>the</str<strong>on</strong>g> Rapporteurs shall prepare areport <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> admissibility <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>Communicati<strong>on</strong>. Such report shallc<strong>on</strong>tain:a. The relevant facts, includingany informati<strong>on</strong> or commentsobtained under paragraph 3 <str<strong>on</strong>g>of</str<strong>on</strong>g>this Rule;b. The provisi<strong>on</strong>(s) <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> AfricanCharter alleged to have beenviolated in <str<strong>on</strong>g>the</str<strong>on</strong>g> Communicati<strong>on</strong>;c. A recommendati<strong>on</strong> <strong>on</strong>admissibility and <strong>on</strong> any o<str<strong>on</strong>g>the</str<strong>on</strong>g>racti<strong>on</strong> to be taken, as <str<strong>on</strong>g>the</str<strong>on</strong>g> casemay require.Part Three : Protecti<strong>on</strong> Activities31
