I /MEMORANDUM OF UNDERSTANDiNG (MOU) BETWEEN KENDRIYA VIDYALAYASANGATHAN (KVS) AND ERNE!' INDIA<strong>This</strong> <strong>memorandum</strong> <strong>of</strong> <strong>understanding</strong> <strong>made</strong> <strong>at</strong> <strong>New</strong> <strong>Delhi</strong> <strong>between</strong> ERNETIndia, an autonumous society under Department <strong>of</strong> Inform<strong>at</strong>ion Technology,Ministry <strong>of</strong> Communic<strong>at</strong>ions and Inform<strong>at</strong>ion Technology, Govt. <strong>of</strong> India,represet;lted by Executive director hereinafter referred to as "ERNET India" (whichexpression shall unless excluded by or repugnant, to the context be deemed toinclude its successor in <strong>of</strong>fice or assign) <strong>of</strong> the one part and the Kendriya VidyalayaSang<strong>at</strong>han, <strong>New</strong> <strong>Delhi</strong> - an autonomous organis<strong>at</strong>ion under the Department <strong>of</strong>School Educ<strong>at</strong>ion & Literacy, Ministry <strong>of</strong> HRD, represented by its Commissionerhereinafter referred to as Kendriya Vidyalaya Sang<strong>at</strong>han (which expression shallunless excluded by or repugnant to the context be deemed to include its successorin <strong>of</strong>fice or assign) <strong>of</strong> the other part.2. Kendriya Vidyalaya Sang<strong>at</strong>han (KVS) established Vidyalayas all over thecountry to impart quality educ<strong>at</strong>ion, promotion <strong>of</strong> n<strong>at</strong>ional integr<strong>at</strong>ion, adventureactivities, physical educ<strong>at</strong>ion etc. Improving quality educ<strong>at</strong>ion through shadng <strong>of</strong>experience and facilities hav0 been some <strong>of</strong> the main aims <strong>of</strong> these Vidyalayas.3. At present under KVS, there are 978 Vidyalayas spread over St<strong>at</strong>es and UnionTerritories. There are also 3 Vidyalayas abroad. These Vidyalayas have over 1million students on roll.4. The Kendriya Vidyalayas are envisaged as model and pace-setting institutionsto lead the school educ<strong>at</strong>ion system in India and paving the way for the realiz<strong>at</strong>ion<strong>of</strong> n<strong>at</strong>ional goals.5. ERNET India, as Autonomous Society under the Department <strong>of</strong> Inform<strong>at</strong>ionTechnology, Ministry <strong>of</strong> Communic<strong>at</strong>ions & Inform<strong>at</strong>ion Technology, Government <strong>of</strong>India, is oper<strong>at</strong>ing "ERNET", a nodal network <strong>of</strong> Govt. <strong>of</strong> India to provideconnectivity and Internet access to Educ<strong>at</strong>ion and Research Institutions in thecountry. ERNET India, in collabor<strong>at</strong>ion with leading academic and researchinstitutions in the country, has pioneered the Internet Technology in the country.ERNET India has developed expertise and established a st<strong>at</strong>e-<strong>of</strong>-the-artinfrastructure with a mand<strong>at</strong>e to facilit<strong>at</strong>e modern communic<strong>at</strong>ion facilities for theeduc<strong>at</strong>ion and research community in the country. Continuous technologicalinputs through R&D and training activities ensure high quality <strong>of</strong> service for theconnected institutions.6. Towards integr<strong>at</strong>ion <strong>of</strong> the Computer Educ<strong>at</strong>ion Programme <strong>of</strong> the KendriyaVidyalayas, KVS has already equipped a large number <strong>of</strong> their schools withcomputer technology. In addition to computer literacy programme, students andteachers are encouraged to use computer as a medium <strong>of</strong> teaching and learning.Already substantial number <strong>of</strong> teachers have been trained in this area.7. KVS and ERNET India see a synergy in their objectives and agree to have acollabor<strong>at</strong>ion in strengthening computer educ<strong>at</strong>ion programme. In order to achievethis, KVS and ERNET India agree to set up KVS-Net connectivity <strong>of</strong> remoteVidyalayas under KVS, providing them internet access by utilizing ERNET services,expertise and networking infrastructure.- 1 -
8. It is hereby agreed and declared th<strong>at</strong> for setting up <strong>of</strong> IevS-Net and utiliz<strong>at</strong>ion<strong>of</strong> ERNET India's expertise in Inform<strong>at</strong>ion Technology (IT) by !(vS and/or "theVIDYALAYAS",the following shall be the responsibilities <strong>of</strong> ERNET India and !(vS.A. RESPONSIBILITIES OF ERNET INDIA/(i) ERNET India will design IevS-Net to ,meet the requirements <strong>of</strong>Kendriya Vidyalaya Sang<strong>at</strong>han for it~/schools and <strong>of</strong>fices.(ii) ERNET India would assist !(vS in procuring hardware and otheraccessones.(Hi)ERNET India will provide Broadband VSAT connectivity toKendriya Vidyalayas loc<strong>at</strong>ed in remote areas as agreed to,<strong>between</strong> !(vS, ERNET India and the concerned Vidyalaya.(iv)(v)(vi)(vii)(viii)(ix)(x)ERNET India on its part will get installed the rec:uired hardwareand s<strong>of</strong>tware such as leased d<strong>at</strong>a circ'uits, RF (Radio Frequency)communic<strong>at</strong>ion, VSATs (Very Small Aperture Terminals) andDial-up links and router as suited to the requirement <strong>of</strong>institution to establish Internet access from !(VS-Net.ERNET India will train KVS and/or Vidyalaya personnel toensure proper oper<strong>at</strong>ion and maintenance <strong>of</strong> installed hardwareand s<strong>of</strong>tware. Training <strong>of</strong> !(vS personnel and/or Vidyalayas onawareness and usage <strong>of</strong> Internet and rel<strong>at</strong>ed applic<strong>at</strong>ions will bearranged by ERNET India on cost-plus basis. Training will bearranged <strong>at</strong> mutually agreed centers and TA/DA <strong>of</strong>trainers/trainees will be borne by the respective organiz<strong>at</strong>ions.As and when required, ERNET India will give recommend<strong>at</strong>ionson augment<strong>at</strong>ion/replacement <strong>of</strong> the Computer Communic<strong>at</strong>ionEquipments for improving the performance and usage <strong>of</strong> network.ERNET India wilJ respect inform<strong>at</strong>ion propriety <strong>of</strong> !(vS and/orVidyalayas and will provide all mutually agreed safeguards whichare feasible within the ambit <strong>of</strong> technical and resourceconstraints.ERNET India or its design<strong>at</strong>ed ager!cy will provide maintenance <strong>of</strong>the system installed under this agreement to the s<strong>at</strong>isfaction <strong>of</strong>IevS and/or Vidyalayas. The terms <strong>of</strong> maintenance may bedecided by ERNET India in consult<strong>at</strong>ion wi~h KVS and/orVidyalayas.ERNET India will provide back·-up support to KVS and/orVidyalayas whenever required for solving any network or ITrel<strong>at</strong>ed problems on cost plus basis.ERNET India shall help KVS and/or Vidyalayas in making use <strong>of</strong>IT in day-to-day academic/administr<strong>at</strong>ive work including theconduct <strong>of</strong> students/staff performance evalu<strong>at</strong>ions, examin<strong>at</strong>ionsetc. and finally leading to a paperless <strong>of</strong>fice. <strong>This</strong> service will b~provided on cost plus basis.- 2 -
(xi) ERNET India will provide its services and procure, supply andinstall equipments and establish link on cost plus basis.(xii) ERNET India will charge 10 per cent over and above the cost <strong>of</strong>equipment, install<strong>at</strong>ion and transport<strong>at</strong>ion charges as servicecharges, which may be mutually decided on case-to-case basisand the r<strong>at</strong>e may be reviewed from time to time. However,bandwidth tariff for different connectivity will be applicable as inthe case <strong>of</strong>UGC/AlCTE.(xiii) ERNET India would also assist KVS in face-lifting computer labfacilities available in the Vidyalayas.(xiv) ERNET will adhere to the time frame for connectivityoper<strong>at</strong>ionalis<strong>at</strong>ion and other services.B. RESPONSIBILITIES OF KVS/Vidyalaya'(i) KVS will identify the schools and its other <strong>of</strong>fices to be broughtin under 1
from a d<strong>at</strong>e mutually agreed upon but by giving <strong>at</strong> least threemonth's notice by either side.,.I(ii)On all other aspects where the above articles <strong>of</strong> <strong>understanding</strong>are silent, or for special cases <strong>of</strong> devi<strong>at</strong>ion from these articles,the mutually agreed upon decision <strong>between</strong> ERNET India andKVS will be final. However, in case <strong>of</strong> any dispute rel<strong>at</strong>ing to orarising out <strong>of</strong> this MOU, shall be resolved amicably by mutualconsult<strong>at</strong>ions. If such resolution is not possible, then, theunresolved dispute or difference shall be referred to thearbitr<strong>at</strong>ion <strong>of</strong> sole Arbitr<strong>at</strong>or to be appointed by Secretary,Department <strong>of</strong> Legal Affairs, Government <strong>of</strong> India. TheArbitr<strong>at</strong>ion Act <strong>of</strong> 1940 (10 <strong>of</strong> 1940) and Rules framedthereunder, as amended from time to time, shall be applicable tosuch arbitr<strong>at</strong>ion proceedings under this clause.
