Letter from Union Wide Organizing Committee Members

Dear Fellow SEIU-UHW Leader,It has now been 18 months since our local went into trusteeship and we want to bringyou up to date on where we are at and what we can expect in the future.This has been an extremely challenging time for all of us as members of SEIU-UHW.We lived through two years of chaos and disruption, organized by the former leaders,leading up to the trusteeship. And for the last 18 months, we’ve lived with the divisionand disruption that the former officials of our union have created in many of ourworkplaces after they formed a new organization, the National Union of HealthcareWorkers (NUHW).Nobody likes the fact that we are in trusteeship, but we needed the trusteeshipto straighten out the financial irregularities and anti-democratic activities of formerPresident Sal Rosselli and the other former officials of our union.Despite the intense efforts by Mr. Rosselli and the others to weaken and sabotage ourunion, we have made great strides in the past year-and-a-half:• We have negotiated dozens of strong contracts, providing raises and protectingwages and benefits for members despite the economy.UNITED HEALTHCAREWORKERS WESTSERVICE EMPLOYEESINTERNATIONALUNION, CLC• Our negotiations are led by member-elected and run bargaining teams that arebigger than ever, and we have a more direct role in bargaining than the staffdominatedway contracts were negotiated in the past. Rank and file members voteto ratify all agreements.• We have established a 300-member Union Wide Organizing Committee that meetsquarterly to set the direction of the local – a group that is nearly four times biggerthan the old Executive Board that was dominated by staff.• We have rebuilt our steward structure and we are increasing our strength in theworkplace.560 Thomas L. The new bylaws call for a 300-member Executive Board that cannotbe dominated by staff, and establish four elected rank-and-file Ethics Officers andfour elected rank-and-file Financial Officers to advise the board and guarantee thefinancial and ethical integrity of our union.• Nearly 95 percent of members who have faced decertification attempts by NUHWhave rejected them and chosen to stay united in SEIU-UHW.• Mr. Rosselli and the other former officials were found guilty by a federal jury oftrying to sabotage our union, misuse our dues, and violate our democratic rights,and they were ordered to pay us $1.57 million in damages.• As part of that lawsuit, we sued Mr. Rosselli and four other former officials to regaincontrol of our $22 million education and training fund. Federal Judge William Alsupruled in our favor and removed them from the Board of Trustees of the SEIU-UHW &Joint Employer Education Fund. SEIU staff and members are now on the board andrepresent our interests.

We can be proud of what we have accomplished given the activities by Mr. Rosselli and the other former officials ofour union that included misusing millions of our dues, stealing and destroying grievance and bargaining recordsneeded to protect members, removing $3 million from our strike fund, and outright canceling members’ contracts.But there is still more work to be done. Despite our progress, we have not yet overcome all of the negative effectsleft behind by the former leaders’ undemocratic activities and their continued attempts to destabilize our collectivebargaining relationships and put us at risk in the workplace. We still need to protect members at Kaiser and dozens ofother hospitals and nursing homes from NUHW decertification attempts. We need to finish our campaign in Fresnowhere the county is threatening to cut home care members’ wages to $8 an hour. And we are locked in a major fightover Gov. Arnold Schwarzenegger’s proposed budget, which would wipe out half of the state home care programand harm virtually every SEIU-UHW member and the people for whom we care.That’s why, as members of the Union Wide Organizing Committee, we support continuing the trusteeship so we winthese campaigns and finish the job of building the strongest union we have ever had. Trustee Dave Regan has sent aletter to SEIU President Mary Kay Henry advising her of our position and requesting that the trusteeship continue for awhile longer.In the meantime, we will prepare to put the bylaws to a vote of the membership, and prepare for an election of newofficers and an executive board so we can emerge from trusteeship stronger than ever and more prepared to win abetter future for ourselves, our families, and the people we serve.P.S. from SEIU-UHW Trustee Dave Regan: Just as we were about to put this letter in the mail, we received aresponse from SEIU President Mary Kay Henry. She has agreed with our assessment and set a time frame calling forus to emerge from trusteeship no later than March 2011.
