REP11/CF 7PROPOSED DRAFT MAXIMUM LEVEL FOR TOTAL AFLATOXINS IN DRIED FIGS(Agenda Item 7) 1144. The Delegati<strong>on</strong> <strong>of</strong> Turkey, as Chair <strong>of</strong> the electr<strong>on</strong>ic Work<strong>in</strong>g Group <strong>on</strong> Dried Figs,<strong>in</strong>troduced the document highlight<strong>in</strong>g the ma<strong>in</strong> issues associated with the establishment <strong>of</strong> theproposed maximum level <strong>of</strong> 10 µg/kg as laid down <strong>in</strong> work<strong>in</strong>g document CX/CF 11/43/7. Inparticular, the Delegati<strong>on</strong> <strong>in</strong>formed the <str<strong>on</strong>g>Committee</str<strong>on</strong>g> that the proposed ML ensures protecti<strong>on</strong> <strong>of</strong>c<strong>on</strong>sumers’ health while ensur<strong>in</strong>g fair trade practices as c<strong>on</strong>sumpti<strong>on</strong> <strong>of</strong> dried figs as such or as<strong>in</strong>gredients was lower than other products traded worldwide such as tree nuts for which the same levelhad been established. The Delegati<strong>on</strong> also highlighted that the proposed ML was based <strong>on</strong> theappropriate applicati<strong>on</strong> <strong>of</strong> the Code <strong>of</strong> Practice for the Preventi<strong>on</strong> and Reducti<strong>on</strong> <strong>of</strong> Aflatox<strong>in</strong>C<strong>on</strong>tam<strong>in</strong>ati<strong>on</strong> <strong>in</strong> Dried Figs (CAC/RC 65-2008)45. A delegati<strong>on</strong> while not opposed to the proposed ML for dried figs, suggested that <strong>in</strong> future the<str<strong>on</strong>g>Committee</str<strong>on</strong>g> should strictly apply the pr<strong>in</strong>ciple <strong>in</strong> the General Standard for C<strong>on</strong>tam<strong>in</strong>ants and Tox<strong>in</strong>s <strong>in</strong><strong>Food</strong> and Feed when agree<strong>in</strong>g to new work for establishment <strong>of</strong> MLs.46. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> noted that there was wide support for the proposed ML however somedelegati<strong>on</strong>s stated that it was not possible to agree with the proposed ML without hav<strong>in</strong>g full clarityabout the sampl<strong>in</strong>g plan. Other delegati<strong>on</strong>s also emphasized the importance <strong>of</strong> the sampl<strong>in</strong>g plans <strong>in</strong>view <strong>of</strong> the heterogeneous distributi<strong>on</strong> <strong>of</strong> aflatox<strong>in</strong>s <strong>in</strong> dried figs. This would <strong>in</strong> turn allow properenforcement <strong>of</strong> the ML. It was noted that the proposed ML represented a good balance between costbenefits <strong>of</strong> dried fig producti<strong>on</strong> and protecti<strong>on</strong> <strong>of</strong> human health.47. In additi<strong>on</strong>, some delegati<strong>on</strong>s, while not necessarily opposed to the proposed ML, questi<strong>on</strong>edwhether occurrence and process<strong>in</strong>g data should not also be gathered from other produc<strong>in</strong>g countriesso that the ML more accurately reflected current <strong>in</strong>dustry practices, and that c<strong>on</strong>sumpti<strong>on</strong> <strong>of</strong> dried figshad been <strong>in</strong>creased <strong>in</strong> certa<strong>in</strong> countries especially am<strong>on</strong>g certa<strong>in</strong> populati<strong>on</strong> groups like children. Adelegati<strong>on</strong> also questi<strong>on</strong>ed whether the proposed ML accurately reflected good implementati<strong>on</strong> <strong>of</strong> theCode <strong>of</strong> Practice and whether the term “dried figs” covered all types <strong>of</strong> dried figs or <strong>on</strong>ly ready-to-eatproduct.48. The Delegati<strong>on</strong> <strong>of</strong> Turkey highlighted that the sampl<strong>in</strong>g plan referred to <strong>in</strong> CX/CF 11/5/7 wasalready <strong>in</strong> use for many years <strong>in</strong> European countries.49. The Delegati<strong>on</strong> <strong>of</strong> Turkey <strong>in</strong>dicated that the country accounts for the major porti<strong>on</strong> <strong>of</strong> theworld market <strong>in</strong> trade <strong>of</strong> dried figs and that other major produc<strong>in</strong>g countries that had participated <strong>in</strong>the work<strong>in</strong>g group had not provided data that could give rise to lower MLs and had neither disagreedwith the proposed ML. In this regard, it was po<strong>in</strong>ted out a similar situati<strong>on</strong> applied to theestablishment <strong>of</strong> MLs for tree nuts where data <strong>on</strong> different nuts were ma<strong>in</strong>ly based <strong>on</strong> data providedby <strong>on</strong>e or a few major produc<strong>in</strong>g countries. The Delegati<strong>on</strong> noted that provisi<strong>on</strong>s <strong>in</strong> the COP had been<strong>in</strong> place for a l<strong>on</strong>g time <strong>in</strong> Turkey even before the Code was adopted by <str<strong>on</strong>g>Codex</str<strong>on</strong>g>. The Delegati<strong>on</strong>clarified that the term “dried figs” applied to “ready-to-eat” product <strong>in</strong> l<strong>in</strong>e with the decisi<strong>on</strong> <strong>of</strong> thelast sessi<strong>on</strong> <strong>of</strong> the <str<strong>on</strong>g>Committee</str<strong>on</strong>g>, this be<strong>in</strong>g the major form <strong>of</strong> dried figs traded worldwide. As regardsthe need for accompany<strong>in</strong>g sampl<strong>in</strong>g plans, the Delegati<strong>on</strong> expla<strong>in</strong>ed that sampl<strong>in</strong>g plans were closelyl<strong>in</strong>ked to the ML therefore there should first be agreement with the proposed ML before pursu<strong>in</strong>g adevelopment <strong>of</strong> sampl<strong>in</strong>g plans although reference was made <strong>in</strong> the work<strong>in</strong>g document to sampl<strong>in</strong>gplans. The Delegati<strong>on</strong> agreed that sampl<strong>in</strong>g plans would be described and justified together with theproposed level for c<strong>on</strong>siderati<strong>on</strong> by the next sessi<strong>on</strong> <strong>of</strong> the <str<strong>on</strong>g>Committee</str<strong>on</strong>g>.Status <strong>of</strong> the Proposed Draft Maximum Level for Total Aflatox<strong>in</strong>s <strong>in</strong> Dried Figs50. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> agreed to return the Proposed Draft Maximum Level for Dried Figs to Step2/3 so that the sampl<strong>in</strong>g plans accord<strong>in</strong>g to the proposed ML <strong>of</strong> 10 µg/kg can be developed for11CX/CF 11/5/7.
