What is the hierarchical system or Administrative order of the company to dealwith the environmental issues and for ensuring compliance with the ECconditions. Details of this system may be given.46. Does the company have a system of reporting of non compliance / violations ofenvironmental norms to the Board of Directors of the company and / orshareholders or stakeholders at large? This reporting mechanism should bedetailed in the EIA report.47. Any litigation pending against the project and/or any direction/order passed byany Court of Law against the project, if so, details thereof.48. Public hearing to be conducted and issues raised and commitments made by theproject proponent on the same should be included in EIA/EMP Report in the formof tabular chart with financial budget for complying with the commitments made.49. A tabular chart with index for point wise compliance of above TORs.The following general points shall be noted:i. All documents shall be properly indexed, page numbered.ii. Period/date of data collection shall be clearly indicated.iii. Authenticated English translation of all material provided in Regionallanguages.iv. The letter/application for EC shall quote the MOEF file No. and also attach acopy of the letter.v. The copy of the letter received from the Ministry shall be also attached as anannexure to the final EIA-EMP Report.
vi.vii.The final EIA-EMP report submitted to the Ministry must incorporate the issuesin this letter. The index of the final EIA-EMP report must indicate the specificchapter and page no. of the EIA-EMP Report.Certificate of Accreditation issued by the QCI to the environmental consultantshall be included.The Committee prescribed the above ToRs for preparation of EIA/EMP reports.The proponent should prepare EIA/EMP Report based on the above TORs and submitthe same to the State Pollution Control Board for conducting public hearing/consultation.The EIA/EMP Report should be as per the generic structure given in Appendix-III of EIANotification, 2006. The concerns raised alongwith the replies during the Public Hearing/Consultation should be incorporated in the EIA/EMP Report and the final EIA/EMPsubmitted to the Ministry for obtaining environmental clearance.
