Does the company have a system of reporting of non compliance / violations ofenvironmental norms to the Board of Directors of the company and / orshareholders or stakeholders at large? This reporting mechanism should bedetailed in the EIA report.42. Any litigation pending against the project and/or any direction/order passed byany Court of Law against the project, if so, details thereof.43. Public hearing issues raised and commitments made by the project proponent onthe same should be included separately in EIA/EMP Report in the form of tabularchart with financial budget for complying with the commitments made.44. A tabular chart with index for point wise compliance of above TORs.The following general points shall be noted:i. All documents shall be properly indexed, page numbered.ii. Period/date of data collection shall be clearly indicated.iii. Authenticated English translation of all material provided in Regional languages.iv. The letter/application for EC shall quote the MOEF file No. and also attach acopy of the letter.v. The copy of the letter received from the Ministry shall be also attached as anannexure to the final EIA-EMP Report.vi. The final EIA-EMP report submitted to the Ministry must incorporate the issues inthis letter. The index of the final EIA-EMP report must indicate the specificchapter and page no. of the EIA-EMP Report.vii. While preparing the EIA report, the instructions for the proponents andinstructions for the consultants issued by MoEF vide O.M. No. J-11013/41/2006-
IA.II (I) dated 4 th August, 2009, which are available on the website of this Ministryshall also be followed.viii. The consultants involved in the preparation of EIA/EMP report after accreditationwith Quality Council of India (QCl)/National Accreditation Board of Education andTraining (NABET) would need to include a certificate in this regard in theEIA/EMP reports prepared by them and data provided by otherorganization/Laboratories including their status of approvals etc. In this regard,circular no. J-11013/77/2004-IA II(I) dated 2 nd December, 2009 and 30 thSeptember, 2011 available on the Ministry’s website http://www.moef.nic.in maybe referred.ix. Certificate of Accreditation issued by the QCI to the environmental consultantshall be included.It was decided that TORs prescribed by the Expert Appraisal Committee(Industry) should be considered for preparation of EIA / EMP report for the abovementioned project in addition to all the relevant information as per the Generic Structureof EIA given in Appendix III and IIIA in the EIA Notification, 2006.The draft EIA/EMPreport should be submitted to the Gujarat Pollution Control Board for public hearing. Theissues emerged and response to the issues raised during should be incorporated in theEIA report. The final EIA/EMP report alongwith Certificate of Accreditation issued by theQCI should be submitted to the Ministry for obtaining environmental clearance.2.5.28. Synthetic Organic (Bulk Drugs & Intermediates) Manufacturing Unit (Phase-I 600kg/day, Phase-II 400 kg/day) at Sy. No. 113, Village Chennavelly, MandalBalanagr, District Mahaboob Nagar, Andhra Pradesh by M/s Creative Organics.(TOR)The project authorities and their consultant (Team Labs and Consultants) gave adetailed presentation on the salient features of the project and proposed environmentalprotection measures to be undertaken alongwith the draft Term of References for thepreparation of EIA/EMP.All Synthetic Organic Chemicals Industry (Bulk Drugs &Intermediates) located outside the notified industrial area/estate are listed at S.N. 5(f)under category ‘A’ and appraised at Central level.M/s Creative Organics has proposed for setting up of Synthetic Organic (BulkDrugs & Intermediates) Manufacturing unit at Sy. No. 113, Village Chennavelly, mandalBalanagr, District Mahaboob Nagar, Andhra Pradesh.Total plot area is 9.625 acres.Project cost is Rs. 5.0 crores. No forest land is involved.
