equests, ong>theong> nationality of ong>theong> person claimed, ong>theong> possibility of subsequent extradition toanoong>theong>r state, and oong>theong>r circumstances.Article 27(1) If ong>theong> extradition is requested by a foreign state from anoong>theong>r foreign state and ong>theong>person claimed would have to be escorted through ong>theong> territory of Montenegro, transitmay be granted by ong>theong> Minister upon ong>theong> letter rogatory by ong>theong> requesting state providedthat ong>theong> person concerned is not a national of Montenegro and that ong>theong> extradition is notenforced for political or military criminal offence.(2) Letter rogatory for transit of ong>theong> person through ong>theong> territory of Montenegro shallcontain ong>theong> information and documents referred to in Article 15 paragraph 3 of thisLaw.(3) In ong>theong> case of transit of ong>theong> person through ong>theong> territory of Montenegro by air transit, ifno landing is expected, it shall not be necessary to obtain permit referred to inparagraph 1 above.(4) The requesting state shall notify ong>theong> Ministry of transit referred to in paragraph 3 above.The notification shall contain information such as: ong>theong> name of ong>theong> person escortedthrough ong>theong> territory of Montenegro, ong>theong> state to which ong>theong> person is extradited, ong>theong>criminal offence for which ong>theong> person is extradited, and ong>theong> time of air transit.Article 28(1) At ong>theong> request of ong>theong> requesting state, ong>theong> competent court shall seize and surrender, inaccordance with ong>theong> domestic ong>lawong>, items which may serve as evidence materials or thatresulted from ong>theong> commission of criminal offence.(2) The items referred to in paragraph 1 above shall be surrendered even in case when analready approved extradition may not be enforced due to ong>theong> death or escape of ong>theong>person claimed.(3) If ong>theong> items referred to in paragraph 1 above are subject to seizure or confiscation in ong>theong>territory of Montenegro, ong>theong>y may be temporarily retained or surrendered provided thatong>theong>y are returned in connection with ong>theong> ongoing criminal proceedings.(4) The items referred to in paragraph 1 above, to which Montenegro and third personshave rights, shall be returned to Montenegro as soon as possible after ong>theong> hearing iscompleted. The costs of returning of items shall be borne by ong>theong> requesting state.Article 29(1) The person for ong>theong> extradition of whom ong>theong> foreign state submitted ong>theong> letter rogatory ifong>theong> conditions for extradition prescribed by this Law have been met may be extraditedwithin a summary procedure if ong>theong> person claimed consented.(2) The consent referred to in paragraph 1 above shall be entered for ong>theong> record before acompetent court in accordance with ong>theong> Criminal Procedure Code, in a way ensuringthat ong>theong> consent has been given voluntarily and that ong>theong> person claimed has been awareof all consequences of such consent when ong>theong> consent was given. The consent oncegiven cannot be revoked.(3) The decision on extradition in a summary procedure shall be passed by a competentcourt.

(4) The court shall notify without delay ong>theong> Ministry about ong>theong> decision referred to inparagraph 3 of this Article, and ong>theong> Ministry shall inform ong>theong> requesting state.(5) The extradition within a summary procedure shall have ong>theong> same force and effect as ong>theong>extradition within an ordinary procedure.Article 30The costs of extradition incurred outside ong>theong> territory of Montenegro shall be incurredby ong>theong> requesting state.Article 31(1) If criminal proceedings are underway in Montenegro against a person located in aforeign state or if ong>theong> person located in a foreign state has been sentenced by acompetent Montenegrin court, ong>theong> Minister may submit ong>theong> letter rogatory forextradition.(2) The letter rogatory shall be submitted to ong>theong> requested state through diplomaticchannels and it shall be accompanied by documents and information referred to inArticle 15 of this Law.Article 32(1) If ong>theong>re is danger that ong>theong> person claimed will flee or hide, ong>theong> Minister may request toorder to detain that person temporarily or to undertake oong>theong>r measures required toprevent his escape even before ong>theong> actions are taken in accordance with Article 31 ofthis Law.(2) The letter rogatory for temporary detention shall contain specifically ong>theong> information onong>theong> identity of ong>theong> person claimed, ong>theong> name of ong>theong> criminal offence for which ong>theong>extradition is requested, indictment, verdict or detention order, date, place and name ofong>theong> authority ordering detention, and/or information about ong>theong> validity of verdict, aswell as ong>theong> statement that ong>theong> extradition shall be requested through regular channels.Article 33(1) If ong>theong> person claimed is extradited, he may be criminally prosecuted and/or ong>theong>punishment may be enforced against him only for ong>theong> criminal offence for which ong>theong>extradition has been granted.(2) If ong>theong> person referred to in paragraph 1 above has been convicted finally and in alegally binding manner by ong>theong> competent Montenegrin court for oong>theong>r criminaloffences committed prior to extradition with regard to which extradition is not allowed,ong>theong> provisions of ong>theong> Criminal Procedure Code regulating ong>theong> reversal of verdictwithout retrial shall apply mutatis mutandis.(3) If ong>theong> extradition has been granted under certain conditions with respect to ong>theong> type orduration of sanction which may be imposed and/or enforced and if it has been acceptedunder such conditions, ong>theong> court shall be bound by such conditions when pronouncinga sentence; while if ong>theong> enforcement of an already imposed sentence is ong>theong> subject ofong>theong> extradition, ong>theong> court adjudicating in ong>theong> highest instance shall reverse ong>theong> verdictand impose ong>theong> punishment in accordance with ong>theong> conditions of extradition.

<strong>on</strong>go<strong>in</strong>g crim<strong>in</strong>al proceed<strong>in</strong>gs.(4) The items referred to <strong>in</strong> paragraph 1 above, to which M<strong>on</strong>tenegro and third pers<strong>on</strong>shave rights, shall be returned to M<strong>on</strong>tenegro as so<strong>on</strong> as possible after <str<strong>on</strong>g>the</str<strong>on</strong>g> hear<strong>in</strong>g iscompleted.
