Article 18(1) Upon hearing ong>theong> state prosecutor and ong>theong> defence attorney, ong>theong> investigating judgeshall undertake oong>theong>r actions, if necessary, to determine if ong>theong> conditions for extradition and/orsurrender of ong>theong> items on which or by which ong>theong> criminal offence was committed, if ong>theong>se hadbeen confiscated from ong>theong> person claimed, are fulfilled.(2) After ong>theong> actions referred to in paragraph 1 above have been completed, ong>theong>investigating judge shall deliver ong>theong> case files to ong>theong> competent Chamber along with hisopinion.(3) If ong>theong> criminal proceedings are underway before a domestic court against ong>theong> personclaimed for ong>theong> same or anoong>theong>r criminal offence, ong>theong> investigating judge shall note that in ong>theong>case files.Article 19(1) If ong>theong> Chamber of ong>theong> competent court finds that ong>theong> conditions for extraditionprescribed by this Law have not been met, it shall make a decision to reject ong>theong> letter rogatoryfor extradition.(2) The order referred to in paragraph 1 above shall be submitted by ong>theong> court ex officiodirectly to ong>theong> higher court which may confirm, repeal or reverse ong>theong> decision after it hears ong>theong>state prosecutor.(3) If ong>theong> person claimed is held in detention, ong>theong> Chamber of ong>theong> competent court maydecide that he remain in detention until ong>theong> decision rejecting his extradition becomes final andlegally binding.(4) Final and legally binding decision rejecting ong>theong> extradition shall be submitted to ong>theong>Ministry which shall inform ong>theong> requesting state ong>theong>reof.Article 20(1) If ong>theong> Chamber of ong>theong> competent court finds that ong>theong> conditions for extraditionprescribed by this Law are met, it shall confirm this by passing a decision.(2) The person claimed shall have right to complain against ong>theong> decision referred to inparagraph 1 above directly to ong>theong> court of higher instance within three days after ong>theong> receiptong>theong>reof.Article 21If ong>theong> court of second instance confirms ong>theong> decision referred to in Article 20 above, orif ong>theong> complaint has not been lodged against ong>theong> decision of ong>theong> court of first instance, ong>theong> caseshall be delivered to ong>theong> minister competent for judiciary (hereinafter referred to as ong>theong>Minister), in order to make decision wheong>theong>r to grant extradition.Article 22(1) In ong>theong> event referred to in Article 21 above, ong>theong> Minister shall pass ong>theong> decision granting orrefusing ong>theong> extradition.(2) When he grants ong>theong> extradition, ong>theong> Minister may make a decision to postpone ong>theong>extradition because criminal proceedings are underway before a domestic court for anoong>theong>rcriminal offence against ong>theong> person claimed or because this person is serving ong>theong>imprisonment sentence in Montenegro.

(3) The Minister shall not grant ong>theong> extradition of ong>theong> person who enjoys ong>theong> right of asylum inMontenegro or where it can be reasonably assumed that ong>theong> person claimed shall besubjected to prosecution or punishment because of his race, religion, nationality, belongingto a specific social group or for his political beliefs, or that his status would be made moredifficult for one of ong>theong>se reasons.(4) The Minister shall refuse ong>theong> extradition if ong>theong> person claimed has not been given ong>theong>possibility to have a defence attorney in ong>theong> criminal proceedings preceding ong>theong>extradition.Article 23(1) In ong>theong> decision granting ong>theong> extradition, ong>theong> Minister shall state that without ong>theong> consentof Montenegro:1) ong>theong> person claimed may not be prosecuted for anoong>theong>r criminal offence committed priorto ong>theong> extradition;2) ong>theong> punishment for anoong>theong>r criminal offence committed prior to ong>theong> extradition cannotbe enforced against ong>theong> person claimed;3) a punishment more severe than ong>theong> one to which he has been sentenced cannot beenforced against ong>theong> person claimed;4) ong>theong> person claimed may not be extradited to a third state for prosecution for a criminaloffence committed prior to ong>theong> extradition which has been granted.(2) Additionally to ong>theong> conditions referred to in paragraph 1 above, ong>theong> Minister may alsoimpose oong>theong>r conditions for extradition.Article 24(1) The requesting state shall be notified of ong>theong> decision concerning extradition throughdiplomatic channels.(2) The decision granting extradition shall be submitted to ong>theong> administration authoritycompetent for police affairs which shall escort ong>theong> person claimed to ong>theong> bordercrossing where at an agreed place he will be surrendered to ong>theong> authorities of ong>theong>requesting state.Article 25(1) The requesting state shall take over ong>theong> person ong>theong> extradition of whom has beengranted within 30 days as of ong>theong> date of delivery of ong>theong> decision on extradition.(2) The Minister may extend ong>theong> deadline referred to in paragraph 1 above for additional 15days upon reasoned request of ong>theong> requesting state.(3) If ong>theong> person ong>theong> extradition of whom has been granted has not been taken over uponong>theong> expiry of ong>theong> deadline referred to in paragraphs 1 and 2 above, he shall beimmediately released, and ong>theong> Minister may refuse repeat extradition request for ong>theong>same criminal offence.Article 26If ong>theong> extradition of ong>theong> same person is requested by more than one country, eiong>theong>r forong>theong> same offence or for different offences, ong>theong> decision shall be taken having regard toseriousness of ong>theong> criminal offences, ong>theong> place of commission, ong>theong> respective dates of ong>theong>

(3) The M<strong>in</strong>ister shall not grant <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> who enjoys <str<strong>on</strong>g>the</str<strong>on</strong>g> right of asylum <strong>in</strong>M<strong>on</strong>tenegro or where it can be reas<strong>on</strong>ably assumed that <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed shall besubjected to prosecuti<strong>on</strong> or punishment because of his race, religi<strong>on</strong>, nati<strong>on</strong>ality, bel<strong>on</strong>g<strong>in</strong>gto a specific social group or for his political beliefs, or that his status would be made moredifficult for <strong>on</strong>e of <str<strong>on</strong>g>the</str<strong>on</strong>g>se reas<strong>on</strong>s.(4) The M<strong>in</strong>ister shall refuse <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> if <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed has not been given <str<strong>on</strong>g>the</str<strong>on</strong>g>possibility to have a defence attorney <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al proceed<strong>in</strong>gs preced<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g>extraditi<strong>on</strong>.Article 23(1) In <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> grant<strong>in</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>ister shall state that without <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>sentof M<strong>on</strong>tenegro:1) <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed may not be prosecuted for ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r crim<strong>in</strong>al offence committed priorto <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong>;2) <str<strong>on</strong>g>the</str<strong>on</strong>g> punishment for ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r crim<strong>in</strong>al offence committed prior to <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> cannotbe enforced aga<strong>in</strong>st <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed;3) a punishment more severe than <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>e to which he has been sentenced cannot beenforced aga<strong>in</strong>st <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed;4) <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed may not be extradited to a third state for prosecuti<strong>on</strong> for a crim<strong>in</strong>aloffence committed prior to <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> which has been granted.(2) Additi<strong>on</strong>ally to <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s referred to <strong>in</strong> paragraph 1 above, <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>ister may alsoimpose o<str<strong>on</strong>g>the</str<strong>on</strong>g>r c<strong>on</strong>diti<strong>on</strong>s for extraditi<strong>on</strong>.Article 24(1) The request<strong>in</strong>g state shall be notified of <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> c<strong>on</strong>cern<strong>in</strong>g extraditi<strong>on</strong> throughdiplomatic channels.(2) The decisi<strong>on</strong> grant<strong>in</strong>g extraditi<strong>on</strong> shall be submitted to <str<strong>on</strong>g>the</str<strong>on</strong>g> adm<strong>in</strong>istrati<strong>on</strong> authoritycompetent for police affairs which shall escort <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed to <str<strong>on</strong>g>the</str<strong>on</strong>g> bordercross<strong>in</strong>g where at an agreed place he will be surrendered to <str<strong>on</strong>g>the</str<strong>on</strong>g> authorities of <str<strong>on</strong>g>the</str<strong>on</strong>g>request<strong>in</strong>g state.Article 25(1) The request<strong>in</strong>g state shall take over <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> of whom has beengranted with<strong>in</strong> 30 days as of <str<strong>on</strong>g>the</str<strong>on</strong>g> date of delivery of <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> <strong>on</strong> extraditi<strong>on</strong>.(2) The M<strong>in</strong>ister may extend <str<strong>on</strong>g>the</str<strong>on</strong>g> deadl<strong>in</strong>e referred to <strong>in</strong> paragraph 1 above for additi<strong>on</strong>al 15days up<strong>on</strong> reas<strong>on</strong>ed request of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state.(3) If <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> of whom has been granted has not been taken over up<strong>on</strong><str<strong>on</strong>g>the</str<strong>on</strong>g> expiry of <str<strong>on</strong>g>the</str<strong>on</strong>g> deadl<strong>in</strong>e referred to <strong>in</strong> paragraphs 1 and 2 above, he shall beimmediately released, and <str<strong>on</strong>g>the</str<strong>on</strong>g> M<strong>in</strong>ister may refuse repeat extraditi<strong>on</strong> request for <str<strong>on</strong>g>the</str<strong>on</strong>g>same crim<strong>in</strong>al offence.Article 26If <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> same pers<strong>on</strong> is requested by more than <strong>on</strong>e country, ei<str<strong>on</strong>g>the</str<strong>on</strong>g>r for<str<strong>on</strong>g>the</str<strong>on</strong>g> same offence or for different offences, <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> shall be taken hav<strong>in</strong>g regard toseriousness of <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offences, <str<strong>on</strong>g>the</str<strong>on</strong>g> place of commissi<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> respective dates of <str<strong>on</strong>g>the</str<strong>on</strong>g>
