Article 16(1) The M<strong>in</strong>istry shall deliver letter rogatory for <str<strong>on</strong>g>the</str<strong>on</strong>g> extraditi<strong>on</strong> to <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>vestigat<strong>in</strong>gjudge of <str<strong>on</strong>g>the</str<strong>on</strong>g> court with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> jurisdicti<strong>on</strong> of which <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed resides or with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>jurisdicti<strong>on</strong> of which <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed happens to be.(2) If <str<strong>on</strong>g>the</str<strong>on</strong>g> domicile or residence of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed is unknown, his domicile orresidence shall be established through <str<strong>on</strong>g>the</str<strong>on</strong>g> state adm<strong>in</strong>istrati<strong>on</strong> authority competent for affairsrelat<strong>in</strong>g to domicile and residence.(3) If <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory was submitted <strong>in</strong> accordance with Article 15 above, <str<strong>on</strong>g>the</str<strong>on</strong>g><strong>in</strong>vestigat<strong>in</strong>g judge shall issue <str<strong>on</strong>g>the</str<strong>on</strong>g> order to deta<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed, if <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a danger that<str<strong>on</strong>g>the</str<strong>on</strong>g> will avoid <str<strong>on</strong>g>the</str<strong>on</strong>g> procedure of extraditi<strong>on</strong>, or if o<str<strong>on</strong>g>the</str<strong>on</strong>g>r reas<strong>on</strong>s referred to <strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Crim<strong>in</strong>alProcedure Code exist, and/or he shall undertake o<str<strong>on</strong>g>the</str<strong>on</strong>g>r measures to ensure his presence, unlessit is obvious from <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory and delivered <strong>in</strong>formati<strong>on</strong> and documents that <str<strong>on</strong>g>the</str<strong>on</strong>g>c<strong>on</strong>diti<strong>on</strong>s for extraditi<strong>on</strong> have not been met.(4) Detenti<strong>on</strong> referred to <strong>in</strong> paragraph 3 above may last until <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> <strong>on</strong> extraditi<strong>on</strong>is enforced at latest but no l<strong>on</strong>ger than six m<strong>on</strong>ths.(5) Up<strong>on</strong> a reas<strong>on</strong>ed request of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state, <str<strong>on</strong>g>the</str<strong>on</strong>g> Chamber of <str<strong>on</strong>g>the</str<strong>on</strong>g> competent courtmay extend <str<strong>on</strong>g>the</str<strong>on</strong>g> durati<strong>on</strong> of detenti<strong>on</strong> referred to <strong>in</strong> paragraph 3 above <strong>in</strong> justified cases foradditi<strong>on</strong>al two m<strong>on</strong>ths.(6) The <strong>in</strong>vestigat<strong>in</strong>g judge shall, after he establishes <str<strong>on</strong>g>the</str<strong>on</strong>g> identity of <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed,<strong>in</strong>form him without delay why and based <strong>on</strong> which evidence his extraditi<strong>on</strong> is requested and<str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>vestigat<strong>in</strong>g judge shall ask him to present his defence.(7) The record shall be made of exam<strong>in</strong>ati<strong>on</strong> and present<strong>in</strong>g of defence. The<strong>in</strong>vestigat<strong>in</strong>g judge shall be obliged to <strong>in</strong>form <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed immediately that he mayengage a defence attorney, or that a defence attorney ex officio may be appo<strong>in</strong>ted for him if <str<strong>on</strong>g>the</str<strong>on</strong>g>defence is mandatory for <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al offence <strong>in</strong> questi<strong>on</strong> pursuant to <str<strong>on</strong>g>the</str<strong>on</strong>g> Crim<strong>in</strong>al ProcedureCode.Article 17(1) Detenti<strong>on</strong> aimed at extraditi<strong>on</strong> may be ordered under c<strong>on</strong>diti<strong>on</strong>s referred to <strong>in</strong>Article 15 of this Law even before <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory of <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state is received, ifrequested by it, or if <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a grounded suspici<strong>on</strong> that <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed committed <str<strong>on</strong>g>the</str<strong>on</strong>g>crim<strong>in</strong>al offence for which he can be extradited to <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state.(2) Investigat<strong>in</strong>g judge shall release <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed when <str<strong>on</strong>g>the</str<strong>on</strong>g> reas<strong>on</strong>s for detenti<strong>on</strong>term<strong>in</strong>ate or if <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory has not been submitted with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> period of time hedeterm<strong>in</strong>ed while tak<strong>in</strong>g <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong> all circumstances, and which cannot exceed 40days from <str<strong>on</strong>g>the</str<strong>on</strong>g> date of detenti<strong>on</strong>. The detenti<strong>on</strong> ordered pursuant to paragraph 1 above may berevoked if <str<strong>on</strong>g>the</str<strong>on</strong>g> letter rogatory has not been submitted with<strong>in</strong> 18 days from <str<strong>on</strong>g>the</str<strong>on</strong>g> date of deta<strong>in</strong><strong>in</strong>g<str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> claimed.(3) The M<strong>in</strong>istry shall <strong>in</strong>form <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state about <str<strong>on</strong>g>the</str<strong>on</strong>g> deadl<strong>in</strong>es determ<strong>in</strong>ed by <str<strong>on</strong>g>the</str<strong>on</strong>g><strong>in</strong>vestigat<strong>in</strong>g judge without delay. Without prejudice to <str<strong>on</strong>g>the</str<strong>on</strong>g> above, if <str<strong>on</strong>g>the</str<strong>on</strong>g>re are justifiedreas<strong>on</strong>s, <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>in</strong>vestigat<strong>in</strong>g judge may extend <str<strong>on</strong>g>the</str<strong>on</strong>g> durati<strong>on</strong> of detenti<strong>on</strong> for additi<strong>on</strong>al 30 days atmost, if requested by <str<strong>on</strong>g>the</str<strong>on</strong>g> request<strong>in</strong>g state.
