TRANSFER AND ASSUMING OF CRIMINAL PROSECUTIONArticle 34(1) If a foreigner whose place of residence is in a foreign state committed a criminaloffence in ong>theong> territory of Montenegro, that state can be surrendered ong>theong> criminal filesfor ong>theong> purpose of criminal prosecution and trial if ong>theong> foreign state does not object to it,without prejudice to ong>theong> conditions referred to in Article 11 of this Law.(2) Before passing ong>theong> decision to conduct investigation, ong>theong> decision to transfer criminalprosecution shall be taken by ong>theong> competent state prosecutor; and if ong>theong> decision waspassed prior to ong>theong> commencement of ong>theong> main hearing, ong>theong> decision to transfer criminalprosecution shall be taken by ong>theong> Chamber of ong>theong> competent court composed of threejudges.(3) The decision to transfer criminal prosecution may be taken for ong>theong> criminal offencespunishable by imprisonment for a term of up to ten years and for ong>theong> criminal offencesof jeopardising public traffic.(4) If ong>theong> victim is a national of Montenegro, ong>theong> transfer of criminal prosecution shall notbe allowed if ong>theong> victim opposes to it, unless a security for ong>theong> settlement of hisproperty ong>lawong> claim has been provided.(5) If ong>theong> accused is held in detention, it shall be requested from ong>theong> requested state throughong>theong> shortest possible means to inform ong>theong> competent Montenegrin authority withinfifteen days at latest wheong>theong>r it shall assume ong>theong> prosecution.Article 35The competent court or ong>theong> state prosecutor shall deliver ong>theong> letter rogatory for ong>theong>transfer of ong>theong> criminal prosecution accompanied with ong>theong> decision on ong>theong> transfer of criminalprosecution and ong>theong> case files to ong>theong> Ministry.The Ministry shall deliver ong>theong> letter rogatory for ong>theong> transfer of ong>theong> criminal prosecutionto ong>theong> competent authority of ong>theong> requested state, in accordance with Article 4 of this Law.Article 36(1) The request of ong>theong> requesting state for Montenegro to assume ong>theong> criminalprosecution of a national of Montenegro or a person whose residence is in Montenegro for ong>theong>criminal offence committed in ong>theong> requesting state, shall be delivered togeong>theong>r with ong>theong> files toong>theong> competent state prosecutor within ong>theong> jurisdiction of whom that person resides.(2) If ong>theong> property ong>lawong> claim has been lodged with ong>theong> competent authority of ong>theong>requesting state, action shall be undertaken as if it were presented to ong>theong> competent court.(3) The requesting state shall be informed of ong>theong> refusal to assume criminal prosecutionas well as of ong>theong> final and legally binding decision passed within ong>theong> criminal proceedings, inaccordance with Article 4 of this Law.

Article 37(1) If ong>theong> criminal prosecution has been assumed at ong>theong> letter of request referred to inArticle 36 of this Law, domestic ong>lawong> shall apply.(2) The ong>lawong> of ong>theong> foreign state shall apply in case when it is more favourable for ong>theong>accused.IV. ENFORCEMENT OF FOREIGN CRIMINAL VERDICTArticle 38(1) Competent Montenegrin court shall enforce final and legally binding criminalverdict of a foreign court if this has been prescribed under an international agreement or ifong>theong>re is reciprocity and if it imposes ong>theong> criminal sanction in accordance with ong>theong> domestic ong>lawong>.(2) In ong>theong> case referred to in paragraph 1 above, ong>theong> competent court shall pass ong>theong>decision within a Chamber composed of three judges without presence of ong>theong> parties.(3) Territorial jurisdiction of ong>theong> court shall be defined according to ong>theong> last place ofresidence of ong>theong> sentenced person in Montenegro and if ong>theong> sentenced person has neverreported his place of residence in Montenegro – according to ong>theong> place of birth. If ong>theong> sentencedperson neiong>theong>r has had his place of residence nor was born in Montenegro, ong>theong> Supreme Courtof Montenegro shall identify one of ong>theong> courts having subject-matter jurisdiction before whichong>theong> proceedings shall be conducted.(4) In ong>theong> operative part of ong>theong> verdict referred to in paragraph 2 of this Article, ong>theong>court shall insert full wording of ong>theong> operative part and ong>theong> name of ong>theong> court from ong>theong> verdictof ong>theong> foreign court and it shall pronounce ong>theong> sentence. In ong>theong> particulars of judgement, ong>theong>court shall state reasons it took into account in ong>theong> pronouncement of ong>theong> sanction and refer toong>theong> reasons of ong>theong> foreign court ong>theong> verdict of which is enforced.(5) State prosecutor and ong>theong> sentenced person or his defence attorney may lodge acomplaint against ong>theong> verdict.Article 39(1) If ong>theong> foreign court pronounced criminal sanction which is not prescribed by ong>theong>domestic ong>lawong>, ong>theong> competent Montenegrin court shall pronounce a criminal sanctionwhich is most similar to ong>theong> criminal sanction imposed by a foreign court by type andseverity.(2) In ong>theong> event referred to in paragraph 1 above, ong>theong> criminal sanction may not be moresevere than ong>theong> criminal sanction pronounced by a foreign court.Article 40The provisions of ong>theong> domestic ong>lawong> regulating pardon, amnesty and conditional releaseshall also apply to ong>theong> persons convicted by foreign criminal verdicts enforced in Montenegro.Article 41(1) A criminal verdict of a Montenegrin court may be enforced in a foreign state if this hasbeen prescribed under an international agreement or if ong>theong>re is reciprocity.(2) If ong>theong> foreign national convicted in Montenegro or if a competent authority authorizedby an international agreement submits a request to ong>theong> competent Montenegrin court for

<str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> to transfer crim<strong>in</strong>alprosecuti<strong>on</strong> shall be taken by transfer of crim<strong>in</strong>al prosecuti<strong>on</strong> shall notbe allowed if <str<strong>on</strong>g>the</str<strong>on</strong>g> victim opposes to it, unless a security for <str<strong>on</strong>g>the</str<strong>on</strong>g> settlement of hisproperty <str<strong>on</strong>g>law</str<strong>on</strong>g> claim has been provided.(5) If to<str<strong>on</strong>g>the</str<strong>on</strong>g> competent state prosecutor with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> jurisdicti<strong>on</strong> of whom that pers<strong>on</strong> resides.(2) If <str<strong>on</strong>g>the</str<strong>on</strong>g> property <str<strong>on</strong>g>law</str<strong>on</strong>g> claim has been lodged with <str<strong>on</strong>g>the</str<strong>on</strong>g> competent authority of <str<strong>on</strong>g>the</str<strong>on</strong>g>request<strong>in</strong>g state, acti<strong>on</strong> shall be undertaken as if it were presented to <str<strong>on</strong>g>the</str<strong>on</strong>g> competent court.(3) The request<strong>in</strong>g state shall be <strong>in</strong>formed of <str<strong>on</strong>g>the</str<strong>on</strong>g> refusal to assume crim<strong>in</strong>al prosecuti<strong>on</strong>as well as of <str<strong>on</strong>g>the</str<strong>on</strong>g> f<strong>in</strong>al and <strong>legal</strong>ly b<strong>in</strong>d<strong>in</strong>g decisi<strong>on</strong> passed with<strong>in</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> crim<strong>in</strong>al proceed<strong>in</strong>gs, <strong>in</strong>accordance with Article 4 of this Law.
