K. Lee, Datuk Dr. Yim Khai Kee, Dato’ Dr. A. Ratnanesan,Dato’ Dr. Lian Chin Boon, Mej. Jen. Dato’ Dr. Shukri Bin Hussain, Dr. T. Thurairatnam, and Dr. JaswantSingh.The Resolutions were as follow;Resolution 1: To resolve that the 69th MDA AGM be held over two (2) days, on the 25th (Friday) and26th (Saturday) of May 2012, from 2:00 pm to 5:00 pm, at the Borneo Convention Centre.Resolution 2: That the registration of members for the AGM be held on both days until the time ofelection.The House voted and adopted the above Resolutions by a show of hands.Item 4CONFIRMATION FROM THE HOUSEThe House confirmed that Honorary members are entitled to vote provided they are also registeredin Division 1 of the <strong>Dental</strong> Registrar according to the <strong>Dental</strong> Act 1971 according to Article VI Section3 subsection b. (iii).Item 5PROPOSALS FROM THE HOUSE1) That no lectures or workshops be held during the duration of the AGM sessions (proposed byDr. Noraini Alwi).2) That the legal advisor should be present for future AGMs or EGMs (proposed byDato’ Dr. A. Ratnanesan).3) That the Notice of Meeting should include both the time and venue (proposed by Dr. NorainiAlwi).4) That the AGM be held in one continuous session, that members cast their votes immediately afterregistration for the AGM and then only have the subsequent discussions on issues pertaining tothe AGM. The names are listed on pages 29 to 32 of the MDA <strong>Annual</strong> <strong>Report</strong> 2011/2012.Dr. Jaswant Singh proposed the acceptance of the above new members and was seconded byDr. Hu Chang LekThe House accepted and approved all the above mentioned new members.Item 12TO CONFIRM THE RE-ADMISSION OF ORDINARY MEMBERS WHOSE MEMBERSHIP (HAD)BEEN TERMINATED BY DEFAULTAs reported by the Honorary General Secretary, there were 50 ordinary members re-admitted whosemembership had been terminated by default.7


<strong>Annual</strong> <strong>Report</strong> 2012/2013Item 13TO CONFIRM THE MINUTES OF THE 68th ANNUAL GENERAL MEETING HELD ON 10th JUNE2011.Corrections to the Minutes;a) Dr. Noraini Alwi reported the printing error on page 5, Item 2.4., to be, The members registeredfor the first session of the AGM were as follows;b) Dr. Shalene Kereshanan reported that her name was not listed in the attendance of the firstsession of the AGM.c) Dr. Noraini Alwi reported the absence of the title for Item 8, to be, To consider matters arisingfrom the Open Dialogue.With no other corrections, the minutes was proposed passed by Dr. Lee Soon Boon and seconded byDr. Malliga VadivelooItem 14TO CONSIDER MATTERS ARISING FROM THE MINUTESa) Dr. Noraini Alwi sought an explanation for Item 9.3 d), on page 14, that is, which countries andwhat reciprocal arrangements between regional dental associations.Dr. Muzafar explained that the reciprocal arrangements are non-monetary and MDA memberswill be given the same registration fees applicable to members of respective dental associationsduring their conventions and trade exhibitions. The countries (regional dental associations) arelisted on page 25, Item 12.b) Dr. Noraini Alwi sought an explanation for Item 9.16, page 16, that is, the discrepancies betweenthe estimated amount of RM 300,000.00 collected and the actual amount of RM182,970.00collected as stated in the Wisma MDA report 2012.Dr. Lee Soon Boon highlighted that the RM 300,000.00 was an estimated collection and wasrecorded at that time in 2011, whereas the amount of RM 182,970.00 stated in the Wisma MDAreport is the actual audited collection dated currently in 2012.Dr. Muzafar announced that all the above can be verified in the Wisma MDA Board of Trustees<strong>Report</strong> 2012 on page 77 of the MDA <strong>Annual</strong> <strong>Report</strong> 2011/2012.c) Dr. Noraini Alwi sought an explanation to the three (3) Resolutions, in Item 13, on page 18.i) Resolution 1: The MDA-DPL Liaison Chairman Dr. Chow Kai Foo and Past President Dr.ShubonSinha Roy briefed the House, that MDA is the sole agent for DPL in Malaysia. The MDA’sresponsibility is to to collect the annual subscription from all DPL members and forward theamount to the DPL. The DPL provides an annual allocation to the MDA for education anddissemination of information to all MDA members concerning the management of patientcomplaints.ii) Resolution 2: Dr. Muzafar briefed the House that MDA does not have jurisdiction over theEnforcement Department of the Oral Health Division concerning the apprehending andprosecution of purveyors of illegal dentistry. The Director General of Health has asked MDAto notify him and his officers if the perpetrators could be identified so that immediate actioncan be taken.iii) Resolution 3: Dr. Chow Kai Foo briefed the House that the Director General of Health hasadvised the MDA to work with the Home Ministry and the Police in the issues of robberies indental clinics. Dentists could request their local police to conduct regular visits to their clinicsas a deterrent against robberies.8


<strong>Malaysian</strong> <strong>Dental</strong> <strong>Association</strong>Dr. Haja Badrudeen highlighted to the House that all the above mentionedResolutions were presented to the House during the 68th MDA AGM and were passed bythe House.Item 15 TO RECEIVE AND PASS THE ANNUAL REPORTS FOR 2011/201215.1 The President’s <strong>Report</strong> (page 22 to page 26)Corrections to the report;Dr. Muzafar noted the grammatical and typing errors for correction. The President’s <strong>Report</strong> wasproposed passed and seconded by Dr.Neoh Gim Bok and Dr.Malliga Vadiveloo respectively.Matters arising to the report;Page 23, Item 5, Continuing Professional Development: Dr. Kalaiarasu briefed the House, thatfor non-MDA affiliates, they must apply to the MDC directly for the awarding of CPD points.MDA affiliates can submit their application for CPD points via the MDA.Page 25, Item 13d, Amendments to the <strong>Dental</strong> Act: Dr. Muzafar clarified that the taskforcestated here was set up by the MDC to prepare a paper to justify the inclusion of dental nursesunder the <strong>Dental</strong> Act.15.2 The Honorary General Secretary’s <strong>Report</strong> (page 27 to page 38)Corrections to the report;a) Page 33, Re-admitted Members: no. 30 and no. 31 are of the same name.b) Page 35, <strong>Dental</strong> Tourism and Globalization Committee Chairman is Dato’ Dr. How KimChuan.c) Page 37, wording of Chairman, Scientific Program and Asst Chairman, ScientificProgram.With no other corrections, the Honorary General Secretary’s <strong>Report</strong> was proposed passed andseconded by Dato’ Dr. A. Ratnanesan and Dr Jaswant Singh respectively.Matters arising to the report;a) Dr. Chow briefed the House that 16 Committees consisted only of the Chairmen. This wasdue to a severe lack of volunteers for the various committees from our membership.b) Dr. Chow explained to the House that attendance for the 6th Council Meeting was leftblank in the <strong>Annual</strong> <strong>Report</strong> as the meeting was only held on 24th May 2012.c) Dr Noraini highlighted the poor attendance record of some Council members and calledfor Council members to attend as many council meetings as possible.9

Ratnanesan and Dr. Jaswant Singh respectively.Matters arising to the report;a) Page 53, item 10, Expenses On Conventions & Meetings, 68th MDA/AGM.Dr V Neduchelian enquired on the the high expenses for the 68th MDA AGM & InternationalScientific and Trade Exhibition amounting to RM1,200,000.00 held at KLCC. The Councilacknowledged that this was due to high rental rate and cost of promotional activities atKLCC.b) Page 46, Surplus For The Year After Taxation as at 31st Dec 2011.Dr Ng concurred to the suggestion by Dr. Noraini that the annual surplus could bedistributed out to benefit of members. However, to date, only 80% of the active membersare paying their annual subscription, thus, such a proposal is not feasible until MDAachieves 100% annual paid-up member subscriptions.c) Page 55, item 15, General Expenses, Donation.Dr. Ng Woan Tyng explained to the House that the donation of RM 12,276.00 is from MDANorthern Zone to the Wisma MDA Fund.d) Page 55, item 15, General Expenses, Legal & Professional Fees.Dr. Ng explained to the House that RM 12,833.00 were for the legal fees incurred inrespect of 68th MDA AGM, Constitutional Amendments and Arbitration services of anMDA Industrial Court case.e) Dr. Ng Woan Tyng also confirmed that the Letter of Intent by the Auditors to the MDAmeans that the auditors will assume full responsibility for all the accounting matters ofthe <strong>Association</strong>.f) Dr. Haja Badrudeen informed the House that Convention centres are built to caterto international standards and are constantly upgraded. This means that the cost ofthe facilities and services of convention centres will remain high and will continue toescalate.g) Dato’ Dr. Ratnanesan addressed the House that the use of KLCC during the 68th MDAInternational Scientific and Trade Exhibition was a trial platform for the coming 35th AsiaPacific <strong>Dental</strong> Congress 2013. The expenditure was high but MDA achieved the objectivesfor an international forum to be held in Malaysia that is compatible with other venues,such as in Manila, Hong Kong, Singapore and Taiwan.h) Page 55, item 15, General Expenses:Dr. Malliga Vadiveloo suggested that the sum of RM 66,922.00 for the depreciation ofassets should be included in the General Expenses and to be highlighted separately withan accounting note.10

She also proposed thatmembers involved in personal and character assassination should forward themselves forvolunteer work and even for elections and serve MDA Council.Dr. Badrudeen briefed the House that with IT facilities many tasks and communication can beaccomplished even without the physical presence of the person.Item 20 The MDA Foundation <strong>Report</strong> (page 80 to page 93)The Chairman of the Foundation, Dato’ Dr. Lim Chee Shin briefed the House on the history ofthe Foundation which began in 1974, its activities and current progress. <strong>Malaysian</strong> <strong>Dental</strong> <strong>Association</strong>Item 27The Proposed Amendments To The MDA ConstitutionAs there were insufficient registered members present to establish a quorum, the Chairman Dr Muzafarannounced that the proposed amendment, that is, Article VI, Section 1 : Types of Membership, Subsectionc, Life Membership to the MDA Constitution to be deferred to the next AGM.Dato’ Dr. A Ratnanesan, the Chairman to the Constitution Amendment Committee, concurred to theabove decision for deferment to the next 70th MDA AGM.Item 28 The Wisma MDA Board of Trustees <strong>Report</strong> (page 77 to page 79)Dato’ Dr. A. Ratnanesan said the statement, “Tax Exemption status has been obtained from theMinistry of Finance” was incorrect since there is no official letter from the Ministry of Finance yet,and therefore sought clarification from Dato’ Dr. How Kim Chuan.Dato’ Dr. How clarified that on the 2nd March 2012, the Ministry of Health conveyed the message byphone that The Honorable Health Minister YB Dato’ Seri Liow Tiong Lai had secured a RM 10 millionTax Exemption status from the Ministry of Finance for the MDA. It was in anticipation that the MDAwould receive the Tax Exemption Letter from the Ministry of Finance towards the end of May thatresulted in the statement.Dato’ Ratnanesan suggested that since it was a verbal assurance from The Health Minister without aletter, it is technically incorrect to report this to have been already achieved. Dato’ Dr. How acceptedthe suggestion and will therefore make the necessary amendments.Dr. Noraini Alwi then accused Dato’ Dr. How of gross misrepresentation of the conversation betweenhim and the Health Minister, lying on the issue of the Tax Exemption Status, and mischief in thewording of the report.Dato’ Dr. How cautioned that there should be no personal attacks and disrespect of the office bearers.Though he agreed with Dato’ Dr. Ratnanesan that there was an oversight in the report, it did notequate to dishonesty, mischief and misrepresentation as suggested by Dr. Noraini Alwi. Therefore,Dato’ Dr.How called for the Board of Inquiry to look into the matter as she had abused the proceduresof the AGM and degraded the integrity of the office bearers.Corrections to the report:Page 77, What we have achieved to date : To delete the entire sentence of no. 2, and to add a newsentence as no. 4, to What needed to be done, that is, To follow-up to obtain tax exemption statusfrom The Ministry of Finance.The above correction was proposed by Dato’ Dr. A. Ratnanesan and seconded by Dr. Shubon SinhaRoy.The above report was adopted and the house passed the report.Matters arising in the report:During the queries raised by Dr. Noraini Alwi and Dr. Shubon Sinha Roy, some harsh words andaccusations were made, which were immediately cautioned by Dato’ Dr. How.Dato’ Dr. How briefed the House on the following matters:a) That all taxes paid to date will be refunded by the government, once the tax exemption status isobtained.17

<strong>Annual</strong> <strong>Report</strong> 2012/2013PRESIDENT’S REPORTThe <strong>Malaysian</strong> <strong>Dental</strong> <strong>Association</strong> has once again achieved an active year. The hot topics for years 2012-2013were the New <strong>Dental</strong> Bill 2013 and the organising of 35th Asia Pacific <strong>Dental</strong> Congress in Kuala Lumpur.Advocacy on behalf of members has required considerable resources, both in time and personnel. MDA Councilwhile addressing the <strong>Dental</strong> Bill 2013 was involved in the long process of discussions and consultations both withinthe profession and with the Ministry of Health Malaysia where MDA has recommended detailed amendments tosome provisions in the new <strong>Dental</strong> Bill to bring about some significant changes to our practice of dentistry.The <strong>Association</strong> continues to liaise and work with various other bodies such as Oral Health Division of MinistryOf Health , MDA Affiliate <strong>Association</strong>s, the Ministry of Defence Malaysia, MyCEB, The Academy of Medicine ofMalaysia , FDI World <strong>Dental</strong> Federation, Asia Pacific <strong>Dental</strong> Federation to name a few.I have found my time as President a wonderful opportunity to be involved in the governance of our associationand to continue in the tradition of many before me in giving a voice to the profession. I’m most grateful for thesupport of my Council, the Secretariat staffs and the various Chairperson of Sub Committee’s who have assistedme in running the business of <strong>Association</strong>. It was a privilege to serve MDA as the President and I thank memberswho have volunteered their services.I have met some wonderful people and explored many aspects of the Profession previously unknown to me. Ithas been a great honour and a privilege. I will pass on the mantle of governance to a great Council with broadexperience and diversity of backgrounds. We have a strong balance sheet and a strong Council to manage it.It is with great pleasure that I present this summary of MDA activities during the MDA Council term 2012-2013.<strong>Dental</strong> Protection LimitedThe MDA met the representatives of the DPL duringthe FDI <strong>Annual</strong> World <strong>Dental</strong> Congress Hong Kong inAugust 2012. The MDA was represented by Dr. ChowKai Foo and his team while the DPL was represented byDr. Kevin Lewis and team.MDA HomepageMDA Homepage continues to improve and innovate toserve the increasing need of membership. For the year2012 we had 152,771 visits compared to 120,531 visitsfor 2011. We expect the traffic to continue to increaseyear by year.The discussion included allocations to the MDA,reinstatement of lapsed memberships, new schemesfor new dentists and sponsorship of a DPL speaker forthe APDC in KLCC Kuala Lumpur organized by the MDAin May 2013.22

<strong>Annual</strong> <strong>Report</strong> 2012/2013our Co-Sponsors had given to us, namely GSK andLotte.The 20th FDI/MDA Scientific Convention & Tradeexhibition was oversubscribed. 150 trade booths weresold out and more than 1200 participants and visitorsattended the convention and trade exhibition.The 35thAPDC which will be held in Kuala LumpurConvention Centre, from 7th to 12 May 2013, is the 4thAPDC event for MDA. This state of the art dental tradeand industry exhibition will truly be at the cuttingedge of dentistry. With about 250 booths it will displayto all participants and visitors the latest technologicaladvances in dentistry during APDC Kuala Lumpur inMay 2013.AwardsMDA would like to congratulate Professor Dato’ DrZainal Ariff bin Abdul Rahman who was conferredthe D.P.S.K. (Dato’ Paduka Setia Kelantan) through thegood office of MDA.On the other hand, Dr Kalaiarasu Peariasamy whois the Assistant Honorary General Secretary wasawarded KMN (Kesatria Mangku Negara) through thePublic Service. The award conferred upon him wastimely and appropriate as Dr Kalaiarasu has beenactively promoting children dental health both locallyand internationally. The MDA shares the joy of hisconferment.BIM and MSPCBoth BIM and MSPC was represented by our MDA PastPresident, Dr YS Tan. MDA suspended its membershipin BIM with a letter to its Honorary Secretary dated11th October 2012 due to series of contentious issues.This decision was taken following the advice from DrYS Tan to safe-guard the integrity and image of MDA asa respected professional association. With this action,MDA would stop payment of its annual subscription toBIM.The MSPC was incorporated in 2010 formed by BIM atthe behest of the <strong>Malaysian</strong> Ministry of InternationalTrade and Industry which covers both professional andnon professional service sectors.MITI was keen on the establishment of MSPC because,with the liberalization of the services sector under theASEAN Free Trade Agreement, the services sector wasprogressively being liberalized. The response was overwhelmingArmed ForcesThe <strong>Dental</strong> Services of the <strong>Malaysian</strong> Armed Forces(DSMAF) strives to be an active friend to the dentalfraternity of the country. Major General Dato’ Dr SukriHussin, the Director of <strong>Dental</strong> Services of the ArmedForces has made it a policy, encouraging all <strong>Dental</strong>Specialists and <strong>Dental</strong> Officers of DSMAF to be amember of the MDA.DSMAF will be the host of the Defence Force DentistryForum (DFDF), which is part of the Asia Pacific <strong>Dental</strong>Conference (APDC) of 2013. DFDF will be conductedon the 7th to 10th May 2013. DSMAF has been activelyinvolved in the promotion of DFDF/APDC 2013 bysending delegation to promote the above eventin Taiwan, Hong Kong, Philippines, Indonesia andThailand.Last but not least, the Armed Forces and MDA wereproud that Brigadier General Dato’ Dr Mohd IlhamHaron was elected as Chairman of Asia Pacific <strong>Dental</strong>Federation (APDF) Commission on Defence Forces in2012 at the 34th APDC which was held in Taiwan.Administrative and FinanceThe committee consisting of the principal officebearers, had convened on a few occasions over the pastyear to decide on financial matters of the <strong>Association</strong>as well as the running of the secretariat.Some upgrades and improvements had beencarried out and they were installation of new CCTVs,installation of fingerprint recognition system for24

The upgrade of the lecture hall is deemednecessary because secretariat continues to be utilizedfor ongoing CPD programs with an average turn-out of50-60 practitioners in any given lecture.Some of the affiliate associations have requestedthe secretariat address to be used for their mailingpurposes and this has been approved.Mr Lim Choong Hooi tendered his resignation in 2012.His dedication and long service is greatly appreciatedand will long be remembered. We wish him onlythe very best in his future undertakings. Two newstaff members have been added to the secretariat inview of the impending APDC, namely Ms. YugeswaryManoharan and Puan Zainon Suppian (6 monthcontract).An exercise was conducted to compile and refreshexisting financial policies and formulate new andupdated guidelines was performed. This includeadvertising costs in the MDA newsletter, MDA website,MDJ website; claim policies, email and postage costing,usage of the secretariat and others. This has greatlyreduced disputes and consequently also providedanother minor source of income for MDA in line withthe need to conduct CPD programs in collaborationwith MDA.Decisions were also made with regards to positioningour fixed deposits in higher yielding rates in differentbanks.Constitutional AmendmentsConstitutional Amendments are an important annualexercise in order to align the constitution towardsaddressing rising challenges both current and inthe foreseeable future. This is to enable the dentalprofession to remain vibrant and continue to berelevant and proactive towards serving the oral healthneeds of the nation and mankind.When the MDA Council 2012-2013 begun, therewere suggestions given by senior members of theprofession touching on the issues of membership,proper parliamentary procedures during the AGM,responsible makeup of the disciplinary committeeof the MDA, rationalisation of the number of councilmembers by correcting typos, affiliates of the MDA andvarious other matters. Each council meeting touchedon the matters to varying depths.the 6th MDA Council Meeting on the 7th of April 2013.Members can scrutinize the draft to be tabled in theAGM in the MDA <strong>Annual</strong> <strong>Report</strong> of 2012/2013.Corporate Social ResponsibilityThis year Oral Health Month (OHM), a joint collaborationbetween Colgate-Palmolive Malaysia and <strong>Malaysian</strong><strong>Dental</strong> <strong>Association</strong> was successfully launched byDr. Khairiyah Abdul Mutalib, Principal Director ofOHD who was representing YB Datuk Rosnah AbdulRashid Shirlin, Deputy Minister of Health, MOH. Thetheme for this year OHM is ‘Let’s Aim for SuperiorHealth’. Oral Health Month is about providing theeducation,awareness and tools needed to promoteoral health and reduce oral diseases in Malaysia. As isour yearly practice, the volunteers from the memberof MDA offer free dental check-ups at all Oral HealthMonth marquees and participating clinics. This is anopportunity for the public to get an update on thestate of their oral health, and to learn more from themembers about the importance of oral health for theirtotal well-being.Continuous Professional DevelopmentContinuous Professional Development (CPD) is anongoing program of learning for all members toconstantly update their professional knowledge. Themain duties of the MDA CPD committee are to verifyMDA organized CPD activities for MDC accreditation,maintain an annual CPD calendar and conduct EveningLecture Series in small groups for members.MDA CPD committee under the chairmanship of DrKalaiarasu Peariasamy successfully conducted monthlyCPD Evening Lecture Series (ELS) both in Kuala Lumpurand regionally. This year was marked by an increasingnumber of dental professionals attending the ELSwith an average of 60 participants per lecture. <strong>Malaysian</strong> <strong>Dental</strong> <strong>Association</strong>HONORARY GENERAL SECRETARY’SREPORT 2012-2013I am proud to report to you that the <strong>Malaysian</strong><strong>Dental</strong> <strong>Association</strong> is going from strength to strengthwith membership numbers close to 5000 (includingundergraduates) as of 31 March 2013. We expect thisnumber to grow significantly with the addition ofnew dental graduates in the coming years. The risingnumber of members augurs well for our association aswe strive to represent one strong consolidated voice ofour profession.We have received positive and constructive feedbacksfrom members during our roadshow nationwide tobrief practitioners on the new <strong>Dental</strong> Bill. Suggestionswere well taken and put forward to the <strong>Malaysian</strong><strong>Dental</strong> Council for further deliberation. In manyinstances, MDA through the good office of PresidentDr Haja, who also sits in the <strong>Malaysian</strong> <strong>Dental</strong> Council,was able to propose, amend and fine tune the New<strong>Dental</strong> Bill. This exercise would not have been achievedwithout contributions and input from proactive MDAzones. My word of thanks to all zone chairmen andtheir respective team.The workload as a General Secretary is rather heavyand demanding yet the joy is begining to pay off. Imust admit that the entire MDA council is made upof strong, diligient and dedicated members whereeveryone has contributed significantly in the runningof the association. <strong>Annual</strong> <strong>Report</strong> 2012/2013THE HONORARY FINANCIALSECRETARY’S REPORT FOR THEFINANCIAL YEAR ENDING31ST DECEMBER 2012It is with great pleasure I hereby present the <strong>Malaysian</strong><strong>Dental</strong> <strong>Association</strong>’s financial statements for the yearended 31st December 2012 (FY2012). The financialstatements are drawn up so as to provide a completeand accurate representation of the <strong>Association</strong>’sfinancial position. All accounting records have beenassiduously cached, adhering to proper and strictaccounting procedures as is required in an associationof this magnitude. Thus I am pleased to report thatMDA maintains an excellent financial health status asconcurred by our auditor.The <strong>Association</strong> managed to deliver a strong andhealthy balance sheet as at 31st December 2012with net current assets amounting to RM5.3 million.This was mainly due to the increase in cash andbank balances of RM3.6 million and RM1.6 millionrespectively representing the <strong>Association</strong>’s cash andcash equivalents of RM5.2 million up from RM4.2million as at 31st December 2011.Thank you.Sincerely,Financial Performance and PositionDuring the year under review, the <strong>Association</strong>’s totalincome stood at RM4.32 million amounting to a slightincrease from last year. Anestimate is made for doubtful debts on a review of all outstanding amounts as at the balance sheetdate.PayablesPayables are stated at cost which is at fair value of the consideration to be paid in future, whether ornot billed to the <strong>Association</strong>.Financial InstrumentsFinancial instruments carried on the balance sheet include cash and bank balances, debtors andcreditors. The particular recognition methods adopted are disclosed in the individual accountingpolicy statements associated with each item.Impairment of AssetsAt each balance sheet date, the <strong>Association</strong> reviews the carrying amounts of its assets to determinewhether there is any indication that those assets have suffered an impairment loss. If any suchindication exists, impairment is measured by comparing the carrying values of the assets with theirrecoverable amounts.Income TaxIncome tax on the profit or loss for the year comprises current and deferred tax. Current tax is expectedamount of income taxes payable in respect of the taxable profit for the year and is measured usingthe tax rates that have been enacted at the balance sheet date.41


<strong>Annual</strong> <strong>Report</strong> 2012/2013Deferred tax is provided for, using the liability method, on temporary differences at the balancesheet date between the tax bases of assets and liabilities and their carrying amounts in the financialstatements. In principle, deferred tax liabilities are recognised for all taxable temporary differencesand deferred tax assets are recognised for all deductible temporary differences, unused tax losses andunused tax credits to the extent that it is probable that taxable profit will be available against whichthe deductible temporary differences, unused tax losses and unused tax credits can be utilised.Deferred tax is measured at the tax rates that are expected to apply in the period when the asset isrealised or the liability is settled, based on tax rates that have been enacted or substantively enactedat the balance sheet date. Deferred tax is recognised in the income statement, except when it arisesfrom a transaction which is recognised directly in equity, in which case the deferred tax is alsocharged or credited directly in equity.(h)Income RecognitionAll income, including membership subscriptions and entrance fees are recognised on receipts basisexcept for interest income and rental income which are recognised on an actual basis.(i)(ii)Employee Benefits(i) Short Term Employee Benefits Wages, salaries, social security contribution, bonuses andnon-monetary benefits are accrued in the period which the associated services arerendered by the employees.Post-Employment BenefitsThe <strong>Association</strong> contributes to the Employees’ Provident Fund (“EPF”), the national definedcontribution plan. The contributions are charged to the income statement in the period towhich they are related. <strong>Malaysian</strong> <strong>Dental</strong> <strong>Association</strong>We have gone from strength to strength under the able leadership of our President, Dr Haja Badrudeen. He haslent much support to the MDJ Transformation Project. This project is the brainchild of our dynamic MDJ Editor, DrHaizal Mohd Hussaini. Through his vision and courage, he has significantly increased the visibility and accesibilityof the journal by introducing it online (www.mdj.org.my). This step has doubled submissions, especially frominternational authors.The second phase of the MDJ transformation will include the implementation of online manuscript submissionand management system to improve efficiency of handling submissions. The management of manuscripts isprimarily aimed at attracting the right volume, the right subject matter as well as the right depth of knowledgein the manuscripts submitted for consideration.I would like to take this opportunity to thank all MDA members who have kindly allowed me the opportunity toserve as Honorary Publication Secretary for the 3rd term. We had organized 11 CPD programme throughoutthe term, and we have achieved new record in terms of the number of participants and traders for the 11thPenang <strong>Dental</strong> Congress, there were 550 participants and 40 dental traders and 54 booths.On top of that, in order to foster a good relation amongst MDA Northern Zone members, family members’dental suppliers and friends, this year again an exciting and memorable Extra Oral Exploration (TreasureHunt) was organized in Balik Pulau Penang.8. Datuk Seri Panglima Musa Hj Aman.The past one year has been a very fruitful year for <strong>Malaysian</strong> <strong>Dental</strong> <strong>Association</strong> Eastern Zone. Since its inceptionin 2010, the Zone has progressed tremendously in its number of activities. Indeed, all of these hard works wouldnot be possible without the support from all its members. The Zone has proven its capabilities to organise majordental congress of international standing. The task to organise the 2012 Commonwealth <strong>Dental</strong> <strong>Association</strong> /<strong>Malaysian</strong> <strong>Dental</strong> <strong>Association</strong> / FDI World <strong>Dental</strong> Federation Joint International Scientific Convention & TradeExhibition cum 69th MDA AGM at Kuching, Sarawak, was not easy and full of obstacles along the way. Our hatsoff to Dr John Ting Sii Ong, Organising Chairman, for a splendid leadership, Central Committee of <strong>Malaysian</strong><strong>Dental</strong> <strong>Association</strong>, and to the whole local organising committee for working extremely hard to make this eventa success.Under the dynamic and capable leadership of the Organizing Chairman Dr. John Ting and his team,we had successfully attracted more than 1500 dental personnels and dental traders to gather in Kuching for theoccasion. To a lot of our colleagues and dental traders, Kuching was one of the destinations they had liked tovisit for a long time. The Kuching River cruise for the international and local speakers and senior MDA memberswas very fascinating and memorable although there was heavy rain. The informal night at the poolside of theMagherita Hotel with local musical performances attracted the most attendances to any informal nights everheld by MDA. The whole function area was packed with food and fellowship, implanting many unforgettablememories. We would like to thank the Chief Minister Sarawak Yang Amat Berhormat Pehin Sri Haji Abdul TaibMahmud for hosting the Gala Dinner for all the participants at BCCK, Kuching, Sarawak. The Zone was alsoinvolved at an international level with our Honourary Secretary, Dr Leong Kei Joe, who was appointed as theEditor – in – charge for the Asia Pacific <strong>Dental</strong> Federation Newsletter June 2012.Apart from this major dental congress, the Zone has organised numerous Continuing Professional Developmentactivities for its members and actively providing community dental service to the public as Corporate SocialResponsibility (CSR) projects either on its own or in collaboration with other organisations including the OralHealth Division, Ministry of Health, Malaysia. The Sarawak State Government has also provided one set ofequipment free for mobile dental clinics for the needy dentists in any outreach project. <strong>Annual</strong> <strong>Report</strong> 2012/2013Dr. Matthew Hong asked if a specialist dental clinic can be taken over by general practitioner. The presidentwas at the opinion that the specialist clinic can still carry on as long as the specialist is still working in theclinic, otherwise the “specialist” wording should be removed from the signboard.Dr. Leong commented on the issue of the illegal dentist has been practicing tens of year in Johor Bahru,if they were caught they are penalized for a few thousand ringgit. Moreover, there are a few dentallaboratories start migrating to the lower floor of busy business buildings, with a prominent shop front. Afew of his neighbor have complaining that the laboratories involved in providing services such as dressingand filling, dentures etc. on the patients. Dr. Ratna reported that she had won the case in a court battlewith an illegal dentist. The illegal dentist has been busted by the authority but he is still practicing becausesome of the crown and bridge cases were wrongly sent to her. She highlighted the changes and the rationale of the amendments. The 47.2 received heavyfocus on the privileging and definition of the “specialist procedures”. The MDA Northern, Southern and EasternZones has put up the following resolution:1) Clause 47.2 should be removed completely. This clause restricts the freedom of practice of the generaldental practitioners(GPs). We believe that GPs can perform any dental procedures they feel confident inas long as they understand that they are legally responsible for the treatment rendered. This is in line withadvanced countries like the United States and the UK and Australia where they do not have this clause.72


<strong>Malaysian</strong> <strong>Dental</strong> <strong>Association</strong>The boundary of GPs and Specialists field of practice cannot be demarcated clearly. The mechanism ofprivileging is not clear. The wording of the clause is ambiguous and subject to subjective interpretationof various parties which may divert from the original intention of the law makers. The restriction willdemoralize and discourage the GPs to advance in their knowledge and skills.2) <strong>Annual</strong> Practicing Certificate - to have only 1 principal address , and able to practice anywhere in Malaysia.Government dental officers have one address, which is the Ministry of Health and they can practice dentistryanywhere in the country to which they may be posted.3) Severe penalties: We feel that the dental practitioners are criminalized under the act and the penalty is tooheavy compare to other professionals. The medical act imposes a maximum fine of RM100,000 while thedental act metes out fines up to RM300,000 and 6 years imprisonment. The Committee has met aon06/12/2012 and the following feedback was forwarded to the MDACouncil for consideration and action:“The <strong>Malaysian</strong> <strong>Dental</strong> Council Fund• Clause 11.(1)The administration of the Fund must be transparent. The fund should be audited by external auditor and bemade known to the the public.There might be conflict of interests if the MDC acts as a prosecutor/judge and the fines/penalties arechanneled into the fund.73

(1) An authorized officer may enter and inspect the premises in which a registered practitioner ispracticing dentistry in which there is reasonable grounds to believe that a person is committing an offenceunder this Act…84.(1) If it appears to a Magistrate, upon written information on oath and after such enquiry as he considersnecessary, that there is reasonable cause to believe that any premises has been used or is used or is aboutto be used for the commission of an offence under this Act, the Magistrate may issue a warrant authorizingany authorized officer named therein to enter the premises during business hours….Compare 83.1 & 84.1, the “authorized officer” may conveniently enter into a “premises in which a registeredpractitioner” and those not necessary registered. There is an issue of discrimination (a registered practitioneris more inferior and unprotected compare to those which might not be registered) and are open to therisk of abuse of power.We request that the exercise of the power of 83. (1) should be monitored and we suggest thati) The authorized officer should inform the Director General present the evidence and of the suspectedpremise (The Director General should be duly informed of the proposed raid on a dental premiseand that there are sufficient evidences/ proofs of such an offence/s being committed under the ACT, before the DG issues and authorizing letter to an officer for the said raid of the premise.)ii)After satisfied with the evidence, the Director General then authorize the raid on the premise• 99.9 Notice to registered person to serve as a dental officer in the public servicesThe decision of the Minister …. shall be final and shall not be questioned or reviewed in any court.Power of Minister to grant reduction, exemption or postponement from period of service under section100 101.(4)The decision of the Minister …. be final and shall not be questioned or reviewed in any court.We hope that the <strong>Dental</strong> Bill respect the independence and balancing amongst the Administrator, lawmaker and the Justice System, and hence provide the check and balance required for the progress of ademocratic country, hence the clause which give the absolute power the to Minister to be removed.• SEVENTH SCHEDULE: PROCEDURES THAT MAY BE CARRIED OUT BY A DENTAL THERAPIST IN THE PRIVATESECTOR1. A <strong>Dental</strong> Therapist employed in the private sector may carry out the following procedures:(a) Clinical procedures on deciduous teeth except 2(g) ( request to delete “ persons below theage of 18 years”)(b) Clinical procedures on special needs children below the age of 12 years;(c) <strong>Dental</strong> health promotion, education and instruction; and(d) Intra-oral photography on instruction of the dental surgeon.2. Clinical procedures that may be carried out by a dental therapist in the private sector referred to insubsection (1)(a) and (1)(b) shall be limited to the following:(a) Oral examinations;(b) Class I, II, III and V restorations on DECIDOUS TEETH, using direct restorative materials; (Nofilling/drilling of permanent teeth)(c) Administration of local infiltration anaesthesia;(d) Extraction of primary teeth;(e) (i) Placement of fissure sealants on deciduous teeth(II) Placement of fissure sealants on permanent teeth where the fissure has no decay and/or the stain cleanable with polishing and not drilling.74

These young dentistswould have their income derive from simple procedures such as scaling and filling. Added to the work forceis the dental therapist which will take part of the job/income from the younger dentists. Nevertheless, wedo see the rationale to include the dental therapist under the <strong>Dental</strong> Bill for easier regulation, rather thanput them in a different Act which the MDC may not have control on.• However, we are at the opinion that the dental therapist should only do simple and relatively “safe” ,“uninvasive” or “reversible” procedures , which filling on adult teeth MAY not fall in the category of relatively“uninvasive” or “reversible”. We suggest no fillings on the permanent teeth regardless of the age of thepatients. This clears the doubts of having to screen the patient for month and year of birth date and thereis no excuse of treating a permanent molar and try to defense by giving excuses of mis-interpretation ofpatient’s age. This limit and reduced the liability/risk to the deciduous teeth which is LATER dispensable(except rare case of deciduous without successor teeth) and reduce the exposure of medico-legal claims.• The age of 12 & 18 is a convenient copy (if not arbitrary) from the government version which is differentfrom and has little to do with the private practice scenario. The ages limits set are related to primary andsecondary school children ages’, not to the disease pattern nor treatment needs.• The dental therapist in government treating school children has a homogenous patient pool based onthe school classes and can be easily controlled, whereas the patients that walk into a private practice aregenerally a diversified, demographically and hence more difficult to control/monitor and may be subjectedto abuse.We suggested the dental therapist should work under the prescription of the dentists. Their works shouldbe supervised (on site) or audited (off-site) by the supervising dentist. It is strongly encouraged that the<strong>Dental</strong> Practitioner be the first to examine the new patient before the patient is seen and treated by thedental therapist.The dental therapist might have the training to performed simple examination and diagnosis, However, forthe patient safety we suggest the patient should be screened by the dentist before the dental therapistcommence the treatment. (There was a real case where a hygienist in Singapore failed to take note norgave pre-medication to a patient with heart valve problem, and was only found later by the dentist whomcheck through the hygienist works)The dental therapist should not portrait themselves as the qualified dentists nor can they do procedures otherthan prescribed, especially if the supervising dentist is not around.We request heavy penalty for the dental therapist if they perform procedures beyond the scope of the Bill. Thesame applies to the dentists that allow/instruct the therapist to cross the red line.We expect the boundary of job scope of the dental therapist is clear cut. It is difficult to monitor a legal personin the clinic doing illegal work(out of the scope of the provision of the Bill) and the safety and well being of thepatient may be jeopardized.Singapore has stopped to produce the their version of <strong>Dental</strong> Therapist after a few years of implementation. Minister, Deputy Minister and Senior Officials of the Ministry of HealthThe new Minister of Health is YB Datuk Seri Dr. S. Subramaniam while the new Deputy Minister is YB Dato’Seri Dr. Hilmi bin Hj. Yahaya. The Secretary-General of the Ministry of Health is Datuk Farida binti Mohd. Aliwhile the Director-General of Health (DG) is DatukDr. Noor Hisham bin Abdullah.2. Repeal of the <strong>Dental</strong> Act 1971The <strong>Dental</strong> Bill is the first impending Act in Malaysia to undergo public engagement. This was successfullyundertaken and much feedback was received, following which amendments were made to the draft Bill.The Bill is now being finalised at the Attorney-General’s Chambers before being tabled to Parliament.Amongst the issues addressed include the inclusion of dental nurses (therapists) under the new <strong>Dental</strong> Act.Since dental therapists are operating auxiliaries, it is appropriate their practice is regulated under the sameAct.3. Continuing Professional Development (CPD) Points for <strong>Annual</strong> Practising Certificate (APC) RenewalA proposal has been made for MDA to be verifier of CPD activities for members of the association.4. <strong>Dental</strong> Specialist RegistrationWith the repeal of the <strong>Dental</strong> Act, and the establishment of a Specialist Division, in principal the list of dentalspecialists who are currently registered with the National Specialist Register (a collaboration between theMinistry of Health and the Academy of Medicine of Malaysia), will be transferred to the <strong>Malaysian</strong> <strong>Dental</strong>Council (MDC). The mechanism for this is being worked out.5. Autonomous LiberalizationUnder autonomous liberalization, specialist dental services may be provided by foreign dental practitionersat hospitals. The credentials of intending practitioners are currently submitted to the National SpecialistRegister for recognition as specialists, pending the establishment of the Specialist Division under the new<strong>Dental</strong> Act. When requirements meet the set criteria, these specialist practitioners are given TemporaryPractising Certificates, renewable yearly.Meanwhile, a letter from MDA to the Hon. Minister of Health objecting to foreign dental specialists settingup standalone clinics has been noted by BahagianDasardanPerhubunganAntarabangsa of the Ministry.6. Conjoint Board for <strong>Dental</strong> EducationA Conjoint Board for Post-graduate <strong>Dental</strong> Education has been established by the Ministry of (Higher)Education. The role of this Board is to set criteria and look into aspects of postgraduate dental courses inthe country.7. Moratorium on New <strong>Dental</strong> Undergraduate ProgrammesThe Ministry of (Higher) Education has agreed to a moratorium of 5 years on new local dental undergraduateprogrammes beginning from 1st March 2013. Currently, there are 13 institutions of higher learning offeringthe dental curriculum, while 2 more about to start.77

Accreditation of <strong>Dental</strong> FacilitiesDiscussions are on-going with the <strong>Malaysian</strong> Society for Quality in Healthcare (MSQH) for accreditationof dental facilities, particularly following a report by Price Waterhouse Coopers on <strong>Dental</strong> Tourism where itwas stated that there is still no mechanism for accreditation of dental facilities in existence. Accreditationof dental facilities is considered necessary for participation in healthcare travel.9. Support for the 35th Asia Pacific <strong>Dental</strong> Congress (APDC)The Oral Health Division of the Ministry of Health supported the 35th APDC by sponsoring more than 1,000participants to the Congress while ministerial funds were used to assist in funding the Opening Ceremonyin order to help make the event a resounding success. In addition, assistance was also provided for theprinting of souvenir programme books. At the Congress, the Ministry of Health conducted a <strong>Dental</strong> PublicHealth Symposium, contributing speakers who touched on policies as well as plans and achievementsof the Ministry for oral health in the country. A booth providing information on oral health promotionefforts by the Oral Health Division, and another on the <strong>Dental</strong> Practitioner Information ManagementSystem (DPIMS) and other information relating to the regulation and practice of dentistry by the <strong>Malaysian</strong><strong>Dental</strong> Council, were manned by staff of the Ministry of Health. Information sheets on DPIMS, the NationalOral Health Survey of Adults 2010 (NOHSA 2010) and a booklet, “Milestones in Dentistry” were distributedduring the Congress. The Director-General of Health, Deputy Director-General of Health (Research andTechnical Support) and the Principal Director of Oral Health were the Guests of Honour at functions heldduring the Congress.10. New <strong>Dental</strong> Specialties for the Ministry of HealthSpecial Needs Dentistry is a new specialty in the Ministry of Health while recognition for the specialty ofForensic Odontology has been given on a personal-to-holder basis in the Ministry.11. Gazettement of <strong>Dental</strong> Public Health SpecialistsThe process for gazettement of dental public health specialists in the Ministry of Health is being continued.12. National Blue Ocean Strategy (NBOS)The Ministry of Health has been involved in many efforts towards the implementation of NBOS. The NBOS 7has been implemented with the theme “1Malaysia Family Care”. Target groups for implementation includethe elderly (involving Ministry of Defence veterans, too), persons with special needs and single mothers.The oral health programme of the Ministry needs to ensure that these groups are targeted in activitiesundertaken. Collaboration with other agencies is very much encouraged.Meanwhile NBOS 8 involves the provision of mobile services to the community. The dental services in theMinistry have been utilising this mode of delivery since its early days. More initiatives towards this togetherwith the inclusion of innovative efforts are being undertaken.13. Rural Transformation Centres (RTCs) and Urban Transformation Centres (UTCs)Several RTCs (in Gopeng, Perak; Kota Bharu, Kelantan; Kuala Kedah, Kedah; PekanNenas, Johor;TanjungManis, Sarawak; and Kuala Linggi, Melaka) and UTCs (BangunanDuniaMelayuDunia Islam, Melaka;and PuduSentral, Federal Territory Kuala Lumpur) have been set up with dental clinic as a component withoperating hours from 8.00am to 10.00 pm daily. The delivery of oral healthcare at these facilities are mainlyfor the relief of pain, and management of conditions requiring immediate treatment. More of such centresare being established.14. Amendments to the Regulations of the Private Healthcare Facilities and Services Act 1998A forum was held with the profession on the amendments to the above Act (Act 586) in September2012, where private dental practitioners have agreed that Professional Fees remain as in the current 13thSchedule. However, the quantum of charges shall be changed.78

Transformation of the <strong>Malaysian</strong> Healthcare SystemPlans to develop an integrated healthcare system that is responsive and provides choice of quality healthcare, improving universal coverage for the population based on the principles of solidarity and equity, withstrong public financing and good financial protection are being discussed with the ultimate goal of healthgain for <strong>Malaysian</strong>s.The current healthcare system is a dichotomous public and private system (2Care). Many resources existoutside of the public sector which can be turned into a seamless system (1Care) for the benefit of thepopulation. Integration of care from primary, secondary to tertiary levels can be made available to all.Quality of care across all healthcare facilities and providersneeds to be assured, while at the final stages, acost-effective mechanism for the provision of healthcare will have to be worked out. The engagement ofstakeholders will be done throughout.16. Patient Safety GoalsThe National Patient Safety Council has approved 13 Patient Safety Goals which are to be monitored atpublic and private clinics and hospitals.17. The First Year <strong>Dental</strong> Officer ProgrammePrevious plans to extend the First Year <strong>Dental</strong> Officer (FYDO) Programme of the Ministry of Health to a2-year programme have been reverted back to the 1-year programme due to the exigencies of service.Meanwhile, compulsory service with the Ministry remains at 2 years.18. Fake BracesThe availability of fake braces sold through the black market, kiosks at marketplaces and through onlinewebsites was highlighted to the Oral Health Division. A press statement cautioning the public about thesafety of these fake braces was issued by the Hon. Minister of Health.19. <strong>Annual</strong> <strong>Report</strong> 2012/2013The organization of the 35th APDC to date has proceeded extremely well due to the deep commitment anddedication of the members of the Organizing Committee.The outstanding features of the various components of the Congress are as follows :1. The Scientific Programme :There are eleven (11) Hands-on Workshops and Limited Attendance Courses featuring the latest techniquesand technologies. They are well subscribed.The Programme features more than 40 internationally acknowledged experts.matches the best we have ever organized at a Scientific Convention.In scope and content itIt fulfills a vital niche for the actively practicing dental professional in his obligatory pursuit of ContinuingProfessional Development.2. International <strong>Dental</strong> Trade and Industry ExhibitionThere were 240 Booth spaces in the designated Exhibition Area.Of these about 200 were rented out to Exhibitors with special consideration given to Sponsors. Theremaining were either sold for Table Clinics or given to Organizations with similar objectives for promotionalefforts (reciprocating previous gestures extended by them).3. The Social programme consists of many Tour arrangements mainly on subscription basis. TheOpening Ceremony, Welcome Reception and the Gala Dinner are the Special events.Due to the impending 13th General Elections, we were unable to confirm the attendance of VIPS for theSpecial Events.A main feature of the Congress is the organization of this mammoth event in the main, without a ProfessionalCongress Organizer. A PCO was used to a limited extent for the Opening Ceremony.I must, in all sincerity, honesty and humility express my deepest gratitude and appreciation to all membersof my Committee who repeatedly answered the call in the spirit of true selfless sacrifice and commitmentto ensure the successful delivery of this mega event. <strong>Annual</strong> <strong>Report</strong> 2012/2013RESOLUTION 3Date 23/5/2013I the undersigned, member of the <strong>Malaysian</strong> <strong>Dental</strong> <strong>Association</strong>, hereby resolve that the <strong>Malaysian</strong> <strong>Dental</strong><strong>Association</strong> through its President and Council Members, apply urgently to the Honorable Minister ofHealth, to allow the stakeholders of the dental profession in Malaysia to review the proposed <strong>Dental</strong> Bill2013. This would enable the concerned stakeholders to go through, the various provisions and issuesthat are incorporated , in this proposed Denta Bill 2013, especially the new ones, submit their views tothe relevant authorities.Thanking youYours sincerelyDr R. VijendranRESOLUTION 4The <strong>Malaysian</strong> <strong>Dental</strong> <strong>Association</strong> Southern Zone proposes that the general body of the MDA pass aresolution to review the DENTAL BILL 2013 for the following reasons:-1. Though it is true that the proposed <strong>Dental</strong> Bill 2012 and later renamed <strong>Dental</strong> Bill 2013 was posted onthe net for 30 days last year, it was not satisfactorily scrutinized by all the stakeholders. It is a heavilyrevised document based on the original <strong>Dental</strong> Act 1971 that included many new sections anddetails that should have been opened to all the stakeholders for a much longer period than 30daysand should have been vetted thoroughly with expert professional advice. Such an exercise is vitalbecause it is a very important document that will determine the future health of the profession andthus the dental health of the nation. A new bill is okay provided due diligence has been exercised.The alternative is to tweak our old bill to make it better.2. The heavy penalties as compared to the Medical Act of Malaysia, the inclusion of dental therapistsas dental practitioners, the setting up of the <strong>Malaysian</strong> <strong>Dental</strong> Council as a body corporate, therequirement of putting every address where a dentist practices apart from the principal addressinto our APC as compared to what is required of our medical colleagues, the guidelines for specialistregistration and rules that may limit the legitimate practice of dentistry are just a few areas thatneed to be relooked with greater care for the sake of the public at large.The above mentioned <strong>Dental</strong> Act has not been tabled in Parliament. We would like this Bill to bereviewed by the <strong>Malaysian</strong> <strong>Dental</strong> <strong>Association</strong> and propose that a committee be set up for thispurpose.
