<strong>Right</strong> <strong>to</strong> <strong>Buy</strong>Who is eligibleYou may have the right <strong>to</strong> buy your home in thefollowing circumstances;You may be eligible for the Preserved <strong>Right</strong> <strong>to</strong> <strong>Buy</strong>(PRTB) if you are a tenant of <strong>Eastlands</strong> <strong>Homes</strong> andyou were a tenant of Manchester City Councilprior <strong>to</strong> the transfer of your home <strong>to</strong> <strong>Eastlands</strong><strong>Homes</strong> in September 2003 or March 2009 (thismeans that you have a protected tenancy). Theremust have been no breaks in your tenancy sincetransfer from Manchester City Council.You may be eligible for the <strong>Right</strong> <strong>to</strong> Acquire(RTA). You can use this scheme <strong>to</strong> buy your homeif you are an <strong>Eastlands</strong> <strong>Homes</strong> assured tenant, inarmed forces accommodation, or as an assuredtenant of a Registered Social Landlord (RSL), suchas <strong>Eastlands</strong> <strong>Homes</strong> (this period increases <strong>to</strong> fiveyears if your tenancy started on or after 18January 2005).You must occupy the property as your only orprincipal home and your home must be a selfcontainedproperty.Who is not eligibleYou may not be able <strong>to</strong> apply for the PRTB or RTAif; a court makes a possession order that says thatyou must leave your home, you are declaredbankrupt and your bankruptcy order is still inforce or you have made arrangements withcredi<strong>to</strong>rs (people you owe money <strong>to</strong>) and you stillowe them money.Other things that may s<strong>to</strong>p you using the PRTB orRTA are:<strong>Homes</strong> that are particularly suitable for an elderlyperson such as Sheltered Accommodation.A home that was let <strong>to</strong> you or the previoustenant on the condition that you or other peopleliving in the property were over the age of 60before 1 January 1990.<strong>Homes</strong> where we have served a demolitionnotice. We do not have <strong>to</strong> let you buy your homewhile the notice is in force.There are other rules that may mean that youcannot use the PRTB or RTA scheme <strong>to</strong> buy yourhome. You cannot apply <strong>to</strong>buy your home until your tenancy is converted <strong>to</strong>an assured tenancy.Can I buy my home with other family members?Yes you can buy your home with up <strong>to</strong> threemembers of your family but we will check <strong>to</strong> makesure they have been living with you for more thanone year and the property you are buying is theironly or main home.Can other family members buy my home onmy behalf?Family members can provide you with the money<strong>to</strong> purchase your property. However, the purchasewill be in your name (the tenant) only and anyother family members who are living in theproperty with you for the required 12 months.What if I am a joint tenant but only one of uswants <strong>to</strong> buy the property?If the tenancy is joint then both people wouldnormally apply <strong>to</strong> purchase the property. If onetenant does not wish <strong>to</strong> purchase he / she mustsign the form consenting <strong>to</strong> the other tenantpurchasing in their sole name.What discount will I get?As a tenant of <strong>Eastlands</strong> <strong>Homes</strong> it is likely you willbe eligible for a discount. It will depend on howlong you have been a tenant and what sorttenancy agreement you have. The maximumdiscount available in the North West is £26,000. Ifyou are eligible for the right <strong>to</strong> acquire there is astandard discount of £10,000 for all applicants.Can I sell my home after I have purchased it?You can sell it whenever you want, but if youapplied for the right <strong>to</strong> buy before 18/1/2005 andsell within three years you will have <strong>to</strong> pay backsome of the discount depending when you sell.After three years you do not have <strong>to</strong> repay anydiscount. If you applied <strong>to</strong> purchase your homeafter 18/1/2005 you will have <strong>to</strong> pay back somediscount if you sell in the first five years afterpurchase.
