Now, because of theTotal Electrification Programme, this number has come down toaround 9 lakhs. Also, kerosene quota has been reduced, and a verymeager amount of kerosene is being given to the State. Now gas isalso not available easily. I would like to know whether the Governmentwill consider increasing the kerosene supply to families so that allfamilies would get, at least, two or three litres of kerosene, which wasbeing given earlier.SHRI R.P.N. SINGH: Sir, PDS kerosene is used <strong>for</strong> cooking andillumination. <strong>The</strong> question that is being raised by the hon. Member isabout fishermen. I can assure the hon. Now, because of the Total ElectrificationProgramme which we have implemented, our quota was reducedcompared to other States. Secondly, I want to know whetherfisheries come under agriculture. Is any State getting the subsidizedquota of kerosene <strong>for</strong> agriculture? And, since fisheries, includingdeep-sea fisheries, come under agricultural activity, I would like toknow whether subsidized kerosene can be given to fishermen.SHRI R.P.N. SINGH: Sir, we are not supplying PDS kerosene <strong>for</strong> anyagricultural purposes. As I have mentioned earlier, PDS kerosene isonly <strong>for</strong> cooking purposes and illumination. We are supplying PDSkerosene quota <strong>for</strong> these two primary purposes. <strong>The</strong> hon. Memberhad asked as to why the quantity of kerosene to Kerala is beingreduced. We have rationalized the quantities of kerosene being

NO. 12 (Contd.)the States had not lifted kerosene during the first two quarters of 2011-12 signifying excess supply over demand. <strong>The</strong> allocation hasaccordingly been reduced by the un-lifted SKO quality of kerosene. InKerala, it was nil. So, we have not reduced it according to thiscategory. In the second category, with the increase in LPG coverageacross the country, it is natural that the requirement of cooking fuel,PDS kerosene, would reduce, and that the allocation of kerosene toStates need to be modified accordingly. <strong>The</strong>re<strong>for</strong>e, it is to be seenwhether the LPG coverage is beyond the national average. <strong>The</strong>national average is 59 per cent, while, in Kerala, the average LPGcoverage was to the extent of 97 per cent. Wherever it has been found to be moreSHORT NOTICE Q. NO. 12 (Contd.)than 19 per cent, we have rationalised it to just ten per cent of thekerosene allocated accordingly. Under this procedure, the cut inKerala has been about 28,370 kilolitres, and I can assure the hon.Member, if any dubious connections or any wrong, faulty connectionsof LPG have been found, we are writing to all States. If there are anydubious connections of LPG connections, if they are cut by theGovernment of any State, we will supply the amount of the number ofLPG dubious connections. According to that cut in LPG coverage,we will give 36 litres of it. <strong>The</strong>re is a large variation in the scales ofkerosene allocation adopted by different States across the country,and, there<strong>for</strong>e, the allocation process has been standardised to 36litres per capita per year to non-LPG production. Accordingly, the cutin Kerala has been 48,562 kilolitres, and in the same way, this hasbeen introduced in all the States of India, which leads to about 39 per

RAJEEVE (KERALA):Mr. Vice-Chairman, Sir, theInternational Arbitration Tribunal, London, recently, gave an order infavour of White Industries Australia Limited (WIAL) and against theGovernment of India.<strong>The</strong> Arbitration Tribunal criticized the IndianSupreme Court, in particular, and the Indian judicial system, ingeneral, and made the Government of India liable to compensate <strong>for</strong>the lapse on the part of our Judiciary. <strong>The</strong> WIAL had entered into acommercial contract with the State-owned Coal India Limited. But,subsequently, a dispute arose between the two and both the partiesapproached the Supreme Court of India. Meanwhile, the WIALapproached the United Nations Arbitration Tribunal.<strong>The</strong>n, anArbitration Tribunal was constituted, which consisted of one member,nominated by the Government of India, one member, nominated bythe Government of Australia, and the Chairman was selected as per

This Tribunal gave a unanimous order against theGovernment of India. It is very shocking that an investor can sue theGovernment of India, as per the bilateral treaty. <strong>The</strong> Government ofIndia has entered into more than eighty bilateral treaties. <strong>The</strong>Executive has done all these things. <strong>The</strong>re is no provision <strong>for</strong> any typeof scrutiny. Any investor can sue the Government of India.Sir, I quote from the orders of the Tribunal, "<strong>The</strong> Tribunal has nodifficulty in concluding the Indian judicial system's inability to deal withWhite's jurisdictional claim in over nine years, and the SupremeCourt's inability to hear White's jurisdictional appeal <strong>for</strong> over five yearsamounts to undue delay and constitutes a breach of India's voluntarilyassumed obligations as per the bilateral treaty and is liable <strong>for</strong>compensation." This is an attack on the sovereignty of the IndianJudiciary. <strong>The</strong> judicial functioning is one of the major sovereignfunctions of a State. <strong>The</strong>re<strong>for</strong>e, it is an attack on the sovereignty ofthe country. <strong>The</strong> Government is not ready to make any publicstatement on this issue. <strong>The</strong> Government is not ready to take anyaction on the member, nominated by the Government of India, in theArbitration Tribunal. <strong>The</strong> independence of Judiciary is a basic feature

That will be essentially in the Bundelkhandarea. That area consists of seven districts of Uttar Pradesh and sixdistricts of Madhya Pradesh. When I tried to introduce the Bill lasttime, same issue was raised. However, there is already a CentralUniversity in Imphal which is catering to seven States. Entry 25 of theConcurrent List of the Constitution reads as follows: “Education,including technical education, medical education and universities,subject to the provisions of entries 63, 64, 65 and 66 of List I;vocational and technical training of labour.” If there was no objectionto setting up Central Agricultural University in Imphal, Manipur then, Idon’t understand why there is objection to set up an AgriculturalUniversity in the area of Bundelkhand. Entry 14 of the State List coversagriculture. It says, “Agriculture, including agricultural education andresearch, protection against pests and prevention of plant diseases.”It is clearly mentioned that agriculture includes agricultural education

We announced that those who wanted to come back toIndia would be provided with the ticket and that they would be sentback to India. At the same time, the issue of arrears which are to bepaid is also taken up with the contractor and the Government by ourAmbassador. At our level also it is taken up with the contractor andthe Government to pay the arrears and to send them back.As far as the case is concerned, the management has, inrespect of the people who have worked, agreed to waive the fineimposed by the court. <strong>The</strong> workers need not pay any fine. That hasbeen waived by the management. <strong>The</strong>y said, “Don’t pay”. Asregards the compensation also, the contractor agreed that they neednot pay it. So, our embassy is involved in it. Due to paucity ofsufficient beds, patients are lying on the floor, and, are waiting <strong>for</strong>medical treatment. This situation further intensifies the severity of thedisease and subsequent increase in casualties.<strong>The</strong>re<strong>for</strong>e, I request the Government to immediately send aCentral Medical Team with entomologists to assess the situation andprovide immediate medical help to the affected people so as toprevent further loss of life. For their whole life,they work as temporary workers and also die as temporary workers.He or she has family responsibility <strong>for</strong> their children’s education,medical care, marriage and other day-to-day expenditures of family.<strong>The</strong>ir salary is one-fourth of regular workers. In public sector also,

But how can there bediscrimination in wages and other allowances between the workersdoing the same volume of work? <strong>The</strong>re should be equal wage <strong>for</strong>equal work and when the Central and the State Governments haveaccepted the Pay Commission recommendations, what is the harm ifthey regularize all DLR, work-charged, NMR workers working invarious departments of Central Government and State Governmentsand Central PSUs and State PSUs.All workers <strong>for</strong> same work must get same wage, allowance,medical care, ESIC and EPF coverage and should also get bonus andpension. Gratuity must be increased to one month per year and thepension of EPF must be Rs. 2,000 minimum per month. All Contract,DLR, work-charged workers should be given gratuity and pension.(Ends)

This is anambitious programme to connect all the Asian countries through landroute as this was the vision of ESCOS. During the freeodom struggle,as early as 1930, Mahakavi Subramania Bharathi sung that byelevating Sethu (Ramanathapuram Kingdom was called SethupathBoomi which includes Rameswaram and Islands) land route to Eelam(Sinhala Island). STRIKE BY AIR INDIA PILOTSTHE MINISTER OF CIVIL AVIATION (SHRI AJIT SINGH): Mr. Vice-Chairman, Sir, we all know that Indian Pilots Guild of erstwhile AirIndia is on strike. It is an illegal strike. <strong>The</strong> Single Bench Judge ofHigh Court declared it as illegal. <strong>The</strong> IPG went on appeal and the TwoJudge Bench of the High Court has also declared it as illegal strike. Infact, on 7 th or so, I had received a call at about <strong>11.00</strong> pm that somepilots had reported sick. So, basically, they had not given any noticethat they are going on strike. <strong>The</strong>y had some discussions with themanagement of the Air India. But, they did not discuss it with the CivilAviation Ministry or they did not even discuss it with me. <strong>The</strong>y wenton a flash strike. Sir, they have four demands, basically, which theyput be<strong>for</strong>e the CMD. <strong>The</strong> first one is, they have some outstanding

BY KS "2A")2a/2:40/ksSHRI AJIT SINGH (contd.):<strong>The</strong>y had obtained a stay from theBombay High Court to the effect that erstwhile Indian Airline pilotswould not be trained on the Dreamliner. <strong>The</strong> ICPA, which is the unionof erstwhile Indian Airline pilots, moved the Supreme Court. <strong>The</strong>Supreme Court vacated the stay and said that it was a managementdecision. <strong>The</strong>re<strong>for</strong>e, Air India had sent 50 per cent erstwhile IndianAirline pilots and 50 per cent erstwhile Air India pilots. That was thesecond issue. In my view, that was the main issue.I come to their third demand. At present, they have anagreement with the management that if they do not get promoted to


134<strong>Uncorrected</strong>/ <strong>Not</strong> <strong>for</strong> <strong>Publication</strong>-<strong>22.05.2012</strong>the Commander's level, by the tenth year, they will be madeCommanders notionally and they would get the pay and all thebenefits even if there was no vacancy.So, even if they had notbecome Commanders, they would get all those benefits. <strong>The</strong>ywanted to reduce this ten-year period to six years. <strong>The</strong>y wanted thatin six years time they should all be made Commanders. Basically,these were the demands.All these issues are being considered under the DharmadhikariReport. <strong>The</strong>se are HR issues. In fact, these are the issues on whichthat whole merger has been held up. <strong>The</strong> Dharmadhikari Report wasreceived by the Ministry on 31 st January. We have looked at it and weare in the process of determining what the impact of their suggestionswould be on pilots, on engineers, on the ground staff, on the cabinstaff. Once we know what the impact would be, then only, we wantto initiate talks with the unions. So, we assured them that within twomonths, we would be talking to them on these issues. <strong>The</strong>y refusedto listen. <strong>The</strong>y reported sick. We sent doctors to talk to them. Sir,seventy to eighty per cent of them were neither at home nor had theygone to any doctor. <strong>The</strong>n, as I said, they moved the High Court, the

Infact, the initial order had said that they should report back to work,which they haven't done. So, the Government's view is, we are readyto discuss all the issues, which we would have discussed with themany way.First, let us all remember, Air India is in a very bad financialsituation. <strong>The</strong>y have not been able to pay their pilots. <strong>The</strong>y owethousands of crores to oil companies.<strong>The</strong>y owe more than athousand crores of rupees to the Airports Authority of India.<strong>The</strong>re<strong>for</strong>e, the Cabinet had approved a Rs. 30,000 crore package torevive Air India. Now, that package is not without strings. We haveput certain check-points in it. We have specified the parameters onwhich they would be judged, like, the turn-around time, the yield, ontimeper<strong>for</strong>mance which, if Air India has agreed to meet, then only, themoney will be released gradually. Let me also in<strong>for</strong>m the House that,in the last three months, Air India had been doing very well. <strong>The</strong>irrevenue had gone up by 35 per cent as compared to the same time oflast year. <strong>The</strong>ir yields went up. <strong>The</strong>ir on-time per<strong>for</strong>mance hadimproved. <strong>The</strong>ir equipment-usage had improved. And this is the

We told the pilots that we were willing to discusseverything and, at this point of time, if they went on strike, that woulddent the credibility of the Air India.I would like to share something with the hon. Members,because I watched it on television and they must have also seen it.One of the passengers who was to fly in by Air India, he had the AirIndia ticket, said on television, "When I die, I will tell my children tonever fly in Air India". That is the kind of anger passengers have. Togo on strike deliberately at this point of time, which is the peakseason, when Air India's credibility was going up, would put injeopardy the thirty thousand crore package, which is certainly withstrings attached, because banks have to take part in a lot of it andthey are not willing to give even the working capital to any airline. Thatis where the situation stands today. We have taken action and someof the pilots have been dismissed. <strong>The</strong>re is a rule that after fourteendays, a pilot has to go in <strong>for</strong> a medical check-up and it has been aconvention that they are asked to present themselves be<strong>for</strong>e specifiedAir Force medical units where they have to undergo the medicalcheck-up. So, that process is on. Again and again, in Parliament,
