RAIL TRANSPORTATION SERVICE PROVIDER RULESSECTION CIII. TRAILER-ON-FLATCAR (TOFC) AND CONTAINER-ON-FLATCAR (COFC)RULESThe rules provided in this part shall apply to the rail movement of loaded or emptytrailers/containers. Other rules set forth in other parts of this publication shall also apply whenapplicable. These rules will also apply to containers without chassis that are moving in COFCservice, where a TSP maintains lift on/lift off facilities at both origin and destination unless priorarrangements have been made to utilize lift on/lift off at facilities other than those of TSPperforming the line-haul service.ITEM 249CUSTOMS OR IN BOND FREIGHT1. A TSP may charge for those Customs or In-Bound Freight fees that have beenactually incurred for customs or in-bond clearance of a shipment, subject to theprovisions of this publication.2. Any shipments that is detained or held in TSP possession in order to comply withcustoms or in-bond clearance requirements may be subject to charges listed inDetention of Vehicles, Item 253, in this section, Storage of Vehicles, Item 283, inthis section. For the purposes of this section, the term ―vehicle‖ is defined as atrailer on flat car (TOFC) or COFC (Container on Flat Car).3. When applying the storage rules and related charges in connection with a shipment,TSP shall be required to immediately notify the Deputy Collector of Customs thatshipment is available for customs inspection, and such notification shall beinterpreted as representing shipment delivery for the purpose of storage charges only.ITEM 251DETENTION OF VEHICLES (DTB)1. Detention of Vehicles (DTB) shall apply where trailers/containers that are railroadowned or railroad-leased are delayed at a shipper/consignee location or at rampawaiting pickup by shipper/consignee, to the following conditions:a. Arrival notification must be provided to the consignee during normal operatinghours.b. In no event shall less than 48-hours free time be permitted per vehicle. Where a numberof railroad-owned or railroad-leased vehicles are made available by a TSP on the samedate, the free time permitted shall be governed under the table below. If ashipper/consignee is unable to load/unload all vehicles within the free time allotted,chargeable time will begin on the next 11:59 PM after termination of that free timeterminates, excluding Saturday, Sunday, and Holidays.
